Resolution 2017-37RESOLUTION NO. 2017-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY RATIFYING THE PROCLAMATION OF A LOCAL EMERGENCY WHEREAS, California Government Code Section 8630 and Chapter 9 of the Gilroy City Code, Emergency Organization and Function, empowers the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when said City is affected, or likely to be affected, by a public emergency, and the City Council is not in session; and WHEREAS, on September 5, 2017, the Acting Director of Emergency Services proclaimed a local emergency due to the Ballybunion (`Bally ") Fire pursuant to this authority, which is attached hereto as Exhibit A; and WHEREAS, under Government Code Section 8630 and Chapter 9 of the Gilroy City Code, the local emergency shall not remain in effect for longer than seven (7) days unless it has been ratified by the City Council; and WHEREAS, the City Council hereby ratifies the existence of the local emergency for the reasons set forth in Exhibit A; NOW, THEREFORE BE IT RESOLVED that: 1. The condition of potential extreme peril to the safety of persons and property arose within said City, caused by the Ballybunion ( "Bally ") Fire that began at approximately 7:13 p.m. on Sunday, September 3, 2017 threatening over 800 homes in the Eagle Ridge Subdivision with the potential for evacuations; and 2. Even after fire containment is achieved, significant fire suppression repair and rehabilitation will be required due to significant hillside damage and potential for mudslides and flooding during the upcoming rainy season; and 3. A federal Fire Management Assistance Grant (FMAG) may be jointly requested by Cal Fire and the City of Gilroy for the Ballybunion (`Bally ") Fire; and 4. The aforesaid condition of potential extreme peril warranted and necessitated the proclamation of the existence of a local emergency; and IT IS FURTHER RESOLVED AND ORDERED that a copy of this Resolution be forwarded to the Director of the California Governor's Office of Emergency Services. PASSED AND ADOPTED this 1 l'' day of September, 2017 by the following roll call vote: AYES: COUNCILMEMBERS: BRACCO, HARNEY, KLOECKER, LEROE- MUNOZ, TOVAR, TUCKER and VELASCO NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE, Nhawna creels, City Clerk Velasco, Mayor RESOLUTION NO. 2017-37 PROCLAMATION OF THE EXISTANCE OF A LOCAL EMERGENCY BY THE DIRECTOR OF EMERGENCY SERVICES FOR THE CITY OF GILROY, CA WHEREAS, California Government Code Section 8630 and Chapter 9 of the Gilroy City Code, Emergency Organization and Function, empowers the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when said City is affected, or likely to be affected by a public emergency, and the City Council is not in session; and WHEREAS, the Director of Emergency Services has designated an Acting Director of Emergency Services to serve in his capacity; and WHEREAS, the Acting Director of Emergency Services of the City of Gilroy does hereby R�� 1. That the condition of potential extreme peril to the safety of persons and property has arisen within said City, caused by the Ballybunion (`Bally") Fire that began at approximately 7:13 p.m. on Sunday, September 3, 2017 threatening. over 800 homes in the Eagle Ridge Subdivision with the potential for evacuations; and 2. That the City Council of the City of Gilroy is not in session and cannot be immediately called into. session.
