A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY ESTABLISHING REQUIRED BONDING FOR
DESIGNATED CITY OFFICIALS
WHEREAS, pursuant to the City Charter Section 808 the City Council shall fix by
ordinance the nature amount and terms of the official bonds of all officials or employees who are
required by ordinance to qualify for such bonds; and
WHEREAS, Section 2.8 of the Gilroy City Code provides that the City Council require
designated city officials to be bonded in such amounts as may be required by resolution; and
WHEREAS, California Government Code Section 36518 requires that the City
Administrator, City Clerk and City Treasurer be bonded and that the penal sum of the bond shall
be in a reasonable amount recommended by the city attorney and fixed by the City Council, by
resolution; and
WHEREAS, California Government Code Section 1481 provides that the City Council
may approve of the use of a master official bond, or other form of master bond, which shall
provide coverage on more than one officer, employee or agent of the City, whether elected or
appointed, who is required by statute or regulation to give bond; and
WHEREAS, the City has entered into a Blanket Public Employee Bond (Commercial
Crime Policy) with Municipal Pooling Authority to provide said coverage.
NOW, THEREFORE, BE IT RESOLVED that the following bond requirements are
hereby established for the following City Officials as required by statute:
1. City Administrator $1,000,000.
2. City Clerk $1,000,000.
3. Finance Director /City Treasurer $1,000,000.
