A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY ORDERING THE VACATION OF A CERTAIN
STRIP OF LAND DESIGNATED AS A PORTION OF A
PUBLIC STREET RIGHT OF WAY DESIGNATED FOR
PUBLIC USE, THE STRIP SHOWN AS PORTION OF
COBBLESTONE COURT SHOWN UPON THAT CERTAIN
MAP ENTITLED "PARCEL MAP" FILED APRIL 18, 2014
IN BOOK 871 OF MAPS, PAGES 17 THROUGH 20,
RECORDS OF SANTA CLARA COUNTY, CALIFORNIA
WHEREAS, to California Streets and Highway Code, Section 8330 et seq., the City
Council may summarily vacate an excess public right -of -way for street or highway purposes by
finding, from evidence submitted, that the excess right -of -way is no longer required for street or
highway purposes and conforms with the provision of Section 8334 of the California Streets and
Highway Code regarding vacation of excess right -of -way; and
WHEREAS, the public street and the related easements were dedicated to the City on the
Map entitled "Parcel Map" filed April 18' 2014 in Book 871 of Maps, Pages 17 through 20,
Records of Santa Clara County, California; and
WHEREAS, the City Council having duly considered all evidence, and followed the
procedure prescribed by law, hereby finds and determines from all of the evidence submitted that
the proposed order of vacation of the public street conforms with the provisions of Section 8333
of the California Streets and Highway Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GILROY, AS FOLLOWS:
1. That the portion of the Public Street and related easements proposed for vacation
were dedicated to the City in on the Map entitled "Parcel Map" filed April 18° 2014 in Book 871
of Maps, Pages 17 through 20, Records of Santa Clara County, California.
2. The City Council, pursuant to Streets and Highway Code, Chapter 4, Section
8330 et seq., hereby orders the vacation of a portion of the public street shown as Cobblestone
RESOLUTION NO. 2018 -08
Court dedicated to the City in on the Map entitled "Parcel Map" filed April 18° 2014 in Book 871
of Maps, Pages 17 through 20, Records of Santa Clara County, California, shown as Exhibit "I ",
"II" and "III" that further described in Engineer of Record Exhibit "A" and depicted in
Engineer of record Exhibit `B "; and
3. This Resolution shall become effective on May 7, 2018 , and shall be recorded by
the City Clerk in the Santa Clara County Recorder's Office shortly thereafter; and
4. From and after the date this Resolution is recorded in the Santa Clara County
Recorder's Office, the portion of the public street and easements shown as Exhibit "I ", "II" and
"III" that further described in Engineer of Record Exhibit "A" and depicted in Engineer of record
Exhibit `B" shall no longer constitute a public street or easement and the land subject to the
public street and easement shall revert to APN: 810 -21 -011 land owner, pursuant to Streets and
Highway Code Section 8351.

VACATION OF A PORTION OF THE PUBLIC STREET AND RELATED EASEMENTS
SHOWN AS COBBLESTONE COURT DEDICATED TO THE CITY IN ON THE MAP

THROUGH 20, RECORDS OF SANTA CLARA COUNTY, CALIFORNIA.

particularly described as follows:
Beginning at the southeast corner of said "Cobblestone Court", also being the easterly
terminus of the course designated as "N89 052'29 "W 561.35 feet" on said Map; thence along the
south line of said "Cobblestone Court", N89 052'29 "W, a distance of 14.50 feet to the west line of
said "Cobblestone Court"; thence along said west line, N00 °06'38 "E, a distance of 505.18 feet to
