Resolution 2019-19RESOLUTION NO.2019 -19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY DECLARING CERTAIN BLIGHT CONDITIONS IN THE CITY TO BE A PUBLIC NUISANCE, DESCRIBING THESE BLIGHT CONDITIONS WHICH CONSTITUTE SUCH NUISANCE, AND PROVIDING NOTICE OF THE ADOPTION OF THE RESOLUTION BY PUBLICATION THEREOF PURSUANT TO GILROY CITY CODE SEC. 5B.20 WHEREAS, the building located at 7574 Monterey Road, Gilroy ("Building") has been vacant and abandoned for many years and is now in a state of disrepair and unsafe condition; and WHEREAS, the property owners, William Singh and Lynette Singh, have received repeated notices from the City regarding Property violations, yet have failed to make all of the necessary repairs to the Building to ensure public safety and address blighted property conditions, as required under Chapters 5B and 6 of the Gilroy City Code; and WHEREAS, Code Enforcement Officer, Scott Barron, has identified various, long- standing structural deficiencies in the Building, visible from the public right of way and exposing the interior of the building to weather damage and vandalism, resulting in local and state building code violations described in the "Violation Notice and Order" sent to the property owners on December 4, 2017; WHEREAS, due to the property owners' failure to respond to or comply with said violation notice, the City sent a Notice of Pending Action to the property owners on February 5, 2018, and resent a copy of the original violation notice by request of property owners, on February 13, 2018; and WHEREAS, the property owners again failed to address the violations identified in said notice, and failed to comply with requirements to make necessary repairs under the applicable local codes and State law discussed in such notice; WHEREAS, based on the foregoing and the observations of the Code Enforcement Officer regarding the blighted and unsafe condition of the Building, the City Administrator has determined that the Building is a public nuisance that must be abated without delay by the destruction or removal of such blighted condition. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy as follows: RESOLUTION NO.2019 -19 That the condition of the Building does now constitute, and will continue to constitute, a public nuisance and it is ordered that said property owners shall, without delay, destroy or remove said nuisance. If the property owners fail to comply with this order, City of Gilroy employees, contracting agents, or other representatives (the "City") shall have the right to abate such nuisance and enter onto the Building property for such purposes, pursuant to the authority provided under Section 513.23 of the Gilroy City Code. 2. If said nuisance and property blight are abated by the City, the costs of such abatement will be assessed upon the lots and lands from which the nuisance and/or property blight is destroyed or removed, in accordance with Section 513.27 of the Gilroy City Code. Such costs will constitute a lien upon such lots or lands until paid and will be collected upon the next tax roll upon which general municipal taxes are collected. 3. That it is ordered that Monday, the 17'h day of June 2019, at the hour of 6:00 o'clock p.m., or as soon thereafter, in the Council Chambers of the City Council at 7351 Rosanna Street, Gilroy, California is hereby fixed as the time and place when objections to the proposed removal or abatement by the City shall be heard and given due consideration. 4. That the City Administrator of the City of Gilroy is hereby ordered and directed to cause notice of the adoption of this resolution and notice of hearing to be provided to said property owners in the manner and form provided in Section 513.21 of the Gilroy City Code, at least fifteen (15) days prior to said hearing.
