A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY REVISING THE COMPREHENSIVE
SCHEDULE OF FEES CHARGED BY ALL DEPARTMENTS
OF THE CITY
WHEREAS, State law allows cities to charge fees or charges for the filing, accepting,
reviewing, approving or issuing of an application, permit or entitlement, so long as the amount of
those fees and charges do not exceed the estimated cost required to provide the service for which
the fees or charges are levied; and,
WHEREAS, the revitalization of Gilroy's downtown will benefit the public by providing
much needed economic development, and,
WHEREAS, resetting certain processing fees for a temporary period of time will help to
reduce barriers to new businesses and to revitalize existing businesses, and,
WHEREAS, these revised processing fees include certain Community Development,
Building Life Environmental Safety and Planning fees, which are set forth in Addendum A, Fee
Schedule for Downtown Commercial Corridor, to the City of Gilroy Comprehensive Fee
Schedule. Addendum A is attached hereto as Exhibit "A"; and
WHEREAS, the Downtown Commercial Corridor is described as those properties that
abut to Monterey Street beginning at the intersection of First Street and ending at the intersection
of Tenth Street, as depicted in Exhibit "B' ; and
WHEREAS, after review and analysis with all departments and the City Administrator,
Staff has prepared and recommended revisions of the City of Gilroy Comprehensive Fee
Schedule, as authorized by the various Sections of the City Code, and,
WHEREAS, the public meeting for the revision of Comprehensive Fee Schedule has
been publicly noticed for August 19, 2019; and,
WHEREAS, this Resolution is exempt from environmental review pursuant to Section
15273 of the State Guidelines implementing the California Environmental Quality Act of 1970,
as amended; and,
WHEREAS, pursuant to Section 7. 4 of the Gilroy City Code provides that all fees and
charges set forth shall take effect after the City Council has duly passed by Resolution the City
of Gilroy' s Comprehensive Fee Schedule.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Gilroy
does hereby adopt the revised processing fees set forth in Addendum A, Fee Schedule for
Downtown Commercial Corridor, to the City of Gilroy Comprehensive Fee Schedule.
Addendum A is attached hereto as Exhibit "A" incorporated by this reference. The revised
processing fees shall apply to all appropriate departments of the City of Gilroy.
