A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY MAINTAINING THE 3% INCREASE ANNUAL
TRAFFIC IMPACT FEE (TIF) INCREASE UNTIL THE
GENERAL PLAN IS COMPLETE AND A NEW TIF
PROGRAM IS ESTABLISHED
WHEREAS, City Staff prepared an analysis on the current state of the Traffic Impact
Fee (TIF) Program, the history of reimbursements over the past few years, and staff s approach
to updating the TIF Program; and
WHEREAS, at the July 1, 2019, City Council meeting City Staff provided its TIF
Program overall budget analysis and project unit costs scheduled for TIF funding; and
WHEREAS, pursuant to Resolution No. 2012-53 the City's 3% TIF annual automatic
fee adjustment (Fee Adjustment) was scheduled to sunset on July 1, 2019, due to the
anticipated completion of the General Plan and implementation of a new TIF program; and
WHEREAS, Resolution No. 2012-53 established that the cost adjustments for the Fee
Adjustment are based on new cost data only, and do not affect the statutory findings made by
the City Council at the adoption of the TIF in 2004.
WHEREAS, Staff has determined that, for the next five years, the TIF Program Fund
has sufficient balance to reimburse all projects expected to request reimbursement so long as
the City Council continues to maintain the 3% TIF Fee Adjustment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy,
that the City will continue to maintain the 3% Fee Adjustment for a period of five years, or
until such time as the General Plan and Transportation Master Plan updates are complete, and
a new Traffic Impact Fee Program can be established.
