Resolution 2020-08RESOLUTION NO.2020-08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY REPEALING RESOLUTION NO. 2014-11 IN ITS ENTIRETY AND ADOPTING A NEW CITY OF GILROY RECORDS RETENTION SCHEDULE TO AUTHORIZE THE MAINTENANCE AND DESTRUCTION OF CITY RECORDS WHEREAS, the City of Gilroy ("City") accumulates records, and from time to time seeks to purge and destroy old records that are no longer needed or legally required to be maintained by the City; and WHEREAS, California Government Code Section 34090 et seq. authorizes the City and it's departments and divisions to destroy, with specified exceptions, records not less than two (2) years old, pursuant to a resolution of the City Council and the written consent of the City Attorney; and WHEREAS, the City previously adopted Resolution No. 2014-11 entitled "the City of Gilroy Records Retention Schedule" which guidelines are presently outdated; and WHEREAS, the City has developed a new comprehensive city wide records retention schedule entitled "City of Gilroy Records Retention Schedule", which includes current records retention and destruction time periods for the City, and is in statutory compliance with current laws. NOW THEREFORE BE IT RESOLVED THAT Resolution No. 2014-11 adopting the previous City of Gilroy Records Retention Schedule is hereby repealed in its entirety, and the City of Gilroy Records Retention Schedule dated December 2, 2019 and attached hereto as "Exhibit A" and incorporated herein by this reference is hereby adopted. BE IT FURTHER RESOLVED that pursuant to California Government Code Section 34090 et seq. all Department Heads are hereby authorized to destroy, with specified exceptions, those records identified within the schedule, with the written consent of the City Attorney which consent has been given.
