A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF GILROY APPROVING THE EXTENSION
OF WATER AND SEWER SERVICES TO
CHRISTOPHER RANCH LABOR CAMP SITE
LOCATED AT 935 SOUTHSIDE DRIVE
WHEREAS, a facility fonnerly known as the Rodriguez Labor Camp has existed
since the 1950s on property at 935 Southside D1ive, Gilroy, California (APN 841-15-005,
the "Property") owned by Christopher; and
'WHEREAS, although the Rodriguez Labor Camp has not been in use for several
years , Christopher desires to refurbish the Property for a project (the "Project") that will
utilize existing buildings for the purpose of providing seasonal agiicultural worker
housing only. The only new building construction will be a small modular home (750 st)
solely to be occupied by an on-site manager for security and maintenance of the Property
to preserve its suitability for agricultural worker housing; and
WHEREAS, workers to be housed at the facility will be employed exclusively in
support of agricultural industries; and workers will be housed in dormitory-style
accommodations, not in independent residential living units, with c01mnunal cooking and
restroom facilities, which shall be occupied only eight to nine months per year (April to
December) or less; and
WHEREAS, a City main north-south sanitary sewer line leading to the nearby
South County Regional Wastewater Treatment Plant is located i1mnediately adjacent to
the eastern border of the Property, and since the 1980s the City has provided sanitary
sewer service to the Property by means of a direct physical co1mection from the Property
to this sanitary sewer line; and
WHEREAS, a City municipal water line for many years has been located on the
Southside drive frontage of the Property; and
WHEREAS, the Property is located within the County of Santa Clara. The
County has issued a use pennit, architectural and site approval and gi·ading approval for
the Project on or about February 27, 2020 (the "County Permits "), subject to various
conditions of approval; and
WHEREAS, the City has surplus capacity in its municipal water system to
provide municipal water service to the Property and capacity tlu·ough the South County
Regional Wastewater Authority to continue to provide sanitary sewer services to the
Property, for the uses consistent with the County Pennits and this Agreement; and
WHEREAS, due to the isolated location of the Property and the limited
agricultural employee housing use to which it will be put under the County Pennits

(which ex plicitly do not allow general residential use), the City has found and detennined
that the extension of surplus water service to the Property limited to the uses described
above will support agricultural industries and will not either support or induce
development, and thus is consistent with the provisions of California Government Code
Section 56133(d)(3) and does not require approval of the Santa Clara County Local
Agency Fonnation Commission.
NOW, THEREFORE, BE IT RESOLVED , by the City Council of the City of Gilroy
that:
1. The Interim City Administrator is authorized to enter into that certain agreement
(the "Agreement") with Christopher Ranch LLC entitled "Agreement for
Provision of Limited Municipal Services to Project Supporting Agricultural
Industries" dated March 16 , 2020.
2 . Pursuant to the tenns of the Agreement, and all applicable City ordinances,
policies, regulations and procedures now in effect or hereafter adopted for
commercial municipal water and sanitary sewer customers, City will prov ide
municipal water and sewer services to the Property solely for the use of the
agricultural employee housing project described in the County Permits.
