Call to Order The meeting was called to order at 6:00 p.m. by Mayor Marie Blankley 1. Pledge of Allegiance Council Member Marques led the Pledge of Allegiance. 2. Invocation Pastor Malcom MacPhail from New Hope Community Church provided the invocation. 3. Employee Introductions Fire Chief Jim Wyatt introduced rehired employee Kellie Bourke as the Fire Administration Technician for the Gilroy Fire Department. II. CEREMONIAL ITEMS A. Proclamations, Awards, and Presentations 1. Proclamation Naming October 29, 2021 as Arbor Day Proclamation was acknowledged, but not read aloud since the date for Arbor Day had already passed. 2. Proclamation Naming November 27, 2021 as Small Business Saturday Mayor Blankley read the Proclamation naming November 27, 2021 as Small Business Saturday. III. PRESENTATIONS TO THE COUNCIL Mayor Blankley opened the public comment period. The following speakers spoke during public comment on items not on the agenda: Elia Salinas - requested resignation of Council Member Armendariz due to events of October 31, 2021. Ron Kirkish - spoke in support of the resignation of Council Member Armendariz due to events of October 31, 2021. Chrystine Villarreal - spoke in support of Council Member Armendariz and her dedication and service to the community. City Council Meeting Minutes 11/15/2021 Vanessa Ashford - spoke in support of Council Member Armendariz and her service to the community. Andrea Hightower - spoke in support of Council Member Armendariz and gun violence prevention. Holly Horner - spoke in support of Council Member Armendariz. Theresa Gamboa - spoke in support of Council Member Armendariz. Michelle Rodriguez - spoke in support of Council Member Armendariz. Basil Romero - spoke in support of Council Member Armendariz. Jan Bernstein Chargin - spoke in support of Council Member Armendariz and gun violence being a public health issue. Erik Porescon - spoke in support of Council Member Armendariz. There being no further public comment, Mayor Blankley closed public comment. IV. REPORTS OF COUNCIL MEMBERS Council Member Bracco - nothing to report. Council Member Armendariz - provided a personal statement regarding the shooting incident that occurred on October 31, 2021. Council Member Marques - reported on Downtown Holiday Parade and Tree Lighting scheduled for December 4, 2021; provided a Gilroy Gardens updates. Council Member Hilton - reported on South County United for Health - mural applications due December 3, 2021; and provided Silicon Valley Clean Energy updates. Council Member Tovar - provided a "thank you" to staff and City Administrator for proactive garbage removal; reported on meeting with new leadership of Salvation Army. Council Member Leroe-Munoz - reported on Silicon Valley Regional Interoperability Authority - final meeting of the year scheduled for November 18, 2021; reported that the Gilroy Economic Development Corporation met last week - possible changes to the structure of the organization moving forward - will report back and keep Council informed on these changes. Mayor Blankley - Reported on updates on Senate Bill 9 and Planned Bay Area 2050 from discussion at Santa Clara County Cities Association; VTA Measure B funds - dollars now allocated for local streets and roads - specifically to Gilroy $7.6 million to come to the Highway 101/152 (10th Street) interchange — this allocation is expected to be approved in the near future by the VTA Board. V. FUTURE COUNCIL INITIATED AGENDA ITEMS Council Member Bracco requested to discuss the issue of catalytic converter theft; following some questions, Council Member Bracco withdrew his request and will speak with the Police Chief. Council Member Hilton requested to have a future item on Smoking Pollution Control - outdoor dining and residential multi -family properties — Gilroy City Code Chapter 19 B amendments on a future agenda; City Council did not agendize the item as only two council members supported placing the item on a future agenda. VI. Introduction of An Ordinance of the City Council of the City of Gilroy Amending Gilroy City Code Chapter 12 to Add a New Article VI, Entitled Mandatory Organic Waste Disposal Reduction, to Chapter 12 of the Gilroy City Code to Implement the Requirements of SB 1383 Staff report provided by Senior Management Analyst Bryce Atkins. City Council Meeting Minutes 11/15/2021 4 Possible Action: a) Motion to read Ordinance 2021-05 by title only and waive further reading. b) Introduce Ordinance 2021-05 amending Chapter 27 of the Gilroy City Code, Article VI "Water Supply Shortage Regulations" authorizing the Public Works Director to make changes to the City of Gilroy Watering Schedule as needed. Project Garlic Industrial Subdivision (Panattoni Development) Mitigated Negative Declaration and Request for Industrial Planned Development Approval for Warehouse, Distribution Facility and Commercial Use of Property at the Northeast Corner of Pacheco Pass Highway and Camino Arroyo (File No.s Z 20-07, AS 20-21, TM 20-07, CUP 20-02 and GPA 20-01) Mayor Blankley asked Council to continue this item to December 6, 2021 as requested by the applicant. Council unanimously supported continuance. Mayor opened the public hearing. Public Comment received from: Michelle Nelson; Johnny Gallegos; Stephen Lua; Connie Rogers; Ron Kirkish; Cheryl Parks — all spoke against project. There being no further public comment, Mayor Blankley closed the public hearing. Item was continued to December 6, 2021 at which time the public hearing will be reopened. Possible Action: Staff and the Planning Commission analyzed the proposed project and recommend the City Council: a) Adopt, by resolution, the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program prepared for the project with findings required by the California Environmental Quality Act (CEQA); b) Adopt a resolution to approve General Plan Amendment GPA 20-01 amending the Mobility Element Figures M-1 and M2 for the project; c) Motion to read the ordinance by title only and waive further reading; d) Introduce an ordinance to approve Z 20-07 Commercial/Industrial Planned Unit Development Zoning Amendment; e) Adopt a resolution to approve Architectural and Site Review AS 20- 21 for the site planned unit development plan and buildings, with findings and conditions; and f) Adopt a resolution to approve Tentative Parcel Map TM 20-07, with findings and conditions. IX. UNFINISHED BUSINESS A. Appointments to Fill Vacancies on Boards & Commissions Mayor Blankley provided background on this item. Mayor opened public comment. No public comment. Mike Sanchez was appointed to the Housing and Neighborhood Revitalization Committee with votes from Council Members Bracco, Hilton, Leroe-Munoz, and Tovar. Council Member Armendariz abstained as she was not in attendance at the November 1, 2021 meeting. No appointments to Open Government Commission were made and interviews will be included the annual recruitment process currently underway. Possible Action: Appoint members to the vacant seats on the Housing & Neighborhood Revitalization Committee and Open Government Commission. B. Status Update and Council Direction on the Evaluation of the Boards and Commissions Structure for Efficiency Staff report provided by Senior Management Analyst Bryce Atkins. Possible Action: Council receive report and provide direction. X. INTRODUCTION OF NEW BUSINESS A. Approve a School Resource Officer Memorandum of Understanding for Fiscal Year 2021-2022 Police Chief Pedro Espinoza provided a staff report. Mayor opened public comment. Possible Action: a) Adopt 2021-64 Resolution of the City Council of the City of Gilroy authorizing the City Administrator to participate in a Memorandum of Understanding with the Gilroy Unified School District for two School Resource Officers, and b) Authorize the City Administrator to execute the Memorandum of Understanding with the Gilroy Unified School District sharing the cost of two School Resource Officers for Fiscal Year 2021-2022. Mayor Blankley noted that the future procedure for items such as this will be for the Council Member making the request to bring the item forward under Future Council Initiated Agenda Items. Motion by Council Member Tovar, seconded by Council Member Armendariz to approve city -funded travel to the Local Government Commission conference. Motion failed on a 2-4-1 vote with Council Members Bracco, Leroe-Munoz, Marques, and Mayor Blankley voting no. Council Member Hilton abstained. Motion by Council Member Armendariz to approve city funded travel to the CalBike conference; motion failed for the lack of a second. Possible Action: Approve or deny the request from Councilmember Hilton to approve City - funded travel to the Local Government Commission and the CalBike Conference in compliance with Government Code Section 53232.2 and AB 1234. Xl. CITY ADMINISTRATOR'S REPORTS A. Fentanyl in the Gilroy Community 1. Public Comment Staff report provided by Police Chief Espinoza and Fire Chief Wyatt. Mayor opened public comment. Public Comments provided by: Geralyn Vasquez; Lisa Marquez; Ron Kirkish; Dr. Meghan Fraley There being no further public comment, Mayor closed public comment. Council gave support for public education in the community and in partnership with Gilroy Unified School District and other community organizations. Council directed staff to look at other action items to include: public information messaging - same as Gilroy Unified School District - to students and parents; share messaging with YMCA, Youth Alliance, and Community Solutions; and organize/coordinate engaging classes for youth, parents, and others to educate on the issue of Fentanyl - community partners and service providers to provide these training sessions.
