ADJOURNMENT GILROY OPEN GOVERNMENT COMMISSION Regular Meeting Minutes Thursday, August 12, 2021 I.OPENING A.Call to Order and Roll Call Commissioner Enzensperger called the meeting to order at 7:14 p.m. and announced that the Commission was meeting remotely via Zoom under the Governor’s Order and detailed the process of public participation. Open Government Commission Special Meeting Agenda Item No. 5.1 IV.UNFINISHED BUSINESS A.Commission Input on Training Budget for Fiscal Year 2021-22 (Continued discussion from 7/12/21 Meeting) Interim City Clerk McPhillips presented the Staff Report. Public Comment There was no public comment. The Commission requested links to the on-line webinars that were discussed. Assistant City Attorney Houston will be speaking at a webinar in November that may be of interest and will provide information when it becomes available. V. NEW BUSINESS A.Quarterly Review of Public Records Requests Per Gilroy Code Section 17A.35 (c) (Second Quarter, 2021) Interim City Clerk McPhillips presented the Staff Report. Public Comment There was no public comment. Motion was made by Committee Member Scheel, seconded by Committee Member Carvalho and carried 3-0-2 to accept the report. VI.INTERIM CITY CLERK’S REPORT Interim City Clerk McPhillips provided an update to the Commission on the City Clerk vacancy. VII.CITY ATTORNEY'S REPORT Assistant City Attorney Houston updated the Commission on AB 473 which had a third reading as of 7/8/21. VIII.REPORTS OF COMMISSION MEMBERS There were no reports. Adopted this 20th day of January, 2022. /s/ Thai Nam Pham, City Clerk Open Government Commission Special Meeting Agenda Item No. 5.1 CITY OF GILROY OPEN GOVERNMENT COMMISSION STAFF REPORT Date: January 20, 2022 To: Open Government Commission Staff: Thai Nam Pham, City Clerk Subject: Open Government Commission Training Budget FY 2021-22 SUMMARY The FY 2021-22 budget approved by the City Council on June 7th includes $2,000 for training expenditures. The funds could be used for training opportunities that would be beneficial and valuable to the Open Government Commission and related to subject matters such as public records and government transparency. Funds are available through the fiscal year ending June 30, 2022. At its meetings of July 8 and August 12, 2021, the Commission discussed possible training opportunities through either the annual League of Cities Conference or the 1st Amendment Coalition organization. Staff also provided information on two online webinars that might be of interest. RECOMMENDED ACTION No action required. Staff and Commission will continue to look for training opportunities that become available during Fiscal Year 2021-22. Respectfully Submitted, Thai Nam Pham, City Clerk Open Government Commission Special Meeting Agenda Item No. 6.1 CITY OF GILROY OPEN GOVERNMENT COMMISSION STAFF REPORT Date: January 20, 2022 To: Open Government Commission From: Thai Nam Pham, City Clerk Subject: Quarterly Review of Public Records Requests Per Gilroy Code Section 17A.35 (c) (Third Quarter, 2021) SUMMARY Included with this staff report are the following logs of Public Records Requests for the third quarter of calendar year 2021: •General City Public Records Requests •Fire Department Public Records Requests •Police Department Public Records Requests and Denial Log As the Commission is aware, there was a complete staffing turnover in the City Clerk’s Office in April 2021 and the general log of public records requests through March 31, 2021 was not complete at the time of the employee departures. There were two carryover items that staff brought forward (copy attached) and provided a status update at the August 12th meeting. As discussed, the PRA received on 3/2/2021 was completed. The second outstanding PRA received on 12/30/2020 is currently pending. This request is quite broad and staff has attempted to contact the requestor several times (8/12/2021, 8/22/2021, and 9/3/2021) to determine what, if any, records the City maintains in response to the request. The requestor has been unresponsive to the City’s multiple requests for clarification. Other than this one outstanding PRA, every records request has been logged and tracked for timely response as reflected in the third quarter report. RECOMMENDED ACTION Staff recommends that commission receive the report.
