Resolution No. 2014-02 | Zoning Amendment (Z 14-02) Section 30 of the Gilroy City Code | Adopted 03/06/2014RESOLUTION NO. 2014-02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GILROY RECOMMENDING CITY COUNCIL APPROVAL OF ZONING AMENDMENT APPLICATION (Z 14-02), AMENDING SECTION 30 OF THE GILROY CITY CODE, ZONING ORDINANCE, BYADOPTION OF NEW AND REVISED PROVISIONS REGARDING EMERGENCY SHELTERS, SUPPORTIVE AND TRANSITIONAL HOUSING, REASONABLE ACCOMMODATION AND DENSITY BONUS. WHEREAS, the 2007 —2014 Housing Element of the General Plan includes actions that are intended to implement City's housing goals and ensure compliance with State housing law; and WHEREAS, Actions 4-2.4, 4-3.1 and 4-3.4 of the Housing Element identify amendments to the zoning section of the City Code that are necessary for the City's regulations to comply with State law; and WHEREAS, the Planning Commission of the City of Gilroy considered the proposed zoning amendments at its regularly scheduled meeting of March 6, 2014, in accordance with the Gilroy Zoning Ordinance, and other applicable standards and regulations; and WHEREAS, on March 6, 2000 the City adopted Homeless Shelter Guidelines to regulate the location and circumstances under which emergency shelters may operate within the City; and WHEREAS, the regulation of emergency shelters proposed by Zoning Amendment Application Z 14-02 in conjunction with the regulatory limitations of emergency shelters provided in State Senate Bill 2 render the adopted Homeless Shelter Guidelines obsolete; and WHEREAS, the Staff Report dated March 6, 2014 along with testimony received at the duly -noticed public hearing other materials were considered in the review process; and WHEREAS, the Planning Commission finds the proposed amendments are consistent with the General Plan in that they provide specific implementation of Housing Element actions and are consistent with the intent of the City Code in that they promote the public health and welfare by encouraging suitable housing for all segments of the community; and WHEREAS, Section 15335 of Title 14 of the California Code of Regulations exempts those projects involving minor amendments to land use limitations from the requirement for the preparation of environmental documents imposed by the State California Environmental Quality Act; and Resolution No. 2014-02 Page 2 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Gilroy hereby recommends to the City Council the approval of Zoning Amendment Application Z 14-02 by adoption of the amendments shown in attached Exhibit A. The recommended additions are shown in underlined text and the recommended deletions are shown in strike -out text. In addition, the Planning Commission recommends to the City Council that the Homeless Shelter Guidelines, adopted March 6, 2000 be rescinded.
