A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
GILROY RECOMMENDING APPROVAL OF ZONE CHANGE Z 14-05,
ZONING ORDINANCE TEXT AMENDMENT TO GILROY CITY CODE
SECTIONS 30.50.60 (b) (2) k. and 30.50.60 (b) (2) I., RDO INTERIM
EXEMPTION, TO EXTEND THE DATE BY WHICH PLANNING
APPLICATIONS MUST BE SUBMITTED AND DEEMED COMPLETE FOR
PROCESSING AND TO MAKE MINOR CLARIFICATIONS TO THE TEXT,
FILED BY THE CITY OF GILROY, 7351 ROSANNA STREET, GILROY, CA
95020.
WHEREAS, Zoning Ordinance section 50.62 creates exemptions forcertain defined
projects from the provisions of the Residential Development Ordinance ("RDO"); and
WHEREAS, the Gilroy City Council adopted an RDO Interim Exemption, Gilroy City
Code sections 30.50.60 (b) (2) k. and 30.50.60 (b) (2) I., on April 3, 2013 to allow
residential developers an opportunity to develop market -rate projects while the City Council
considers amending the RDO; and
WHEREAS, the RDO Interim Exemption expired on April 3, 2014; and
WHEREAS, the city of Gilroy filed a Zoning Ordinance text amendment to Gilroy
City Code sections 30.50.60 (b) (2) k. and 30.50.60 (b) (2) I., RDO Interim Exemption,
to extend the date by which planning applications must be submitted and deemed
complete for processing and to make minor clarifications to the text; and
WHEREAS, the Planning Commission of the city of Gilroy has considered the zone
change request (Z 14-05), in accordance with the Gilroy Zoning Ordinance, and other
applicable standards and regulations; and
WHEREAS, the Planning Commission of the city of Gilroy finds that a limited
amount of residential development should be permitted to occur while the city considers
changes to its `Residential Development Ordinance"; and
WHEREAS, Section 15305 of the California Environmental Quality Act (CEQA)
Guidelines exempts from further environmental review those projects involving "minor
alterations in land use limitations"; and
WHEREAS, the Planning Commission considered the Staff Report dated June 26,
2014 along with testimony received at the duly -noticed public hearing and other materials;
and

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City
of Gilroy hereby recommends to the City Council:
1. The approval of Zone Change application Z 14-05; and
2. The allocation of 265 units to projects receiving an RDO Interim Exemption:
40 units to projects that have received prior RDO allocations and 225 units to
projects that have not received prior RDO allocations.
