Resolution No. 2014-14 | Conditional Use Permit (CUP 13-10) San Ysidro Courts | Adopted 08/07/2014RESOLUTION NO. 2014-14 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GILROY APPROVING A CONDITIONAL USE PERMIT (CUP 13-10), TO ALLOW FIRST FLOOR RESIDENTIAL UNITS IN AN APARTMENT PROJECT LOCATED AT THE SOUTHWEST CORNER OF 10T" STREET AND ALEXANDER STREET APNS 841-16-061, 841-16-029 and 841-16- 004, JAN HOCHHAUSER, APPLICANT WHEREAS, Jan Hochhauser, representing The Pacific Companies, submitted an application requesting Conditional Use Permit approval to allow apartment units to be located on the first floor of a building located in the Expansion District of the Downtown Specific Plan; and WHEREAS, the subject property is located at the southwest corner of the intersection of loth St. and Alexander St.; and WHEREAS, the Planning Commission of the City of Gilroy has considered the Conditional Use Permit application CUP 13-10 in accordance with the Gilroy Zoning Ordinance, and other applicable standards and regulations and public testimony received at a duly noticed public hearing; and WHEREAS, said Conditional Use Permit application was referred to various public utility companies, City departments, including the Technical Advisory Committee for recommendations; and WHEREAS, the project was evaluated pursuant to Section 15183.3 of the CEQA Guidelines, Streamlining for Infill Projects and based on that evaluation the project was determined to be exempt from further environmental review. A notice of that determination will be filed; and WHEREAS, the Planning Commission finds the Conditional Use Permit application conforms to the City's General Plan and elements thereof; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: 1. The proposed project is properly located in relation to the general plan and to the community as a whole and to other land uses and to transportation and service facilities in the vicinity. 2. The proposed use, if it complies with all conditions upon which approval is made contingent, will not adversely affect other property in the vicinity, or cause any damage, hazard, or nuisance to persons or property. Resolution No. 2014-14 Page 2 WHEREAS, the Planning Commission finds all elements, requirements, and conditions of this resolution as being a reasonable manner of preserving, protecting, providing for, and fostering the health, safety, and welfare of the citizenry in general, including persons who work, visit or live in Gilroy. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Gilroy hereby approves the Conditional Use Permit application, subject to the following condition: 1. This approval is valid upon approval of Architectural and Site Review application AS 13-33 and subject to the conditions of approval applied to that application.
