Resolution No. 2015-01 | Residential Development (RD 92-29) Country Estates Phase IV Amendment | Adopted 02/05/2015RESOLUTION NO. 2015-01 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GILROY RECOMMENDING APPROVAL OF AN AMENDMENT TO RD 92- 29, A RESIDENTIAL DEVELOPMENT ALLOCATION FOR COUNTRY ESTATES PHASE IV, FILED BY ENTERPRISE REI 8, LLC, 24168 BIG BASIN WAY, SARATOGA, CA 95070. WHEREAS, Enterprise REI 8, LLC submitted an application requesting an amendment to the approved residential development allocation for the Country Estates Phase IV subdivision; and WHEREAS, the Country Estates phase IV subdivision is generally located north of Hecker Pass Highway (State Route 152) and south of Mantelli Drive, adjacentto the Gilroy Golf Course and consisting of approximately 153 acres; and WHEREAS, the Country Estates phase IV subdivision obtained residential development allocations in the 1992 residential development competition via application RD 92-29; and WHEREAS, the Country Estates phase IV subdivision originally was granted RDO allocations for 25 townhome units and 70 estate lots, for a total of 95 RD allocations; and WHEREAS, Enterprise REI 8, LLC requests eliminating the townhouse units and reducing the estate lots to 61; and WHEREAS, the planning commission of the city of Gilroy has considered the amendment to RD 92-29 in accordance with the Gilroy Zoning Ordinance, and other applicable standards and regulations; and WHEREAS, the planning commission of the city of Gilroy has considered the Staff Report dated February 5, 2015 along with testimony received at the duly -noticed public hearing and other materials; and WHEREAS, residential development allocations are not considered projects pursuant to the California Environmental Quality Act; and WHEREAS, the planning commission of the city of Gilroy finds that the modified project would have scored better in the RD competition than the original project; and WHEREAS, the planning commission of the city of Gilroy finds that the modified project is superior to the prior design. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Gilroy hereby recommends to the City Council the approval of the amendment to RD 92- 29.
