Resolution No. 2015-02 | Zoning Amendment (Z 14-11) Country Estates PUD Approval | Adopted 02/05/2015RESOLUTION NO. 2015-02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GILROY RECOMMENDING APPROVAL OF ZONE CHANGE Z 14-11, A PLANNED UNIT DEVELOPMENT ZONING AMENDMENT TO APPROVE THE COUNTRY ESTATES PHASE IV PUD DESIGN, FILED BY ENTERPRISE REI 8, LLC, 24168 BIG BASIN WAY, SARATOGA, CA 95070. WHEREAS, Enterprise RE] 8, LLC submitted an application requesting a Planned Unit Development zoning amendment to approve the specific design of the fourth phase of the Country Estates subdivision; and WHEREAS, the Country Estates phase IV Planned Unit Development design sets forth the subdivision design for property located within the Country Estates phase IV subdivision, generally located north of Hecker Pass Highway (State Route 152) and south of Mantelli Drive, adjacent to the Gilroy Golf Course and consisting of approximately 153 acres; and WHEREAS, the Planned Unit Development design requests private streets that deviate from city of Gilroy public street standards with regard to street slopes and widths; and WHEREAS, the proposed deviations are minor in nature and intended to reduce city maintenance costs or reduce grading and tree impacts; and WHEREAS, the developer proposes to conserve 95.75+/- acres of open space, provide a public class 11 trail (bike lane) along local public Street A, and control stormwater runoff from the project site onto Gilroy Golf Course as Planned Unit Development amenities; and WHEREAS, the planning commission of the city of Gilroy has considered the zone change request (Z 14-11), in accordance with the Gilroy Zoning Ordinance, and other applicable standards and regulations; and WHEREAS, an initial study and mitigated negative declaration (MND) was prepared for this project; and WHEREAS, the MND determined that no significant adverse effects are expected to result from the proposed development; and WHEREAS, the planning commission of the city of Gilroy has considered the Staff Report dated February 5, 2015 along with testimony received at the duly -noticed public hearing and other materials; and Resolution No. 2015-02 Page 2 WHEREAS, the planning commission of the city of Gilroy has determined that the proposed Planned Unit Development design complies will all required Planned Unit Development findings. NOW, THEREFORE, BE IT RESOLVED that the planning commission of the city of Gilroy hereby recommends to the city council the approval of the Planned Unit Development zoning amendment and adoption of the mitigated negative declaration.
