Resolution No. 2016-22 | RDO HE 16-01 Sobrato Apartment Project | Adopted 12/01/2016RESOLUTION NO. 2016-22 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GILROY APPROVING RDO HE 16-01, AN APPLICATION TO AWARD RESIDENTIAL DEVELOPMENT ORDINANCE INTERIM EXEMPTION UNITS TO THE SOBRATO APARTMENT PROJECT LOCATED AT 9369 MNTEREY ROAD, APN 790-07-027 WHEREAS, Eden Housing (the "applicant") submitted RDO HE 16-01, requesting allocation of 60 Residential Development Ordinance (RDO) units to the Sobrato Apartment project pursuant to Gilroy City Code section 30.50.60(b)(2) I, "RDO Interim Exemption for Projects on Properties without Previously Awarded Allocations'; and WHEREAS, the subject property is located at 9369 Monterey Road (APN 790-07- 027); and WHEREAS, the city has determined that the review and approval of an application for an RDO Housing Exemption does not confer any entitlement for residential development and therefore is not a "project' for the purposes of review pursuant to the California Environmental Quality Act; and WHEREAS, the Planning Commission held a duly noticed public hearing on the proposed project on August 18, 2016, at which public hearing the Commission considered the proposed project, staff report dated August 18, 2016, public comments and testimony, and all other documentation or other evidence received on the project. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the city of Gilrov hereby recommends to the City Council the approval of RDO Housing Exemption application RDO HE 16-01.
