A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
GILROY DENYING TENTATIVE MAP (TM 15-05) TO SUBDIVIDE A 6.28-
ACRE PARCEL OWNED BY GIACALONE & CHRISTOPHER AND
IDENTIFIED AS ASSESSOR'S PARCEL NUMBER (APN) 810-20-006.
THE TENTATIVE MAP WOULD CREATE 16 RESIDENTIAL LOTS, TWO
OPEN SPACE PARCELS, A COMMERCIAL ACCESS PARCEL,
EXTENSION OF LONE OAK LANE (A PUBLIC STREET), AND A
REMAINDER PARCEL FOR FUTURE AGRI-TOURIST COMMERCIAL
DEVELOPMENT. APPLICATION FILED BY NORTHERN CALIFORNIA
LAND AND ENTITLEMENT CONSULTANTS C/O SKIP SPIERING.
WHEREAS, Northern California Land and Entitlement Consultants submitted an
application requesting a tentative map to subdivide a 6.28-acre parcel creating
16 residential lots, each of which would be 4,600 square feet in size, two open space
parcels totaling 0.26 acres, a 0.05-acre commercial access parcel, an extension of Lone
Oak Lane totaling 0.39 acres, and a 3.89-acre remainder parcel for future Agri -tourist
Commercial development; and
WHEREAS, the subject property is located between Hecker Pass Highway (State Route
152) and Lone Oak Lane, west of Two Oaks Lane; and
WHEREAS, said tentative map was referred to various City departments, including the
Technical Advisory Committee for recommendations; and
WHEREAS, the Planning Commission of the City of Gilroy has considered TM 15-05 in
accordance with the Gilroy General Plan, the Gilroy Zoning Ordinance, the Hecker Pass
Specific Plan and other applicable standards and regulations; and
WHEREAS, the Planning Commission held a duly noticed public hearing on the
proposed project on April 7, 2016, at which public hearing the Commission considered
the proposed project, staff report, public comments and testimony, and all other
documentation or other evidence received on the project.
WHEREAS, the Planning Commission finds the Tentative Map 15-01 is not
consistent with the Hecker Pass Specific Plan and the Gilroy Zoning Ordinance as
described in the April 7, 2016 staff report; and
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the
City of Gilroy hereby denies approval of Tentative Map TM 15-05 due to its
inconsistency with the Hecker Pass Specific Plan and the Gilroy Zoning Ordinance.
