RECOMMENDATION: Staff has analyzed the proposed project, and recommends that the Planning Commission: a) Based on its independent analysis, determine this project is exempt from further environmental review pursuant to State CEQA Guidelines Section 15183 (Consistency with a Community Plan or Zoning); and b) Adopt a resolution approving the Architectural and Site Review permit application AS 23-06. PROJECT DESCRIPTION: Proposed Architectural and Site Review to construct three light industrial warehouse buildings for a total of approximately 120,786 square feet on a vacant 7.29-acre parcel located in the M1 (Limited Industrial)/Murray-Las Animas Avenue overlay combining zoning district (APN: 835-01-059). The proposed project would be constructed in three phases and consist of three buildings (Building 1 – 42,266 square feet; Building 2 – 48,600 square feet; and Building 3 – 29,920 square feet) with a mix of office, warehouse, and light industrial uses, associated parking, landscaping, and onsite/offsite infrastructure improvements. The project applicant, Highly Visual LLC also known as Heatwave, has been headquartered in Gilroy since 2019 and has been incorporated since 2014. The business is currently located north of this site at 8840 Forest Street and is looking to expand their operations to one of the proposed warehouse buildings, Building 1. Heatwave designs and sells eyewear, namely sunglasses and safety glasses and is a direct-to-consumer brand corporation, shipping on average 605 small package orders a day through USPS, UPS, and FedEx. Tenants have not been identified currently for Buildings 2 and 3; however, the applicant may decide to use Buildings 2 and 3 for their own use as well depending on the market conditions. Facility operation would require truck shipments to receive and send out products. For operation of the applicant’s operations, the proposed project assumed one low 2 frequency LCL (less than a container load) truck shipment per week per building and is anticipated to require three LCL truck shipments per week at full buildout. Additionally, the proposed project is anticipated to require three daily truck trips per building per day for daily shipping and receiving of products from USPS, FedEx, and UPS. It is anticipated that after construction of Phase I, Building 1 would generate approximately 35 employees. Phase II and Phase III are both anticipated to generate an additional 30 employees each and therefore, buildout of the proposed project would result in approximately 95 employees. General hours of operation would be Monday through Friday, 7:00 AM to 6:00 PM. However, if the applicant does not occupy all three buildings, the proposed project’s combined 120,786 square feet of limited industrial designated building area would result in generation of approximately 190 employees. Therefore, buildout of the proposed project would generate approximately 95 to 190 total employees. The proposed construction would occur in three phases as stated below: • Phase I: Construction of Building 1 (42,266 square feet) and associated driveways along Forest Street, an internal driveway to the existing northern property to provide secondary emergency access during Phases II and III, parking areas, and infrastructure improvements. • Phase II: Construction of Building 2 (48,600 square feet), parking areas, and infrastructure improvements. • Phase III: Construction of Building 3 (29,920 square feet), a driveway on Murray Avenue, associated parking areas and infrastructure improvements. Colors and Materials. The buildings are proposed in contemporary architecture with concrete facade and accent metal paneling. Large storefront windows face the public streets with metal awnings above. Building 1 proposes a second-floor outdoor deck facing Forest Street. The color palette is neutral with three colors in various shades of grey. Parking. Parking is proposed for 293 passenger vehicles, 15 short-term bicycle stalls, and 9 long-term bicycle stalls to accommodate anticipated employee parking needs. Site Improvements. The project will include two driveways accessed from Forest Street and one driveway accessed from Murray Avenue. An internal driveway to the adjacent parcel to the north with access to Kishimura Drive will be constructed in Phase I to provide temporary secondary emergency vehicle access until the driveway on Murray Avenue is constructed in Phase III. Site landscaping is provided along both frontages and the side property lines along with 6-foot-tall steel fencing along the side property lines. BACKGROUND: Subject Property and Surrounding Land Uses: The 7.29-acre project site is located 3 on the east side of Forest Street between Kishimura and Nagardea Drive and also includes frontage on the west side of Murray Avenue between Kishimura Drive and Gavilan Court. The project site’s topography is generally level, undeveloped, and covered by non-native annual grasslands. The site is within the Murray-Las Animas Avenue overlay combining district and requires public notification and Planning Commission review to ensure compliance with the Murray-Las Animas Avenue overlay design criteria. The site and surrounding land uses are as follows: LOCATION EXISTING LAND USE GENERAL PLAN ZONING Project Site Undeveloped Industrial Park M1/Murray-Las Animas Overlay North Light Industrial Industrial Park M1/Murray-Las Animas Overlay South Undeveloped Parcel, Office, Single Family Residential Industrial Park M1/Murray-Las Animas Overlay East Single Family Residential Industrial Park/Low Density M1, R1 Single-Family Residential/Murray- Las Animas Overlay West Industrial Industrial Park M1, Limited Industrial Environmental Assessment: A Section 15183 Consistency Evaluation provided by Stantec Consulting Services dated March 26, 2025 concludes that the proposed project qualifies for an exemption from additional environmental review because it is consistent with the development density and use characteristics established by the Gilroy General Plan and analyzed in the accompanying Environmental Impact Report (EIR, State Clearinghouse #2015082014), which were approved and certified by the Gilroy City Council on November 2, 2020. In accordance with CEQA Guidelines Section 15183, the proposed project qualifies for an exemption because the following findings can be made: 1. The proposed project is consistent with the development density established by existing zoning, community plan or general plan policies for which an EIR was certified. 2. There are no project-specific effects which are peculiar to the proposed project or its site, and which the General Plan EIR failed to analyze as significant effects. 3. There are no potentially significant offsite and/or cumulative impacts which the General Plan EIR failed to evaluate. 4. There is no substantial new information which results in more severe impacts than anticipated by the General Plan EIR. 5. The proposed project would undertake feasible policies and actions specified in the General Plan EIR. 4 DISCUSSION AND ANALYSIS: General Plan Consistency: The City's General Plan designates the subject site for Industrial Park uses that can locate in proximity to residential and commercial uses with minimum environmental conflict. Typical uses include office, light manufacturing operations, and large warehouses which supports the proposed project request. As such, the proposal conforms to the goals and policies of the General Plan. Key goals and policies, which pertain to the proposed project are discussed below POLICY # TITLE AND SUMMARY ANALYSIS LU 1.1 Pattern of Development Ensure an orderly, contiguous pattern of development that prioritizes infill and avoids land use incompatibilities. The proposed project is compatible with surrounding industrial and residential land uses, is an infill site, and avoids land use incompatibilities. LU 5.1 Industrial Design Standards Ensure that new industrial developments contribute to the overall attractiveness of the community through appropriate site design, architectural design, and landscaping. This site is located within the Murray- Las Animas Avenue overlay combining district which requires a higher level of design than normally required in industrial areas. The proposed project includes three new buildings constructed with contemporary architecture including a concrete façade accented with metal paneling. New, drought tolerant landscaping is provided around the perimeter of the site. LU 5.3 Screening in Industrial Areas Encourage the screening of loading areas and open storage areas so that they are not visible from major roads Loading areas are located on the interior of the site so they will not be visible from major roads. Open outdoor storage is not proposed. LU 5.4 Connectivity within Industrial Areas Encourage greater automobile, bicycle, This project is required to provide street improvements along both frontages on Forest Street and Murray Avenue including a new sidewalk and 5 pedestrian, and transit connections within industrial areas bike lane that will help connect pedestrians and bicyclists within the industrial area. LU 8.12 Outdoor Lighting Energy Efficiency Select outdoor lighting fixtures to provide maximum energy efficiency as well as effective lighting. Proposed outdoor lighting fixtures are LED and will meet CalGreen Building Code standards. LU 8.13 Limit Light Pollution Encourage measures to limit light pollution from outdoor sources, and direct outdoor lighting downward and away from sensitive receptors. Outdoor lighting is proposed in the parking lot and areas that highlight the building entrances, walkways, and landscape features. All light fixtures are directed downward and will not spillover to adjacent properties. M 1.8 Street Landscaping Require landscaping as a part of all new street design, including street trees, landscaped medians and buffers, and high- quality street furniture. New landscaping and street trees will be provided with this project along the frontages of Forest Street and Murray Avenue. M 3.2 New Development Require new development to include a system of sidewalks, trails, and bikeways that link all land uses, provide accessibility to parks and schools, and connect to all existing or planned external street and trail facilities in accordance with the Mobility Diagrams. The proposed project will install a new sidewalk and bike lane along the project frontage per the Planned Bicycle Network mobility diagram. M 3.9 Bicycle Parking Require adequate short- and long- term bicycle parking for all land uses except for single- family residential uses. Short- and long-term bicycle parking will be provided per the California Building Standards Code requirements. Zoning Code Conformance: The proposed development is located in the M1 Limited Industrial/Murray-Las Animas Avenue overlay combining zoning district. In accordance with the Gilroy City Code (GCC), the proposed light industrial warehouse uses may be permitted with an approved Architectural and Site Review permit. The intent of the M1 limited industrial zoning district is to designate industrial areas in the city that are appropriate to locate in close proximity to residential and commercial zones. The M1 limited industrial district is suitable for small-scale light manufacturing and industrial park uses with low noise and traffic levels, not generally frequented by retail users. The proposed project use would include a light industrial park with low noise and traffic levels which meets the intention of the M1 limited industrial zoning district. The Murray-Las Animas Avenue zoning overlay and related policy are used to soften the impact of industrial buildings, especially when they are near existing residential homes. The majority of the project site fronts along Forest Street which is not adjacent to existing residential homes and includes Buildings 1 and 2. A small portion of the site fronts on Murray Avenue is across the street from single-family homes and includes Building 3. Building 3 will be the last phase of the construction. The project proposes enhanced, contemporary architecture and new landscaping around the perimeter of the site. The maximum height of the buildings will be 35 feet which is consistent with the maximum allowed height of the M1 limited industrial zoning district and the R1 single family zoning district across from the site. Architectural and Site Review (AS 23-06): The zoning code requires the Planning Commission to conduct a public hearing for any Architectural and Site Review permit within the Murray-Las Animas Avenue overlay combining district, subject to review for 7 compliance with the requirements of the overlay district policies and GCC Section 30.50.43 (Scope of Review), as follows: a) Traffic Safety and Efficiency: The site layout provides adequate circulation for vehicles, parking, and traffic as follows: i) Circulation: There are two driveways proposed on Forest Street and one driveway proposed on Murray Avenue that provide adequate access for ingress/egress on the site. The site circulation has been reviewed by Engineering and Fire Protection staff to comply with minimum road width and circulation standards. ii) Passenger Vehicle Parking: Standard parking calculations require 293 total parking spaces for the facility, based on 1 space per 300 square feet of office area (68 spaces); 1 space per 5,000 square feet of warehouse area (10 spaces); and 1 space per 350 square feet of speculative industrial area (215 spaces). Proposed parking spaces (9’ wide by 18’ long) comply with the City’s required parking stall dimensions. The project proposes 293 passenger vehicle spaces for the facility. iii) Bicycle Parking: The project will provide 15 short-term bicycle stalls and 9 long-term bicycle stalls. The short-term bicycle parking exceeds minimum Reach Code requirements and the long-term bicycle parking meets minimum Reach Code requirements. b) Signs: A separate sign permit will be required prior to installation of any future signs. c) Site Development & Architectural Design: The building meets all applicable site and building development standards as noted above. In addition, the project complies with the applicable design criteria as follows: 1. Industrial Policy: i. Design Intent and Scale. High quality industrial land uses in scale with the site and area are encouraged. The building is in scale and character with other buildings within the same industrial development and proposes an efficient use of the site. ii. Streetscape. The development, as proposed and conditioned, would create an attractive streetscape with building storefronts facing Forest Street and Murray Avenue. Landscaping along the street frontage and the project boundary meets City standards and contributes to the attractiveness of the site and area. iii. Access. The site has adequate pedestrian and driveway access from both street frontages. The site plan would not create any safety conflicts with vehicles or pedestrians at intersections. iv. Lighting and Utilities. Light fixtures would be directed downward and shielded to avoid creating glare. Utilities will be placed in underground vaults or screened with landscaping. v. Trash Enclosure. Three trash enclosures would be located on the interior of the property and not visible from the public streets. vi. Outdoor Storage. No outdoor storage uses are proposed or 8 approved as a part of this project. If any is proposed in the future, a subsequent staff review would be required to ensure compliance with the zoning code including section 30.50.44. 2. Murray-Las Animas Policy and Gilroy City Code Section 30.20.40: i. Enhanced Landscaping. The proposed project exceeds the required 21-foot minimum front yard landscaping with 24-feet of landscaping along Murray Avenue and 35-feet along Forest Street. ii. Attractive Architecture. The architecture of the proposed buildings includes a contemporary style with flat roofs appropriate for an industrial use and comparable with other buildings in the area. Large window storefronts are along the entryways and public street frontages along with metal awnings and a second-floor balcony on Building 1. iii. Colors and Materials. The building proposes multi-materials including concrete façade and metal accent panels. Colors include neutral tones with three colors in compliance with applicable criteria. d) Landscaping and Fencing: The landscaping provides water efficient irrigation and planting in compliance with Gilroy City Code Article XXXVIII, and compliance with section 30.38.70 and the Industrial design guidelines. The applicant proposes to plant over 122 trees on this site, as well as shrubs, grasses and groundcover. The plant palette includes a total of eight tree species. The applicant proposes a 6-foot-tall steel fence along the side property lines. The proposed fencing is considered appropriate and aesthetically pleasing for the industrial use. e) Drainage: The proposed project would construct an underground stormwater treatment facility on the southwestern portion of the site to treat, retain, and/or detain stormwater runoff from the project site prior to it being discharged into the City’s storm drainage system. f) Fire Protection: The site is designed to comply with fire access and service requirements g) Environmental Impacts: This infill site has no special or unique environmental constraints. The project would be subject to payment of fees in compliance with the Santa Clara Valley Habitat Plan. The industrial use would not create any potential objectionable noise, odors, or traffic. Technical Advisory Committee (TAC): Project plans were routed to Engineering, Building, Police, and Fire representatives for internal review and comment. Recommendations of the TAC members have been incorporated into the project plans 9 and/or are included as recommended conditions in attached resolution(s). No unique conditions have been established, and the project has been conditioned to assure plans submitted for building permit shall meet the applicable development standards. PUBLIC NOTICING: Property owner information (i.e. list, labels, and map) within 500 feet of the subject site and within the Murray-Las Animas Avenue overlay combining district were generated by the City of Gilroy using current ownership data. Notices of this Planning Commission meeting were mailed to the property owners and residents along within other interested parties and published in the Gilroy Dispatch at least 10 days prior to the meeting. In addition, the property has been posted with on-site signage notifying passersby of pending development, and the Planning Commission public hearing packets are available through the City's webpage. APPEAL PROCEDURE: In accordance with Section 30.51.50 of the Gilroy City Code, the Planning Commission's decision may be appealed, in writing, to the City Council within 20 days of adoption of the resolution. Appeal forms may be obtained from the City Clerk and must be submitted with the appropriate fee before the end of the appeal period. Attachments: 1. Vicinity Map 2. Project Plans 3. (roll call vote) EXECUTIVE SUMMARY The City of Gilroy’s Capital Improvement Program (“CIP”) represents an ongoing budget process through which the City identifies, prioritizes, and develops a multi-year work plan for major capital expenditures and their associated funding sources in an effort to improve and maintain the City of Gilroy’s roadways, parks, facilities, and other infrastructure. Generally, CIP improvements are major expenditures that have a multiyear life and result in becoming City assets. The CIP is a strategic planning tool focusing on City-owned infrastructure, summarizing in one document the City’s overall capital project needs and associated funding requirements during a five-year period. The CIP document is a work plan and a planning tool and should be used as such in the biannual operating budget preparation process. There are a wide variety of funding sources for CIP projects, some steady and predictable, while others are dependent on outside agencies. PROJECT DESCRIPTION: Review of the Capital Improvement Program (CIP) for Fiscal Year 2026 through Fiscal Year 2027 to determine its consistency with the City’s General Plan. 2 BACKGROUND As part of the City’s budget process, the Planning Commission evaluates projects proposed for the Capital Improvement Program (CIP) for consistency with the City’s General Plan. The Commission is requested to review the CIP and report its findings and recommendations, relative to consistency with the General Plan, to the City Council. Environmental Review: Staff has reviewed the list of projects identified in the CIP and determined that a number of projects will likely involve the need for preparation of environmental documentation in accordance with the California Environmental Quality Act (CEQA). As individual projects are selected to move forward through the CIP process, the appropriate CEQA documents will be prepared as the project scopes are more clearly defined. The CIP General Plan conformity determination report is not a project per CEQA Guidelines Section 15378. The CIP is a budgeting and fiscal planning tool. It does not commit the City to construct or implement any specific project. DISCUSSION AND ANALYSIS: The Draft FY26-FY27 CIP Project List is provided in Attachment 1. Staff has reviewed the projects included in the proposed Capital Improvement Program for Fiscal Year 2026 and Fiscal Year 2027 for General Plan consistency. A list of the proposed CIP Projects with their associated General Plan Policies and/or Goals to indicate consistency with the document is provided in Attachment 2. A draft resolution to make a Finding of Consistency with the General Plan is provided in Attachment 3. NEXT STEPS: The CIP Budget is scheduled for adoption by the City Council on June 2, 2025. While none are anticipated, any significant changes made by the City Council would need to return to the Planning Commission for review of General Plan consistency. Attachments: 1. Resolution for CIP General Plan Conformity New Projects Proposed for FY26-FY27 CIP Project List 801000 Library Improvements This project will remodel sections of the existing library to convert upstairs study space into small and medium-sized meeting rooms, combine teen study room and teen area into one space, remodel all service points to support more flexible technology, convert computer room into flexible space, extend children's room programming space, and combine the coffee nook, Friends of the Library, and downstairs meeting room into one Community room. 801020 Parks/Civic Facilities Sidewalk Improvements Citywide This project would correct defective sidewalks and walkways at City-owned properties including the Civic Center, Library, Police Station, various parks, and parking lots. This project would analyze the sidewalk condition along the frontage of City-owned properties and design and implement corrective measures to repair the defective areas to City Standards. 801030 Parking Lot Resurfacing - Downtown This project would resurface and restripe City-owned parking lots in the Downtown area. The scope of work includes asphalt resurfacing, pavement markings, wheel stops, striping, ADA parking stalls, signage, and storm water management. 801040 Citywide Park Improvement Program This project would implement various improvements at City parks, including but not limited to replacing restrooms, upgrading and replacing playground structures, resurfacing sports courts, and replacing bleachers. 801050 Pickleball Courts This project would design and construct pickleball courts at City parks. 801060 Well 8/8a Rehabilitation This project will rehabilitate Well #8/8a to restore production of potable water. Well 8/8a was taken offline following an exceedance of the Drinking Water Standard for Nitrates, and receipt of a Citation from the Regional Water Quality Control Board. This project would install mitigation measures to reduce nitrates and meet standards such that Well 8/8a could resume water production. 801090 City Facilities Repairs and Maintenance This project will provide for the repair and maintenance of various City-owned facilities throughout the City. 801100 Annex Server Room AC Replacement This project will replace the air conditioning at the City Hall Annex building. 801120 Citywide Safety Improvements This project will fund various safety improvements including traffic calming and safe routes to schools. 801130 Parking Lot Resurfacing – Parks This project will resurface and restripe parking lots at City parks. Page 1 of 1 RESOLUTION NO. 2025-XX RESOLUTION NO. 2025-XX A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GILROY FINDING THE PROPOSED 2026- 2027 CAPITAL IMPROVEMENT PROGRAM PROJECT LIST IN CONFORMANCE WITH THE GENERAL PLAN WHEREAS, the City of Gilroy Capital Improvement Program (CIP) is a five-year program adjusted annually that outlines public improvements and estimated expenditures to construct improvements. The current CIP project list has been updated for the 2026-2027 time period for City Council review and consideration; and WHEREAS, California Government Code Section 65401 requires that the City’s Planning Commission make a determination that the annual CIP is in conformance with the City’s General Plan; and WHEREAS, the Planning Division completed an environmental assessment for the project in accordance with the California Environmental Quality Act (CEQA), and recommends that the Planning Commission determine that the General Plan Conformity Finding is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378 in that the General Plan conformance finding as required by State law is not a project as defined under CEQA; and WHEREAS, on May 1, 2025, the Planning Commission held a public meeting and reviewed the 2026-2027 CIP Project List for consistency with the General Plan 2040. NOW, THEREFORE, the Planning Commission of the City of Gilroy hereby finds, determines and resolves as follows: Section 1: The Planning Commission has duly considered the full record before it, including the City staff report, the 2026-2027 CIP Project List, testimony by staff and the public, and other materials and evidence submitted or provided to the Commission. Furthermore, the recitals set forth above are found to be true and correct and are incorporated herein by reference. Section 2: The Planning Commission determines that the General Plan Conformity Finding is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378 since it is not a project as defined under CEQA. Section 3: The Planning Commission finds that each of the Capital Improvement Projects contained in the proposed 2026-2027 Capital Improvement Program Project List is in conformance with the City of Gilroy General Plan 2040 as outlined in the General Plan Consistency Table attached to the Planning Commission staff report dated May 1, 2025. Section 4: The Planning Commission of the City of Gilroy hereby adopts this Resolution finding the proposed 2026-2027 Capital Improvement Program Project List is in conformity with the General Plan and directs staff to transmit this finding to the City Council in compliance with Government Code section 65401.
