OPENING 1.1. Call to Order The meeting was called to order at 6:04 P.M. 1.2. Pledge of Allegiance The Pledge of Allegiance was led by Council Member Bracco. 1.3. Invocation The Invocation was led by Pastor Malcolm MacPhail. 1.4 City Clerk's Report on Posting the Agenda Acting City Clerk Atkins reported that the agenda was posted on Friday, April 4, 2025 at 4:06 P.M. 1.5. Orders of the Day Mayor Bozzo reminded attendees that the public hearing on the district elections transition would be heard at a time certain of 7:00 P.M. or soon thereafter. 1.7. Employee Introductions Captain Powell from the Gilroy Police Department introduced new employee Detention Services Officer Tallen Gray-Peoples to the Gilroy City Council and community. 2. CEREMONIAL ITEMS - Proclamations and Awards 2.1. Proclamation in Memoriam for Saeid Vaziry April 7, 2025 | 6:00 PM Page 2 of 10 City Council Regular Meeting Minutes ITEM NO. 2.1 WAS HEARD AFTER ITEM NO. 2.3 Mayor Bozzo read the proclamation into the record and welcomed the family of Saeid Vaziry to speak. Kean Vaziry, son of Saeid Vaziry, spoke on behalf of the family and thanked the Council for the recognition, and spoke to the positive experiences of his father working with the City of Gilroy, and the positive impact of Saeid’s work on the community. 2.2. Proclamation Declaring April 2025 as Fair Housing Month 2.3. Proclamation Declaring April 2025 as Arts, Culture, and Creativity Month ITEM NO. 2.3 WAS HEARD AFTER ITEM 1.7 Mayor Bozzo read the proclamation, then invited Arts and Culture Commissioner Vice Chair Ruben Dario Villa to receive the proclamation. Vice Chair Villa discussed the positive impacts of the arts on the community, the efforts of the Gilroy Arts Roundtable, Silicon Valley Creates, and the City regarding the arts, and encouraged continued investment in the arts. 3. PRESENTATIONS TO THE COUNCIL 3.1. Presentation of the Report for the Elevate the Arts Program by Alexandra Urbanowski from Silicon Valley Creates Alexandra Urbanowski gave the presentation on the annual report for the Elevate the Arts program. 3.2. PUBLIC COMMENT BY MEMBERS OF THE PUBLIC ON ITEMS NOT ON THE AGENDA BUT WITHIN THE SUBJECT MATTER JURISDICTION OF THE CITY COUNCIL This part of the meeting allows public address on non-agenda topics within the Council's jurisdiction. To speak, complete a Speaker's Card from the entrances and give it to the City Clerk. Speaking time ranges from 1-3 minutes based on the Mayor's discretion. Extended discussions or actions on non-agenda items are restricted by law. For Council action, the topic may be listed on a future agenda. Email written comments on non-agenda topics to publiccomments@cityofgilroy.org or mail them to City Hall, 7351 Rosanna Street, Gilroy, CA 95020, by 1:00 p.m. on the meeting day. These comments, available at City Hall, will be shared with the Council and included in the meeting record. Late submissions will be shared as soon as possible. A 10-page limit applies to hard-copy materials, but electronic submissions are unlimited. Mayor Bozzo opened public comment. Jan Guffey commented about the Earth Resource Fair on April 19, 2025, and the agencies that have come together for this free family event open to the April 7, 2025 | 6:00 PM Page 3 of 10 City Council Regular Meeting Minutes public at San Ysidro Park. With no additional speakers, Mayor Bozzo closed public comment. 4. REPORTS OF COUNCIL MEMBERS Council Member Bracco – Reported on a meeting at the SCRWA Facility of the South County Water Recycling Committee met and with recent rainfall, the reservoirs are almost full, and the snowpack is a record this year. Council Member Fugazzi – Nothing to report. Council Member Marques – Reported on a meeting of the Santa Clara Valley Habitat Agency Implementation Board and the audit report showing $40 million increase mostly for land acquisition and most of the funding from grants. Expenditures have mostly been for land restoration. Additional comments included increase in burrowing owl numbers and other positive indicators of various programs. Council Member Hilton – Reported on the Caltrain Policy Group’s efforts to enhance safety while delivering services, including the installation of RailSentry for train safety to prevent collisions, as well as additional project information about the Monterey County Rail Extension Project. Council Member Hilton provided an additional report on Santa Clara County LAFCO regarding his support of the action to dissolve the South Santa Clara County Fire Department and annex its territories into the Santa Clara County Central Fire Protection District. Council Member Ramirez – Reported on the Santa Clara Housing and Community Development Advisory Committee. Gilroy is an entitlement city and has its own CDBG funding, but is part of the HOME funding consortium and may only get access to this federal funding through the consortium. The meeting involved conversations about Gilroy’s unhoused population in the County and the lowest per capita income in the County and active involvement to ensure the City gets its share of these funds. Council Member Cline – Reported on the VTA Mobility Partnership Committee focused on the State Route 101/25 interchange project, including construction starting, completion expected in 2027, and that the initial construction will have impacts from closure of Castro Valley and Mesa Road, as well as utility relocation and road widening efforts. A further call for residents to ask County representatives to help fund the second phase of this project. Mayor Bozzo – Reported on the Gilroy Gardens Board of Directors meeting, about the planning happening and work on a conditional permit application to have a Garlic Festival event at the lower portion of Gilroy Gardens in the grass area, and that it is still being worked out currently. 5. COUNCIL CORRESPONDENCE (Informational Only) 5.1. Recommendation from the Parks and Recreation Commission Regarding Ranked Locations for Potential Future Pickleball Courts 6. Approval of a Third Amendment to the Professional Services Agreement with CSG Consultants, Inc. in the Amount of $356,000 for On-Call Building and Fire Plan Review and Inspection Services through June 30, 2026 7.4. Claim of Balwinder Singh Mann (The City Administrator recommends a "yes" vote under the Consent Calendar shall constitute denial of the claim) 7.5. Award a Contract to Ascent Environmental, Inc. for the Development of a Gilroy Vehicle Miles Traveled (VMT)/Greenhouse Gas (GHG) Reduction Program in the Amount of $473,841 (Partially Funded by Caltrans Grant of $335,529) Mayor Bozzo opened public comment Ron Kirkish commented about his concerns about Plan Bay Area 2050 regarding use of VMT in mitigation measures and the impacts of regulations. Hold the Third Public Hearing Regarding the City's Transition from an At- Large to a District-Based Elections System for the Purpose of Receiving the Demographer’s Presentation on the Transition Process, the Information Received Regarding Communities of Interest in the City, the Possible Contours of Six Districts, the Drawing of Maps by Redistricting Partners, the Review of Maps Submitted on the City’s Website and by Other Means, and the Presentation of Legally Compliant Draft Maps to the City Council for the Six New Districts, as well as the Order of Elections for the 2026 and 2028 Elections Public Hearings shall commence at 7:00 PM or soon thereafter 1. Possible Action: April 7, 2025 | 6:00 PM Page 6 of 10 City Council Regular Meeting Minutes Hold a third Public Hearing and receive public input and a presentation from the City of Gilroy's consulting Demographer, Redistricting Partners, regarding the process and criteria for establishing boundaries for district elections pursuant to the California Voting Rights Act for the City Council. This could include discussion of the following topics: 1. The Communities of Interest within the City that should define the boundaries and composition of districts before any maps of any proposed district boundaries are drawn. 2. Review of draft maps submitted by Redistricting Partners and the public, including requests for changes to existing draft maps or requests to prepare new draft maps. 3. Consideration of the Order of Elections, that is, which three districts will be on the ballot in 2026, and which three districts will be on the 2028 ballot. ITEM NO. 8.1 WAS HEARD AFTER ITEM 7.1 Mayor Bozzo opened the Public Hearing at 7:42 P.M. Joanne Fierro commented that she supported and asked the Council to elevate maps JH05 and JH07 and her reasoning for elevating them. Zain Yahya commented that it was great to see the level of involvement with the community and stated his support JH07 as a good map to use, and to throw in ranked choice voting. Sally Armendariz commented that she wants the Council to consider JH05 as a map to consider, and the historic, demographic, infrastructure, and other reasoning for her support of the recommended map and the community of interest she identified as her neighborhood on the east side of Gilroy. Downtown Parklet Update ITEM NO. 9.2 WAS HEARD AFTER ITEM NO. 7.2 Mayor Bozzo opened public comment Tom Miller commented about the history of the development of the parklet, other cities that have parklets, and the benefits they provide. With no additional speakers, Mayor Bozzo closed public comment. Motion: APPROVE to let the existing parklet stay as long as Tempo is in business but if it is sold or goes out of business the parklet must be removed; that it be inspected by the City and any repairs that the City deems necessary to be up-to-code must be completed or the parklet must be removed; that the parklet cannot block another business and that if it cannot be modified to meet this requirement then the parklet must be removed, and that there are to be no new parklets allowed on Monterey Road. Greg Felios commented about his support for the School Resource Officer Program, that he also stated his support to Gilroy Unified, and his reasons for supporting it. Ron Kirkish commented about the calls for service in a year and average per day, the desire for more school resource officers, and to keep the program going. Maria Aguilar commented that she has heard of a higher number of drug use and sales at Christopher High School compared to Gilroy High School, though calls for service data shows the opposite frequency between the two schools.
