A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY APPROVING THE PLANS AND
SPECIFICATIONS FOR THE LAS ANIMAS PARK
PICKLEBALL COURTS PROJECT AND AWARDING A
CONSTRUCTION CONTRACT TO MONTEREY
PENINSULA ENGINEERING FOR AN AMOUNT NOT TO
EXCEED $1,226,401 AND TOTAL PROJECT
CONSTRUCTION COST INCLUDING A 5%
CONTINGENCY OF $1,288,000.
WHEREAS, the City Administrator prepared and submitted to the City Council a budget
for the City of Gilroy for Fiscal Years 2025-2026 and 2026-2027, and the City Council carefully
examined, considered, and adopted the same on June 2, 2025; and
WHEREAS, City Staff has prepared and submitted to the City Council a proposed
amendment to said budget for Fiscal Year 2025-2026 for the City of Gilroy in the staff report dated
June 15, 2026; and
WHEREAS, the Las Animas Park Pickleball Courts Project is an approved City Capital
Improvement Project identified in the fiscal year 2025-2026 annual budget; and
WHEREAS, the design was completed on April 10, 2026; and
WHEREAS, the proposed construction of improvements includes construction of six
pickleball courts, concrete and asphalt pathways, accessible parking space paving, striping and
signage, fencing and gates, storm drainage system, stormwater treatment facility, landscaping and
irrigation, lighting, and site furnishings; and
WHEREAS, on April 10, 2026, the project was released for construction bids, and on May
14, 2026, six bids were received from Monterey Peninsula Engineering, Radius Earthwork, Guerra
Construction, Silicon Valley Paving, Galeb Paving, and Ram-Con Corporation; and
WHEREAS, Monterey Peninsula Engineering was determined to be the lowest responsive
and responsible bid in the amount of $1,226,401; and
WHEREAS, an additional amount of $61,559 contingency, approximately 5% of the
contract value, should be authorized on an as required basis; and
WHEREAS, Monterey Peninsula Engineering has satisfactorily completed similar
construction projects in the Central Coast and South Bay Regions; and
WHEREAS, there are not sufficient funds appropriated in the project account to fund
construction, construction contingency, and design services and materials testing during
construction; and
WHEREAS, an additional amount of $499,190 is needed to fully fund the project.

WHEREAS, sufficient funds are available within Fund 290 – Recreation and Fund 615 –
Facilities to provide the necessary additional appropriations for the project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Gilroy
approves the conformed plans and specifications for the Las Animas Park Pickleball Courts
project; and
BE IT FURTHER RESOLVED that the City Council of the City of Gilroy authorizes the
City Administrator to execute a construction contract with Monterey Peninsula Engineering for an
amount not to exceed $1,226,401; and
BE IT FURTHER RESOLVED that the City Council of the City of Gilroy authorizes
staff to execute up to an additional 5% contingency for written amendments, extensions, and
change orders to the construction contract such that the full construction value may not exceed
$1,288,000; and
BE IT FURTHER RESOLVED that the Fiscal Year 2025-2026 Budget is hereby
amended to increase appropriations for the Las Animas Park Pickleball Courts project account by
a total amount of $499,190. The budget amendment shall consist of appropriating $344,190 from
Fund 290 – Recreation fund balance and transferring and appropriating $155,000 from Fund 615
– Facilities for the Las Animas Park Pickleball Courts project.
PASSED AND ADOPTED by the City Council of the City of Gilroy at a regular meeting
duly held on the 15th day of June 2026 by the following roll call vote:
