RESOLUTION NO. 2026-59
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY APPROVING THE PLANS AND
SPECIFICATIONS FOR THE PRECAST CONCRETE
FENCE REPLACEMENT PROJECT AND AWARDING A
CONSTRUCTION CONTRACT TO SILICON VALLEY
PAVING, INC. FOR AN AMOUNT NOT TO EXCEED
$415,000 AND TOTAL PROJECT CONSTRUCTION COST
OF $456,500, INCLUDING A 10% CONTINGENCY
WHEREAS, the City Administrator prepared and submitted to the City Council a budget
for the City of Gilroy for Fiscal Years 2025-2026 and 2026-2027, and the City Council carefully
examined, considered, and adopted the same on June 2, 2025; and
WHEREAS, City Staff has prepared and submitted to the City Council a proposed
amendment to said budget for Fiscal Year 2026-2027 for the City of Gilroy in the staff report
dated August 17, 2026; and
WHEREAS, the Precast Concrete Fence Replacement Project (project) is not included in
the approved fiscal year 2026-2027 Capital Improvement Program and budget; and
WHEREAS, the design was completed in May 2026; and
WHEREAS, the proposed project improvements include removal of existing damaged
fence, procurement of replacement materials, and installation of the new precast concrete fence;
and
WHEREAS, on May 2026, the project was released for construction bids (26-PW-309),
and on June 11, 2026, four bids were received from Silicon Valley Paving, Inc., American Precast
Concrete, Mission Constructors, and BNO Builders; and
WHEREAS, Silicon Valley Paving, Inc. was determined to have the lowest responsive
and responsible bid in the amount of $415,000; and
WHEREAS, an additional amount of $41,500 contingency, 10% of the contract value,
should be authorized on an as required basis; and
WHEREAS, there are not funds appropriated to the project to fund construction and
construction contingency; and
WHEREAS, an amount of $456,500 is needed to fund the project; and
WHEREAS, sufficient funds are available within Fund 260 – Community Facilities
District to provide the necessary appropriations for the project.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Gilroy
approves the conformed plans and specifications for the Precast Concrete Fence Replacement
Project; and.
BE IT FURTHER RESOLVED that the City Council of the City of Gilroy amends
the fiscal year 2026-2027 Capital Improvement Program to include the project (Project No.
801240); and
BE IT FURTHER RESOLVED that the City Council of the City of Gilroy
authorizes the City Administrator to execute a construction contract with Silicon Valley
Paving for an amount not to exceed $415,000; and
BE IT FURTHER RESOLVED that the City Council of the City of Gilroy
authorizes staff to execute up to an additional 10% contingency for written amendments,
extensions, and change orders to the construction contract such that the full construction
value may not exceed $456,500; and
BE IT FURTHER RESOLVED that the City Council of the City of Gilroy amends
the fiscal year 2026-2027 Capital Improvement Budget to appropriate $456,500 from Fund
260 – Community Facilities District to the project.

meeting duly held on the 17th day of August 2026 by the following roll call vote:
