Dear Mr. Wood:
This will refer to our prior discussions concerning the utility
users tax that PGandE is billing to and collecting from its
customers in accordance with your city's ordinance.
Questions have arisen in connection with our method of calculating
the utility users tax when general refunds are credited to our
customer's bills in accordance with refund plans ordered by the
California Public utilities Commission. Since 1970 PGandE has
computed the utility users tax on the gross amount of a customer's
bill before deduction of the refund credit.
In order to relieve the burden on cities of meeting directly the
demands of service users for refund of a related portion of the
tax paid, several cities have asked that we modify our procedures
to credit each customer due a general refund with the proper
amount and then compute the utility users tax for the billing
period on the remaining net amount of the bill. We are willing
to make this modification in our billing procedures on any future
refunds ordered by the California Public Utilities Commission
provided your city formally authorizes the procedure.
Therefore, the purpose of this letter is to request your formal
approval of this modification in billing procedures. If agreeable,
please indicate your acceptance by signing the duplicate copy of
this letter in the space provided and attaching a resolution of
your city council formally authorizing the signature.
