Proj ect Manager City of Gilroy, Engineering Division 7351 Rosanna Street Gilroy, CA 95020 RE: Camino Arroyo Bridge Project Amendment No.2 Dear Mr. Dey: The purpose of this letter is to request an amendment to the existing contract between the City of Gilroy and Dokken Engineering related to expanded project development services for right of way, permitting, design and federal funding support for the Camino Arroyo bridge project. The amendment adjusts the project completion date to November 15, 2007. This is the second amendment for this contract and the first related to the Camino Arroyo project. The proposed scope of services is described in the attached Exhibit A - Scope of Services Amendments, Camino Arroyo Bridge Project, Contract Amendment #2, by task and subtasks. The hours associated with each subtask are broken down by firm and personnel on Exhibit B - Estimated Labor Hours and Cost for Camino Arroyo Bridge Project, Contract Amendment 2. This work will be billed on a time and materials basis with a not-to-exceed amount as shown on Exhibit B. The original contract amounts and proposed increase amounts for Camino Arroyo are shown in the following table. TERM OF AGREEMENT The term of this agreement shall be amended to continue in effect through November 15, 2007 unless terminated in accordance with the provisions of Article 7 of the original agreement. ARTICLE 4, COMPENSATION The total compensation for this agreement shall be increased by $127,950, for a total contract not to exceed amount of $932,095. EXHIBIT "A" SCOPE OF SERVICES AMENDMENTS 1. Project Management 1.5 Caltrans Local Assistance Support Dokken Engineering will perform project management activities related to obtaining Caltrans Local Assistance Authorization to Construct the project. This includes the preparation of the following Local Assistance documents for City approval and submission: . Finance Letter & Updates . RFA for Construction . Project Data Sheets . PS&E Certification . PS&E Checklist . Construction Contract Administration Checklist . Right of Way Certification 1.6 NEPA Support & Ouality Review Dokken Engineering will review the technical studies and the Categorical Exclusion prepared by Jones & Stokes and coordinate the approval of these documents with Caltrans Local Assistance. Dokken Engineering will meet with Caltrans, offer to coordinate site visits for environmental reviewers and communicate with Caltrans as appropriate to facilitate clearance of the project. 2. Preliminary Engineering 2.1 Surveyina and Mappina Dokken Engineering will perform additional specific topographic mapping along Sixth Street to ensure the smooth conform of curb extensions and sidewalk curb ramps to the existing roadway cross section and gutters. Flow line elevations will be surveyed to ensure new gutters and drainage inlets will be coordinated precisely with the existing field conditions. 2.6 Traffic StudY for NEPA - (Optional Service) If requested by Caltrans and authorized by the City, Fehr and Peers will provide additional traffic analysis and revise the existing traffic memorandum prepared under the original design contract. The additional analysis and revised study will only be performed if requested by Caltrans and authorized by the City project manager. This work effort may be necessary, as the original traffic analysis work was not intended to meet Caltrans requirements for a Traffic Impact Study. Alternatively, some additional EXHIBIT A, Scope of Services Amendments ~ ~91I:C}~~!i . ,... . :. traffic engineering computations may be required in support of an Air Quality Study (if required) or noise studies. A precise scope of work and cost estimate will be prepared for City review and approval prior to any expenditure on this task. 2.8 Environmental Studies Dokken Engineering will prepare an Initial Site Assessment (ISA) to identify all documented hazardous waste sites located within the project area, as well as facilities located within the project area that store, transfer, or utilize large quantities of hazardous materials. Dokken Engineering will determine the potential impact to the project and identify subsequent procedures to determine the extent of contamination and remediation requirements. Dokken Engineering will update and modify the Area of Potential Effects Map to obtain Caltrans approval of the map. All changes will be coordinated with Jones & Stokes. 2.10 Proiect Permittinq 2.10.1 Army Corp of Engineers (ACOE): Dokken Engineering will prepare a Preconstruction Notification (PCN) covered under original contract scope 2.10.2 Santa Clara Valley Water District (SCVWD): Coordination covered in original contract scope. Encroachment permit will be required from SCVWD. Permits are required under two SCVWD Ordinances: District Ordinance 83-2, and District Ordinance 90-1 (the District Well Ordinance). 2.10.3 Natural Resources Conservation Service (NRCS) has jurisdiction over the irrigation canal and alterations to it. The SCVWD is required to obtain NRCS approval prior to issuance of their permit. Dokken Engineering will respond to NRCS comments and informational requests to facilitate completion of the SCVWD permit. 2.10.4 Army Corp of Engineers (ACOE) Section 404 of the Clean Water Act (CWA) states that an ACOE Nationwide 13 Bank Stabilization Permit will be needed to authorize bank stabilization activities necessary for erosion prevention. The activity cannot exceed an average of one cubic yard per running foot placed below the ordinary high water mark (OHWM) without notifying ACOE. The 404 Permit will be needed as rock slope protection will be placed adjacent to the piers and the embankments under the bridge. Permit application, follow-up, responses and support. 2.10.5 Section 404 of the Clean Water Act states that ACOE Nationwide 33 Dewaterinq Permit will be needed if more that 10,000 gallons will be discharged into the West Branch of the L1agas Creek. The water level in this area is higher than in past years. 2.10.6 Section 404 Nationwide 14 Linear TransDortation Proiects. Activities required for the construction, expansion, modification, or improvement of linear transportation crossings (e.g., highways, railways, trails, airport runways, and taxiways) in waters of the US, including wetlands. 2.10.7 United States Fish and Wildlife Service (USFWS) coordination will be performed through the informal consultation process. Based on the projects potential impacts to Federal and State endangered species we will be seeking a "not likely to adversely impact federally endangered species". Justification for negative impacts to federally endangered species will be provided to the ACOE for use during consultation with USFWS. There is no specific permit for USFWS, however they will be part of the review under the ACOE jurisdiction. 2.10.8 Dokken Engineering will coordinate with the California Department of Fish and Game (CDFG) to obtain a 1602 Streambed alteration agreement. Projects may not substantially divert or obstruct the natural flow of, or substantially change or use any material from the bed, channel, or bank of, any river, stream, or lake, or deposit or dispose of debris, waste, or other material containing crumbled, flaked, or ground pavement where it may pass into any river, stream, or lake without notifying the Department through the 1602 process. 2.10.9 Regional Water Quality Control Board (RWQCB) Clean Water Act Certification. Water Quality Certification shall be filed in accordance with Sections 3830 through 3869 of Title 23 of the California Code of Regulations. Documents needed: Wetland delineation, Biological Report for the ACOE to conduct informal consultation with the USFWS on endangered species habitat. 3. 30% Design 3.5 Value Enqineerinq Deletion of the three day Value Engineering Session for the Camino Arroyo Bridge Project. See Exhibit B for contract credit. 3.6 Riqht-of-Wav. Aooraisal and Acquisition Universal Field Services will lead the appraisal and acquisition process for (3) partial takes, prepare and exercise an agreement to dedicate, and prepare (3) temporary construction easements. Appraisal Services will be performed by the Schmidt-Prescott Group. The appraisal will conform to the Caltrans Appraisal Manual and the Office of Real Estate Appraisers of the State of California. These services will include: . Contact with the property owners of (4) parcels and invitation to visit the site with the appraiser . Preparation of an appraisal report for (3) partial takes and (3) temporary construction easements Appraisal Reviews for federally funded projects will be performed by Henry Spoto. The appraisal reviews will be completed for each acquisition and shall include a check of all mathematical calculations, and a determination that all relevant and appropriate appraisal methodologies have been employed. Acquisition Services - Universal Field Services will perform the following acquisition services: . Prepare offer letters . Prepare purchase agreement and conveyance documents . Meet with Property Owners . Follow up with owners and explain offers . Maintain a contact report . Continue personal negotiations . Transmit signed purchase agreements to the City for acceptance and processing Title and Closing Services - Universal Field Services will perform the following closing services: . Review updated Title . Assist Title Company in obtaining release of liens, mortgages and encumbrances . Coordinating clearing and prorating of taxes . Coordinate closing of escrows . Review final title policy for appropriate terms for City . Prepare a completed property acquisition report EXHIBIT A, Scope of Services Amendments ~R91~E~!:!i . ~... 4. 65% Design 4.2 Roadwav Desiqn Dokken Engineering will perform additional roadway design for the traffic calming measures, sidewalk curb ramp replacements and a complete drainage system replacement on Sixth Street from Railroad Street to Rogers Lane. This level of improvements was not anticipated with the original scope of services. As the Traffic Management Plan (TMP) evolved, it was determined that curb extensions would be added to nearly the entire corridor, not simply a few select locations. Furthermore, the City desired that there be no leaf and debris traps between the curb extensions and the existing curb/gutter. Therefore, a complete replacement of the existing drainage system must be designed to relocate the drop inlet locations. Other additional elements of the'TMP to be designed include structural gateway features at each end of the neighborhood. 4.7 Street Liqhtinq Desiqn Dokken Engineering will design a new street lighting system for Sixth Street from Railroad Street to Rogers Lane. The new system will be enhanced aesthetic lighting similar to Monterey Street with luminaires on both sides of the street for a better distribution of light. The street lighting design will include design of two lighted crosswalks. The Sixth Street lighted crosswalks will be push button activated and located at the Railroad Street and Rogers Lane crosswalks. 4.9 City Trail Desiqn and Waterline Relocation During the development of the project, it was determined that the City Trail along the Ronan Channel through the US 101 interchange should be designed and constructed with the Camino Arroyo Bridge Project. The original scope of services included planning concepts and support of the trail planners, but not design. Dokken Engineering will perform the following design services for the City Trail. First, design an appropriate structural section for the trail on the native material and for the Sixth Street Overcrossing embankments. Second, expand the roadway grading to include the necessary earthwork for the City Trail. Third, make revisions to the striping along Sixth Street and Gilman Avenue to accommodate the trail. And lastly, design and obtain approval from Caltrans for revisions to the Sixth Street Overcrossing sidewalks, lanes and barriers to accommodate the trail. This is anticipated to require a Caltrans Encroachment Permit for construction. Dokken Engineering will design the relocation of the City waterline at the base of the Sixth Street Overcrossing embankment.
