All copies forwarded to Consultant for signature shall be returned to the City of Gilroy properly filled out. Upon execution by the City, one original will be returned to the Consultant. Camino Arroyo Bridge Project, in the amount of $127,950 - see attached Scope of Work. Expands services for right of way, permitting, design, and federal funding support. Adjustment of project completion date to November 15, 2007. All requirements of the original Agreement Documents shall apply except as specifically modified by this Amendment. The proposed scope of services includes coordinating the necessary permitting through the U.S. Army Corps of Engineers, Santa Clara Valley Water District, Natural Resources Conservation Service, U.S. Fish and Wildlife Service, California Department of Fish and Game, and the Regional Water Quality Control Board. The services are outlined in the attached Exhibit A "Scope of Work - Amendment No. 1 - Farrell Avenue". The hours associated with each permitting activity are also listed on the attached scope. Estimated Labor Hours and Costs are included as Exhibit B. This work will be billed on a time and materials basis with a not-to-exceed amount as shown on Exhibit B. The original contract amounts and proposed increase amounts are shown in the following table. Preliminary Engineering 2.10 Proiect Permittinq 2.9.1 Army Corp of Engineers (ACOE): Dokken will prepare a Pre.collStructlon Notification (PCN) covered under original .contract scope 2.9.2 Santa Clara Valley Water District (SCVWD): Coordination covered in original contract scope. Encroachment permit from SCVWD. Permits are required under two SCVWD Orpinances: District Ordinance 83-2, and District Ordinance 90-1 (the District Well Ordinance).(10 hours) 2.9.3 Natural Resources Conservation Service (NRCS) has jurisdiction over the irrigation canal and alterations to it. The SCVWD is required to obtain NRCS approval prior to issuance of their permit. Dokken Engineering will respond to NRCS comments and informational requests to facilitate completion of the SCVWD permit. (10 hour) 2.9.4 Army Corp of Engineers (ACOE) Section 404 of the Clean Water Act (CWA) states that an ACOE Nationwide 13 Bank Stabilization Permit will be needed to authorize bank stabilization activities necessary for erosion prevention. The activity cannot exceed an average of one cubic yard per running foot placed below the ordinary high water mark (OHWM) without notifying ACOE. The 404 Permit will be needed as rock slope protection will be placed adjacent to the piers and the embankments under the bridge. Permit application, follow-up, responses and support. (20 hours) 2.9.5 Section 404 of the Clean Water Act states that ACOE Nationwide 33 Dewaterina Permit will be needed if more that 10,000 gallons will be discharged into the West Branch of the L1agas Creek. The water level in this area is higher than in past year. However, at the current level, dewatering for the pier construction is expected to exceed 10,000 gallons. (16 hours) 2.9.6 Section 404 Nationwide 14 Linear TransDortation Projects. Activities required for the construction, expansion, modification, or improvement of linear transportation crossings (e.g., highways, railways, trails, airport runways, and taxiways) in waters of the US, including wetlands. (30 hours). 2.9.7 United States Fish and Wildlife Service (USFWS) coordination will be performed through the informal consultation process. Based on the projects potential impacts to Federal and State endangered species we will be seeking a "not likely to adversely impact federally endangered species". Justification for negative impacts to federally endangered species will be provided to the ACOE for use during consultation with USFWS. There is no specific permit for USFWS, however they will be part of the review under the ACOE jurisdiction. (40 hours) 2.9.8 Dokken will coordinate with the California Department of Fish and Game (CDFG) to obtain a 1602 Streambed alteration agreement. Projects may not substantially divert or obstruct the natural flow of, or substantially change or use any material from the bed, channel, or bank of, any river, stream, or lake, or deposit or dispose of debris, waste, or other material containing crumbled, flaked, or ground pavement where it may pass into any river, stream, or lake without notifying the Department through the 1602 process. ( 40 hours) 2.9.9 Regional Water Quality Control Board (RWQCB) Clean Water Act Certification. Water Quality Certification shall be filed in accordance with Sections 3830 through 3869 of Title 23 of the California Code of Regulations.
