HomeMy WebLinkAboutGilroy/Morgan Hill - Boundary AgreementBOUNDARY AGREEMENT BETWEEN THE CITIES OF MORGAN HILL AND GILROY THIS AGREEMENT, is made and signed this 5th day of February, 1968) by and between the CITY OF MORGAN HILL, a Municipal Corporation, hereinafter called "Morgan Hill ", and the CITY OF GILROY, an adjoining City in Santa Clara County, hereinafter called "Gilroy "; R E C I T A L So 1. The Santa Clara County Local Agency Formation Commission has requested, if not required, adjoining Cities to enter into "Boundary Agreements" whereby adjoining Cities declare their intentions regarding future annexations, and agree to respect a certain Boundary Line as the future boundary between such Cities. 2. After several months of study and negotiations, the above named Cities have come to an Agreement respecting the future boun- dary line between these Cities, and they now wish to reduce this Agreement to writing and file it with the Santa Clara County Local Agency Formation Commission. NOW, THEREFORE, in consideration of their mutual agreement, hereinafter set forth, the above named Cities do hereby declare and agree as follows: I There hereby is attached hereto and made a part of this Agree- ment, a certain Map prepared by G. C. McKinney, Civil Engineer, entitled t1Morgan Hill- Gilroy Boundary, October, 1967" which map is marked "Exhibit A" and hereinafter is referred to as "Exhibit A ". Said Map has a red line running in a general East to West direction from Merced County to Santa Cruz County. -1- Also attached to this Agreement, and made a part hereof by this reference, is a 6 page legal description which gives the correct legal description of the red line referred to in the pre- ceding paragraph. This description is designated "Exhibit B ". II Morgan Hill agrees that it shall not, except with the prior written consent of the City Council of Gilroy, extend its boundaries by annexation across that certain red line shown on "Exhibit A" and described in "Exhibit B ". In other words, said red line shall form the Southern limits of the City of Morgan Hill, and shall form the future Boundary Line between the Cities of Morgan Hill and Gilroy. Likewise, the City of Gilroy agrees not to extend its boundaries by annexation across that red line as shown in "Exhibit A" and described in "Exhibit B" without the prior written consent of the City Council of Morgan Hill. III Morgan Hill does hereby consent to the annexation by the City of Gilroy, by one or more annexation proceedings, of any unincorpor- ated territory other than territory which Gilroy is prohibited from annexing by Paragraph II hereof. IV Gilroy does hereby consent to the annexation by the City of Morgan Hill, by one or more annexation proceedings, of any unincor- porated territory other than territory which Morgan Hill is prohibited from annexing by Paragraph II hereof. u This agreement is conditioned upon the understanding and -2- expectation that the boundary line set forth herein shall bisect the proposed South County Airport. In the event the proposed South County Airport is located so that it is not bisected in an east -west direction by the boundary set forth herein, the above, named Cities agree that the final location of said boundary be subject to further negotiation and agreement, VI It is agreed that after approval by Resolution by both City Councils of the respective Cities which are parties to this Agreement, that certified copies of this Agreement may be filed with the Santa Clara County Local Agency Formation Commission, and that the City Clerks of the respective Cities will be directed to so file the Agreement and certified Resolutions of their respective Cities.
