AGREEHENT
The following is an Agreement by and between GILROY
UNIFIED SCHOOL DISTRICT, hereinafter called "District", and the
CITY OF GILROY, hereinafter called "City".
WHEREAS, District and City, pursuant to their Joint Use
Of Facilities Agreement dated October 1975, desire to provide
for the joint park use of approximately 3 acres of property owned
by District, located on Kern Avenue, Gilroy, California.
\iHEREAS, District and City desire to provide streets,
curbs, gutters and other off-site improvements, pursuant to the
specifications of the City of Gilroy, to the property adjoining
said park site;
NOW THEREFORE, the parties agree as follows:
A. District Agrees:
1. To provide for a joint City-District park site on
District's seventeen acre school site on Kern Avenue, Gilroy,
California, consisting of approximately 3 acres in an area to be
mutually determined by authorized agents of City and District.
20 To provide, by agreement, for the construction
of improvements on that portion of Kern Avenue, Gilroy, California,
abutting its seventeen acre school site, which includes said park
site, with curbs, gutters, electroliers, and one-half plus ten
feet of the street improvements consisting of approximately 700
lineal feet, all to City specifications.
B. City Agrees:
1. To reimburse District in an amount equal to the
construction costs of improving 200 lineal feet of frontage along
Kern Avenue, Gilroy, California, with curbs, gutters, electroliers
and one-half plus ten feet of street improvements, all to City

specifications, at such time as said improvements are completed
and approved by City.
2. To be responsible for the development and
construction of the said approximately 3 acres for park use in
accordance with the mutually agreed upon plans for development
of the entire seventeen acre Kern Avenue, Gilroy, California
site.
IN WITNESS WHEREOF, this Agreement is signed this 18th
