AGREEMENT FOR CONSTRUCTION AND MAINTENANCE OF
SOFTBALL FACILITIES AT SOUTH VALLEY
JUNIOR HIGH SCHOOL
~~EREAS, the City of Gilroy, a municipal corporation,
(hereinaLter called "City") and Gilroy Unified School District of
Santa Clara County (hereinafter called "District") entered an
Agreement dated June 1, 1971 covering the joint recreational use
of various City-owned and District-owned properties and facilities
and now desire to specifically provide for the joint construction
and maintenance of softball facilities at South Valley Junior High
School,
NOW, THEREFORE, IT IS AGREED:
A. City shall:
1. Prepare specifications for dugouts, backstops,
wing fencing, site preparation, drainage and reconfiguration of
the irrigation system and the configuration of pitcher's mound,
bases and infield at specified locations on the athletic field at
South Valley Junior High School. Said specifications shall be
reviewed and agreed to by designated representatives of District.
2. Construct or have constructed the above facilities
at South Valley Junior High School pursuant to said specifications.
City shall furnish District with certificates of insurance in the
sum of $1,000,000.00, naming District as an additional insured for
personal injury and property damage during said construction. The
times' of said construction shall be agreed upon by the parties and
a construction timetable established between the dates of March 1,
1986 and July 1, 1986 to avoid conflicts with the use of the
property by District.
3. Provide or have provided required maintenance to prep
field for all games and/or practices during the Little League
season. (District shall furnish the labor and material regarding
normal maintenance such as mowing, irrigation and fertilizing.)
B. District shall:
1. Make available the athletic fields specified for the
above construction during the times specified.
2. Make available for community use all the above said
facilities at such time as regular school programs are not using
said facilities.
3. Provid~ normal maintenance for said facilities prior
to and following Little League season.
C. All other terms and conditions of Agreement of June 1,
1971 shall be applicable herein.
D. Said facilities shall remain property of District or
shall be removed at City's expense if City desires to remove such
facilities as can practicably be removed without damage to school
property.

IN WITNESS WHEREOF the parties hereto have executed this
Agreement on the dates set forth below.
