WATER CONSERVATION DlSTlUCT, n.r.1nafter referred to as It District" .
VlHEREAS, the District 1I1n the process of con.tructiav a flood eon-
tr01 and storm draiDa". project known as thG Prine.velle Canatin the location
shown on the map attached hereto as Exhibit "1\" and by this reference made
a part of this Agreement; l"a'ld
WHEREAS i the area to be drained by such canalis al shown on Ex-
b1blt It Aft , which area oontains approximately 1, 200 aere8~ and
WHEREAS, sald facility will be of special benefit to tM Cuy of GUroy
in providing drainage facilities for said City in addlUon to the general flood
control Oenefits received by the south zone of the District; and
WHEREAS I Oity and District deske to enter Into a cooperative agree-
ment relative to the use of said facility and sbartn, in the costs thereof"
NOW, THEREFORE, IT IS HER.&BY AGREED BY AND 8ET~JEEN tHE PARTIES
HERETO AS FOLLOWS:
1" District agree. to complete said flood control and storm draina,_
facl11U8. 1n the calendar year 1961.
2" District .(lre.. to maintain tbat portion of the facUity whioh is of
open channel.
3" City aqrees to maintain that ponton of the 'aoUity which consist.
of drainage pipes"
4 . CUy shell have the riqht to dbchaffJe all storm drainage waters
originating 1n the drain8ljJe"area shown on Bxhibit "AM and 1n the City of Gilroy
aa said City's boundarlel now exist, or as they may be expanded In tbe future
into said Prtnceva11e CaRd.
S.. Ctty agree. to pay District within thirty (30) days after tbe execu-
tion of thi. Atreement the sum of $8,649.56 .s the Otty's contribuUon for the
area developed prior to February 1, 1961, within Oity and Within the drat nave
area shown on Exhibit "A lit .
6 .. For each aore of ,round within Hid dralnaQe are. whicb 18 or has
been developed \YttMn City after February 1, 1961 II City agrees to pay District
the sum of $aGo.. 00 for each said acre as follows:
A" On August 1, 1961 Q City shall pay District tbe sum of
$200..00 mult1plled by the number of acre. which have been developed
or on which dra1nage fees have been collected by City between
February 1, 1961? and June 30, 1961"
B" On Augult 1, 1962 ~ and on each August 1 thereafter, Olty
shall pay District the sum of $200..00 multiplied by the number of
acres which have been developed or on whioh dralnege fees heve
been collected by City durtng the preceding fiscal YNr"
