HomeMy WebLinkAboutSanta Clara County - Juvenile Probation Services Agreement ctbss ;J-/3-~o '7L .r AGREEMENT BETWEEN COUNTY OF SANTA CLARA AND CITIES OF GILROY, MORGAN HILL, AND SAN JOSE TO PROVIDE COOPERATIVE POLICE AND JUVENILE PROBATION SERVICES This is an agreement between the COUNTY OF SANTA CLARA (County) and the Cities of GILROY, MORGAN HILL, and SAN JOSE (Cities). County and Cities wish to establish and operate a project to provide cooperative police and juvenile probation services to youth in the South County area and to that end agree: 1. STAFFING Throughout the term of this agreement County will assign one deputy sheriff, one deputy probation officer, and one clerk to work full time as the staff of the project. 2. FUNCTION The purpose of the project is to process juveniles receiving citations and other juveniles brought to the project by police officers. 3. EMPLOYMENT STATUS All persons assigned as staff to the project shall retain their status as employees of the party which assigns them to work for" the project and shall be entitled to all of their rights, i~cluding, but not limited to, pay, fringe benefits, promotions, and procedural protections as normally accrue under the rules, policies, and ordinances of their employer. 4. CITIES' CONTRIBUTION Cities will provide the following annual amounts toward the salary and transportation costs of the deputy sheriff: San Jose-$4,OOO, Gilroy-$8,OOO, and Morgan Hill-$8,OOO. The Sheriff will bill each city for these services. 5. COUNTY'S CONTRIBUTION County will provide $7,000 toward the salary and transportation costs of the deputy sheriff. County will provide office space for the project and assign a deputy probation officer and one clerk. ~.' '~::.."i-. .. Page 2 6. HOLD HARMLESS . County agrees to defend Cities and hold them harmless from any claim or liability to anyone other than parties to this agreement arising out of County's performance of this agreement and the act of any employee assigned to the project in the course and scope of their activities as a project staff member. 7. HOLD HARMLESS Cities agree to defend County and hold it harmless from any claim or liability to anyone other than parties to this agreement arising out of Cities' performance of this agreement and the act of any employee assigned to the project in the course and scope of their activities as a project staff member. 8. TERM The initial term of this agreement is from November 1, 1979 through September 30, 1980. This agreement shall be renewed for an additional annual period of October 1 through September 30 unless any party to this agreement gives notice of termination at least 30 days prior to October 1 of such year.
