AMENDMENT TO LEASE AGREEMENT FOR
GILROY BRA.NCH LIBRt\RY
WHEREAS, on January 13, 1969, the City of Gilroy, a municipal
corporation, hereinafter referred to as "Lessor," and the County
of Santa Clara, hereinafter referred to as "Lessee," entered into
a lease agreement whereby the Lessor would acquire land and
construct a building to be leased to Lessee for library purposes;
and
WHEREAS, the low bid for the construction of said building,
together with landscaping costs, estimated remaining architects'
fees, testing, inspection, and printing, shows a total estimated
project cost of $573,117.50, thus creating a deficit of $124,922.44
over the funds available of $448,194.56; and
WHEREAS, Lessor and Lessee desire to amend the lease agreement
to provide for the sharing of the deficit cost, and to further
shm~ that the projected building will contain approximately 13,000
square feet instead of the 15,000 square feet as set forth in the
lease agreement;
NOW, THEREFORE, in consideration of, and subject to, the terms
and conditions hereinafter set forth, Lessor and Lessee agree as
fOllows:
1. Lessee hereby agrees to pay fifty (50%) percent of the
total estimated deficit cost but in no event shall this sum f
exceed $60,000.00. Payment shall be made by Lessee over three
fiscal years beginning with the fiscal year 1974-1975. For the

less the cost of carpeting which shall be purchased and installed
at the expense of Lessee. The item of carpeting shall be
eliminated from the project cost. For the fiscal year 1975-l976,
Lessee shall pay the sum of $20,000.00. For the fiscal year
1976-1977, Lessee shall pay the ba~ance of the deficit which
shall not exceed $20,000.00.
2. Lessor shall be obligated to pay the balance of the
deficit cost. Lessor shall endeavor to reduce the landscaping
costs by undertaking the work by its own work forces.
3. Lessor and Lessee agree that in order to reduce the
deficit cost the item of the fountain and pool may be eliminated
from the plans and specifications.
4. Lessor and Lessee agree that the original size of the
building shall be reduced from 15,000 square feet to approximately
13,000 ~quare feet.
S. In all other respects, the terms and conditions of the
original lease agreement shall remain in full force and effect.
