RELINQUISHMENT AGREEHENT
MOREY AVE (SANTA 'IERESA BLVD)
BE'lWEEN HECKER PASS HWY AND 800 FT. NORTII OF MAN'IELLI RD
THE FOLLOWING is an agreement between the County of Santa Clara
(hereinafter called "County") and the City of Gilroy (hereinafter called
"City").
WHEREAS, County has determined that Morey Ave (santa .Teresa Blvd)
between Hecker Pass Highway and 800 feet north of Mantelli shall be
reconstructed and improved partly within City and partly within County,
and City, has consented to such reconstruction and improvement of said
Morey Avenue;
WHEREAS, the construction of these improvements requires the
relinquishment of certain rights of City within Morey Ave (Santa Teresa
.
Blvd); and
WHEREAS, the relinquishment of these rights is a specific re-
quirement of the State Department of Transportation in order to obtain
its project approval.
NOW, THEREFORE, County and City agree as 'follows: City does
hereby relinquish to County, effective upon execution of this agreement,
all of City's rights, title and interest in and to the lands of Morey
J
Ave (santa Teresa Blvd) between Hecker Pass Highway and 800 feet north
of Mantelli Road, said lands being the areas delineated between the
lines shown as "R/W Line" on the attached Exhibit "A", which is hereby
incorporated herein by reference.
EXCEPTING AND RESERVING THEREFROM:
Exception #1: All public rights of ingress and egress from and
to Morey Ave (santa Teresa Blvd).
Exception 1/2.: The right of City to maintain those utility lines
which are within the right of way boundaries of Morey Ave (Sant~Teresa
Blvd) as said Morey Ave (Santa Teresa Blvd) is shown on the attached
Exhibit "A", as of the date of this agreement.

Exception #3: The right of the City to install or have developer
install landscaping, sidewalks, driveways, and utility lines (including,
but not limited,to, gas, water, storm drains, sanitary sewer, electrical
distribution, telephone, lighting, cable T.V.) within the area bounded
by the right of way line and the ultimate edge of pavement or curb of
MOTey Ave (santa Teresa Blvd - llO ft. wide) subject to available space
and obtaining an encroacpment permit from County. After County has
awarded a contract for said street improvement, all future utility
lines including laterals must be installed by boring and jacking.
Requests for new public street connections must be recommended by the
County Transportation Commission arid be approved by the Board of
Supervisors.
IT IS FURTHER AGREED:

10 County agrees to maintain any existing and future roadway
paving located within the lines shown as R/W line on the attached
Exhibit "A".

County agrees to maintain any existing and future storm drain
lines located within the roadway limits shown under Exhibit "A".
.2. City agrees to maintain:
a. Those utility lines installed by City prior to the date
of this agreement;
b. Any other utility lines which may be installed in the
future at the request of City located within the roadways shown under
Exhibit "A".
