AGREEMENT
SANTA CLARA VALLEY WATER DISTRICT, a public corporation, hereinafter called
"District", and CITY OF GILROY, a municipal corporation, hereinafter called
"City".
AGREE, this 26th day of January
, 1982 as follows:
RECITALS:
1. In conjunction with a proposed subdivision development, City is
requiring developers to construct portions of Lions Creek which is within
the planning jurisdiction of City_ Ultimate construction may be funded by
the U. S. Soil Conservation Service as a Public Law 566 project.
2. The only parcel required for the Lions Creek construction not now
owned by District, is shown on "Exhibit A", attached hereto and made a part
hereof.
3. This agreement will state the r~sponsibility of the parties in securing
and paying for such pa+cel.
AGREEMENT:
1. District agrees to appraise and acquire the parcel shown on Exhibit A.
2. After the purchase price is established, City will advance the funds
therefor prior to close of escrow. In the event purchase is completed by
means of a judgment of condemnation, City will deposit the required funds
with the Clerk of the Superior Court. However, City shall have the right to review
District's appraisal of the proposed acquisition prior to proceeding with this agreement.
3. If the Public Law 566 pToject becomes eligible for State reimbursement
of right of way acquisition costs, District will promptly transfer to City
the full amount of such reimbursement as applied to the subject property.
