HomeMy WebLinkAboutSouth Santa Clara County Fire Distirct - Battalion Chief Operational Agreement ~ ~.1 ~~J SOUTH COUNTY REGION BATTALION CHIEF OPERATIONAL AGREEMENT Between Gilroy Fire Department, South Santa Clara County Fire District and Santa Clara County Fire Department Program re-initiated Oct. 4, 2010 REGIONAL BATTALION CHIEF OPERATIONAL AGREEMENT Gilroy Fire Department, South Santa Clara County Fire District and Santa Clara County Fire Department PARTIES: This agreement is between the City of Gilroy Fire Department, herein referred to as "Gilroy," the South Santa Clara County Fire DIstrict, herein referred to as "District" and Santa Clara County Fire Department, herein referred to as "County." "Battalion Chief' or "BC" refers to a Battalion Chief or other Chief Officer acting in or filling the capacity of an assigned on-duty Battalion Chief. I. PURPOSE: The purpose of this agreement is to provide the citizens and visitors of each jurisdiction with a minimum of two Battalion Chiefs dedicated to the South County Region for uninterrupted 24/7 coverage. II. SCOPE: It is the intent of the parties of this agreement to provide reciprocal Battalion Chief service covering emergency response including but not limited to fires, medical aids, rescues, and hazardous materials incidents. This operational agreement will be accomplished by the District providing a shift Battalion Chief daily and the sharing of a Battalion Chief between Gilroy and County. Gilroy will provide two Battalion Chiefs, one on each of two shifts, and County will provide one Battalion Chief on the third and vacant shift of Gilroy's shift schedule. This arrangement will provide two Battalion Chiefs on duty each day 24/7 in the South County Region. III. OPERATIONAL PHILOSOPHY: The philosophy of this agreement is to respond the closest available Battalion Chief(s) to provide Incident Command, overhead functions, leadership and supervision as needed to mitigate emergencies and specific routine issues. BCs shall release apparatus as quickly as possible to their respective jurisdictions, or provide/ recommend move-ups as needed to maintain South County Regional coverage as outlined in this document (See APPENDIX B.2 Core StatIOns). IV. LOCAL MUTUAL AID: In order to expedite resource response in the South County Region, it is mutually agreed that Local Mutual Aid resource requests for Gilroy, the Distnct, and County will be made directly to the Communications/ Command Center of the jurisdiction having authority. V. INCIDENT RESPONSE GUIDELINES: Refer to APPENDIX B 4.1 VI. AUTOMATIC AID AND RESPONSE BOUNDARIES: Refer to Automatic Aid Response Map (See to create Arc View maps as needed). 2 REGIONAL BATTALION CHIEF OPERATIONAL AGREEMENT Gilroy Fire Department, South Santa Clara County Fire District and Santa Clara County Fire Department VII. RESPONSES AREAS: F or the purpose of this agreement, responses will include all jurisdictional boundaries of the parties to the agreement. VIII. INCIDENT STANDBY In the event that a Battalion Chief is dispatched to an incident that is determined to be stable upon arrival and it appears that the incident requires a period of standby in excess of approximately thirty (30) minutes, the Battalion Chief on scene may request a Battalion Chief from the responsible jurisdiction, or request mutual aid to cover the gap left by the committed battalIon chief. IX. ALTERNATIVE BATTALION COVERAGE In the event that the primary responding Battalion Chief(s)1 are not available for response into one of the other jurisdictIOns, the agency in whose jurisdiction the incident occurs shall dispatch its closest available Battalion Chief or make a Mutual Aid request. In those instances when both Battalion Chiefs are experiencing multiple emergency calls, the Battalion Chiefs and the CommunicatIOn! Command Centers of the involved agencies shall coordinate to provide appropriate Battalion Chief coverage. Each jurisdiction shall provide relief coverage with mutually agreed upon qualifications as defined by the respective Fire Chiefs. X. COMMUNICA TIONS PLAN: Regional Battalion Chiefs Communications Procedures are contained in Appendix A- Communications Plan, of this document. The Communications/ Command Center, in which the incident occurs, shall be responsible for maintaining communications control over all responding Battalion Chiefs. XI. SITUATIONS NOT COVERED IN THIS AGREEMENT: In situations not covered by this agreement, responding Battalion Chiefs shall take the most appropriate action based upon their respective SOPs (Standard Operating Procedures) / SOGs (Standard operating GuidelInes) and any available information. Additionally, the Battalion Chief shall inform his/her counterpart or the designated jurisdictional Duty Chief of the incident and actions taken. XII. INCIDENT COMMAND SYSTEM: The first arriving Battalion Chief shall ensure implementation of the Incident Command System (ICS) and shall have the authority to request additional resources including the activation of the Santa Clara County Fire Mutual Aid Plan. The responsibility of the emergency incident rests with the agency in whose jurisdiction the Incident occurs, and therefore, the Battalion Chief of the agency in which the incident occurs may assume command upon their arrival. I Primary responding Battalion Chiefs applies to those BCs designated daily as part of this Regional Battalion Chief Agreement as opposed to on or off duty jurisdictional BC use or function. 3 REGIONAL BATTALION CHIEF OPERATIONAL AGREEMENT Gilroy Fire Department, South Santa Clara County Fire District and Santa Clara County Fire Department XIII. FIRE INVESTIGATION: The agency with jurisdiction shall have the responsibility for fire scene investigation beyond engIne company level. Request for investi~ators shall go through the Communications/ Command Center of the jurisdictional havIng authority. XIV. KNOX BOX KEYS A Knox Box key shall be provided to the participating Battalion Chiefs from and to each jurisdiction. All Battalion Chiefs shall ensure security of keys provided. An audit of Knox Box keys for all jurisdictions shall be performed annually when this agreement is reviewed to ensure only authorized personnel have access to them and that they are all accounted for. . Each agency shall advise the others re: need for additional keys. XV. RESPONSE MAPS and Operational Information: Each agency shall provide the other agencies with all appropriate response maps as needed, or other similar response materials to facilitate efficient response and Command and Control functions. Response and Operational informational binders created will be exchanged and reviewed annually when this agreement is reviewed or as needed. XVI. INTER-JURISDICTIONAL TRAINING: Shared Battalion Chiefs shall endeavor to attend training in the other jurisdictions for the purpose of operational familiarization and coordination. Shared Battalion Chiefs shall attend! provide command training on a minimum quarterly basis. XVII. AGREED UPON MINIMUM SERVICE OBJECTIVES These parameters are based on the totality of call volume, geographical area of coverage needs and response travel distances, simultaneous incident response coverage, coverage gap probabilities, etc. 1. 2 Battalion Chiefs on duty 24/7, available for immediate response, for the South County Region. 2. 1 Battalion Chief to be at scene in the South County Region urban area (valley floor) within 15 minutes 90% of the time. 3. 2nd Battalion Chief will arrive at the 151 incident or to a new incident in the South County Region urban area within 15 minutes 90 % of the time. XVIII. CONFLICT RESOLUTION: Shared Battalion Chiefs shall contact the designated Battalion Chief or Duty Chief of the involved jurisdiction( s) whenever a conflict or misunderstanding arises in another jurisdiction that cannot be resolved at the company level, or may negatively affect any of the jurisdictions. If not resolved at the BC level it shall continue up through the chain of command. xx. AGREEMENT REVIEW: Parties to this agreement shall meet at least annually in the first quarter of each calendar year to review this agreement and to update and modify as required. XXI. COMPENSATION The parties agree, to the extent that compensation, including but not limited to statutory cost recovery is available from third parties as a result of an incident in which response was rendered under this Agreement, it is the intention of the parties to cooperatively pursue such compensation, and to allocated any recovery pro rata in accordance with the cost incurred by each party in providing response to the incident. XXII. LIABILITY/HOLD HARMLESS Nothing in the provisions of this Agreement is intended to affect the legal liability of any party to this Agreement by imposing any standard of care different from the standard of care imposed by law. Each party shall bear its own exposure for Workers' Compensation on its own personnel while furnished to the other party or otherwise. In lieu of and notwithstanding the pro rata risk allocation which might otherwise be imposed between the Parties pursuant to Government Code Section 895.6, the Parties agree that all losses or liabilities incurred by a party shall not be shared pro rata but instead the pursuant to Government Code Section 895.4, each of the parties hereto shall fully indemnify and hold each of the other parties, their officers, board members, employees and agents, harmless from any claim, expense or cost, damage or liability imposed for injury (as defined by Government Code Section 810.8) occurring by reason of the negligent acts or omissions or willful misconduct of the indemnifying party, its officers, board members, employees or agents, under or in connection with or arising out of any work, authority or jurisdiction delegated to such party under the Agreement. No party, nor any officer, board member, employee or agent thereof shall be responsible for any damage or liability occurring by reason of the negligent acts or omissions or willful misconduct of other parties hereto, their officers, board members, employees or agents, under or in connection with or arising out of any work, authority or jurisdiction delegated to such other parties under this Agreement. 5 REGIONAL BATTALION CHIEF OPERATIONAL AGREEMENT Gilroy Fire Department, South Santa Clara County Fire District and Santa Clara County Fire Department XXIII. AGREEMENT NOT FOR BENEFIT OF THIRD PARTIES This Agreement shall not be construed as, or deemed to be, an agreement for the benefit of any third party or parties, and no third party or parties shall have any right of action hereunder for any cause whatsoever. Any services performed or expenditures made in connection with this Agreement by either party hereto shall be deemed conclusively to be for the direct protection and benefit of the inhabitants and property, which are situated within the respective jurisdictions of the parties. XXIV. INDEPENDENT CONTRACTOR None of the provisions of this Agreement is intended to create, nor shall be deemed or construed to create, any relationship between the parties other than that of independent parties contracting with each other for the purpose of effecting the provisions of this Agreement. The parties are not, and will not be construed to be in a relationship of joint venture, partnership or employer-employee. xxv. NONDISCRIMINATION Parties shall comply with all applicable Federal, State, and local laws and regulations concerning nondiscrimination and equal opportunity in contracting. Such laws include but are not limited to the following: Title VII of the Civil Rights Act of 1964 as amended; Americans with Disabilities Act of 1990; the Rehabilitation Act of 1973 (Sections 503 and 504); California Fair Employment and Housing Act (Government Code Sections 12900 et seq.); California Code of Regulations, Title II, Division 4, Chapter 5; and California Labor Code Sections 1101 and 1102. Parties shall not discriminate against any subcontractor, employee, applicant or any person for employment or in the provision of services because of age, race, color, national origin, ancestry, religion, sex/gender, sexual orientation, mental disability, physical disability, medical condition, political beliefs, organizational affiliations, or marital status. XXVI. TERM This Agreement shall commence upon execution of this Agreement by all parties, and shall continue in full force and effect unless terminated as provided herein. This Agreement may be terminated upon written notice of termination given to the other parties at least ninety (90) days in advance of the effective date of termination. Notice of termination shall be personally served or mailed, postage prepaid to the address designated beneath the signature of the parties hereto; or to such other address as may be designated by written notice. 6 REGIONAL BATTALION CHIEF OPERATIONAL AGREEMENT Gilroy Fire 'Department, South Santa Clara County Fire District and Santa Clara County Fire Department XXVII. (GIL) Fire Chief XXVIII. AMENDMENTS TO AGREEMENT Except as otherwise specified, this Agreement shall not be amended or altered without the written consent of the parties. The Fire Chiefs of the Parties shall have the authority to mutually add, delete or amend the "Operational Procedures" and Service Area Appendices, including the areas in which auto-aid is to be provided along with the required staffing levels and the "Operational Procedures," as set forth in the Appendices, and to execute any documents required to implement such amendments to the exhibits. Any such amendment shall be mutually agreed upon and require the written consent of the Fire Chiefs of the parties or their designees. XXIX. ENTIRE AGREEMENT This document embodies the entire Agreement between the parties with respect to the subj ect matter hereof xxx. Battalion Chiefs (BCs) will advise the ECC that they are on duty. 2. ECC will ensure that other dispatch centers involved in the sharing (CNT and GIL) are advised which resources will have the coverage prior to 0730. 3. ECC will ensure the proper resource status is in CAD. 4. ECC will roster the battalion resources in CAD. 5. ECC will follow existing notification procedures & communicate to both battalion chiefs regarding south county resources and incident status. 6. ECC will dispatch both BCs in CAD to any multiple resource responses in any jurisdictions. 7. Both BCs will be dispatched and voiced out for any multiple resource response in The South Santa Clara County Fire District. 8. Any conflicts are to be attempted to be resolved at the lowest level possible and the ECC chief will be advised. 9 REGIONAL BATTALION CHIEF OPERATIONAL AGREEMENT Gilroy Fire Department, South Santa Clara County Fire District and Santa Clara County Fire Department APPENDIX A.2 - GIL Communications Plan GIL 9-1-1 Communications Unit Procedure Bulletin Vol. No. Division: _Dispatch Section: Date: Originator: Authorized: Date: South County Battalion Chief Coverage Purpose: To provide the guidelines for dispatchers to follow when a Fire Battalion Chief is needed in Gilroy, Morgan Hill, and!or South County Fire District as part of the shared Battalion Chief program between the three jurisdictions. Policy: Beginning April 1, 2010 at 0730 hours Gilroy Fire Department, Santa Clara County Fire and South Santa Clara County Fire Protection District will enter into an agreement to share Battalion Chief coverage in the South County area. This arrangement is effectively an automatic mutual aid agreement and requesting a single Battalion Chief from either County Fire or South District will require only a phone call rather than use of the REDNET. Procedure: Resources and Covera2e: Each agency will provide one Battalion Chief to respond as the closest BC to all types of incidents requiring a Chief Officer, regardless of jurisdiction or nature. There will be two Battalion Chiefs on duty each day in the South County area. One will always be from South County (CALFIRE) and one on duty from either County or Gilroy. B12 (eounty B3, B14 potential move up Bes) CAD Unit Identifiers and Dispatch Procedures: All of the unit identifiers have been entered and validated in the CAD to accommodate the log on and notification process. They will sort in CAD in the "DC" section, and shall remain logged on with the proper status at all times. Each morning at approximately 7:30 AM, the two Battalion Chiefs responsible for South County area will call Morgan Hill ECC and log on. Morgan Hill ECC will in turn call both Gilroy Fire and County Fire and advise who has the duty in South County. (Note) Gilroy Fire BC's will also log on via the Gilroy Fire Channel. In addition to the unit identifiers, ,the badge numbers for all County Fire and South District Battalion Chiefs have been added to CAD as valid resources because they will identify themselves on the radio with their agency and badge number. For example if the battalion chief with the duty is South District B 1611 then he will identify himself as "Battalion 1611" when on the radio and the dispatcher will status change the unit identifier B 1611. If the County Fire Battalion ChiefB12 is covering the duty for South County, he will identify himself as "County Battalion 12" on the radio, and the dispatcher will status change the unit B12. Upon recommendation of a Duty Chief on a Gilroy Fire event the dispatcher shall: . Dispatch the appropriate Fire Units . Call the appropriate agency to request a Duty Chief (CALF IRE or County) . Dispatch appropriate BC to the event. The intent of BC sharing is to keep the process the same as any Auto Aid or Mutual Aid request where the dispatcher calls the agency and asks for the type and resource needed. Therefore, the follow up phone call will be for requesting a battalion chief and the CALFIRE or County dispatcher will advise whether one is available and if so who is responding. The BC responding to the call will come on the radio and advise that he is responding and where he is responding from. All of this information will be logged on 11 REGIONAL BATTALION CHIEF OPERATIONAL AGREEMENT Gilroy Fire Department, South Santa Clara County Fire District and Santa Clara County Fire Department the CAD event. Upon receiving a request for a Gilroy Fire BC from CALFIRE or County Communications the dispatcher shall: . Determine whether a Gilroy Fire BC is available . If available create a MUT AID event . Dispatch the BC and provide the channel assignment Battalion Chief Status Keepin2: After it is determined which two BC's will be covering South County on any given day, it is imperative that their status is kept at all times with any changes in status being accurately documented in CAD. In the event that both BC's covering South County are committed to a single event and!or multiple events and another event comes into the Gilroy Communication Center requiring a BC response, the dispatcher will check to see if a Gilroy Fire BC is available to respond. If a Gilroy Fire BC is not available, the dispatcher will call CALFIRE for a BC on a mutual aid response and will log the appropriate BC responding to the event. All Gilroy Fire BC's will advise of status even if they are not covering the duty for South County in order to facilitate coverage for a call when both BC's in South County are committed to calls and there is a need for another Be. It is imperative that the Be's covering the duty be given the "Duty Chief' capabilities and be moved into the "DC" area in CAD. The BC's not covering the duty will be kept in the "CW" area after they log on. Elapsed Incident Time Broadcast and Notifications: To assist the BC's in ensuring that there is adequate coverage as well as to ensure that move-ups are done in a timely manner, BC's will be advised when a unit has been on a call for 20 minutes. ' On structure fire calls, BC's will be notified at the 15,30, and 45 minute marks of the structure fire event. BC's will be notified of the following: . Any multi engine response . When a paramedic is going to the hospital in the ambulance . "SDBC" designates the South District battalion chief and "GIBC" designates the Gilroy battalion chief. They will sort on the status monitor below the CF battalion chiefs, and shall remain logged on with proper status at all times. Each morning at approximately 8:00 a.m. Cal Fire will contact each agency and provide the badge numbers of the two Battalion Chiefs who will be responsible for covering the South County area. When the call is received, their badge number shall be updated into the appropriate unit ID. (Note: When entering the badge numbers for the SD Battalions Chiefs into the "DR", the "B" will have to be dropped from the badge numbers). For example if the SDBC is B 1611 then he will identify himself as "Battalion 1611" when on the air, and the dispatcher will status change the unit identifier B 1611. If the GIBC is B2, he will identify himself as "Gilroy Battalion 2" on the air, and the dispatcher will status change the unit identifier GIB2. Specific SD battalion chief unit identifiers (B 1611, B 1625 etc.) will sort on the status monitor with other SD equipment like SDE 1. Gilroy battalion chief identifiers will sort on the status monitor with other Gilroy equipment should it be logged on. Event Dispatchin2: For notifications purposes, two BCs will be recommended and dispatched on all multi- unit responses. Just like other two-alpha agency identifiers like SD or SJ, once the unit identifier SDBC or GIBC has been dispatched on a call the CAD will automatically move the unit ill to the prior "P:" field. Dispatching SCBC or GIBC on an event activates a notification email to whomever in logged into that unit. Once both BCs are dispatched on multi-unit events, the battalion chiefs will come up on the radio and indicate if they are responding or just monitoring. Upon recommendation of either SDBC or GIBC on a County Fire event the dispatcher shall: . Execute dispatch command . Follow up dispatch with phone call to appropriate agency (or coordinate with CF2/3) o Request response of BC o Advise which CF channel is being used . Dispatch appropriate BC on event 14 REGIONAL BATTALION CHIEF OPERATIONAL AGREEMENT Gilroy Fire Department, South Santa Clara County Fire District and Santa Clara County Fire Department The intent of BC sharing is to keep the process the same as any other Auto Aid or Mutual Aid request where the fire dispatcher calls the agency and asks for the type of resource needed. Therefore, the follow up phone call will be for requesting a battalion chief and the CAL FIRE or Gilroy dispatcher will advise whether one is available and if so who is responding. Upon receiving a request for B12 from CAL FIRE or Gilroy Communications the dispatcher shall: . Determine whether B 12 is available . If available create a MUT AID event o It will not be necessary to enter an override RC number. If additional resources are requested, update the event with the appropriate Mutual Aid RC. . Dispatch B12 utilizing D"B12 and provide channel assignment BI2. SDBC and GIBC Status Keepine:: The recommendation string for South County BC coverage will be: B12, SDBC, GIBC, B3. Because SDBC and GIBC are both part of the recommendation string, accurate status keeping for those unit IDs is required. They will be either 10-8 or 1 0-7N. After it is determined which two BCs (BI2, SDBC, GIBe) will be covering South County on any given day, it is vital that the 3 rd BC is placed 1O-7N. T -Cards have also been created for all individual Battalion Chiefs. Elapsed Incident Time Broadcast: To assist the North County BCs in ensuring move-ups are accomplished in a timely manner when South County BCs are committed on an incident and both El Toro and Dunne Hill stations are empty, a 15 minutes elapsed incident timer message has been created. Upon the route of events in the South County area this timer will evaluate the status ofEl Toro and Dunne Hill resources after 15 minutes. Ifboth stations are empty a message will be queued to all logged on fire dispatchers: e.g. "Event #100260026 - Elapsed Time 15 Minutes Notify the on-scene Battalion Chief Upon receipt of an elapsed time message, notify the Battalion Chief on scene who will provide direction. Make move-ups if directed and also notify the next due battalion chief that South County move-ups are in progress. Operational Responsibilities: The BC sharing is for Operational functions. When a paramedic is going to the hospital in the ambulance . When any mechanical problem arises with an engine . When a rig is out of service for any reason . Login for daily staffing/ equipment accessible to all BCs in the South County (see Appendix A.l, SCC Communications Plan). 5. Ensure appropriate notifications are made through the Battalion Chief or designated Duty Chief via the responsible agency's Comm. a. Standard Notifications. . Significant events . PIO issues . Prevention . Operational . Performance . Personnel! injuries/ discipline . Complaints 6. Arrange immediate medical attention for personnel injured on an incident by coordinating injury reporting with responsible Battalion Chief or designated Duty Chief as appropriate. 7. Feed crews on incident as necessary, appropriate by coordinating with responsible Battalion Chief or designated jurisdictional Duty Chief. Other Jurisdictional Battalion Chiefs Will Not: 1. Arrange for equipment repairs a. When beyond the scope of the company officer, the Battalion Chief will contact the jurisdiction's Battalion Chief or designated Duty Chief. 2. Deal with MOU or Staffing issues 3. Do Employee evaluations a. BCs should provide performance input as appropriate to the home agency BC as noted in 2.b. above. 4. Complete fire reports outside of our jurisdiction, but shall provide incident summary for major incidents (i.e.; ICS 201 or similar), unusual circumstances as appropriate. 5.
