It is hereby mutually agreed that: I. WORK TO BE DONE In accordance with Notice No. 651.1 dated September 6, 1988, State shall adjust to grade Owner's manholes (3) and water valve (1) as shown on State's contract plans for the improvement of Road 152, EA 124414, which by this reference are made a part hereof. Owner shall have the right to inspect the work during construction. Upon completion of the relocation, Owner agrees to accept ownership and maintenance of the relocated facilities and relinquishes to State ownership of the replaced facility. Minor deviations from said plan may be made and incidental work may be performed by the State when mutually acceptable by both parties and on approval by the State. In the event the Owner wants to retain ownership of old facilities removed by the State's contractor, a clause stating this fact must be included in the special provisions, otherwise the Standard Specifications will award all salvaged material to State's contractor. II. LIABILITY FOR WORK Liability for the above - described work is at Owner's expense pursuant to Section 673 of the Streets and Highways Code, since the existing facilities now occupy the right of way of a conventional State highway. PERFORMANCE OF WORK Owner shall have access to all phases of the adjustment work to be performed by State for the purpose of inspection to ensure that the work is in accordance with the specifications contained in the Highway Contract; however, all questions regarding the work being performed will be directed to State's Resident Engineer for his evaluation and final disposition. IV. PAYMENT FOR WORK Estimated construction costs at Owner's expense is approximately $900.00. Owner agrees to deposit with State within 30 days of receipt of billing therefor, which billing shall be forwarded immediately following State's bid advertising date of the construction contract the sum of $900.00, which is the total estimated cost of the work. It is understood and agreed between the parties that this amount may be either more or less, and final costs will be based upon the actual contract bid price. Upon completion and acceptance of the Construction Contract, State will furnish to the Owner a Statement of Construction Costs to be borne by the Owner, and to refund to Owner any amount of Owner's advance deposit, as provided hereinafter, remaining after the actual costs to Owner have been deducted. Owner agrees to pay State promptly upon receipt of a Statement therefor, any amount over and above said deposit required to complete Owner's share of the costs. R/W 05 -2 2of3 OWNER. It is hereby mutually agreed that: I. WORK TO BE DONE In accordance with Notice to Owner No. 110.23.1 dated August 22, 1985, and Owner's letter of July 8, 1985, requesting the State to include the adjustment of approximately eighteen sanitary manhole and nine water valve covers to grade as part of the State's construction contract, the State shall perform the work as shown on the State's contract plans for the improvement of Road 152 from east of Monterey Street to Route 101 in Gilroy, E.A. 115731, which by this reference is made a part hereof. II. LIABILITY FOR WORK The existing facilities are located within the State's right of way as encroachments and will be adjusted at Owner's expense. III. PERFORMANCE OF WORK Owner shall have access to inspect the adjustment of said manhole and valve covers to ensure that the work is in accordance with the specifications contained in the Highway Contract. Upon completion and approval of the adjustment of said manhole and valve covers, Owner agrees to accept full Fes '� ibility for the maintenance of the adjusted aci ies. R/W 05 -2 1 of 3 0.05P IV. PAYMENT FOR WORK Estimated Cost: Utility Agreement No. 110. 2 3. 1 18 manhole covers @ $200.00 each = $3,600.00 9 valve covers @ $100.00 each = $ 900.00 TOTAL = $4,500.00 When the State contract is awarded, the State shall furnish the Owner with a statement of the actual bid price of the adjustment of manhole and valve covers to grade, whereupon the Owner agrees to pay the State the full amount within thirty days after the receipt of the statement of costs.
