RESOLUTImN OF THE COMMON COUNCIL OF THE CITY OF GILROY CONDITIONALLY
APPROVING FILING OF MAP OR PLAT OF TRACT No. 2336, PARK MEADOWS
UNIT NO. TWO
WHEREAS, there has been filed in the Office of the City Clerk
of the City of Gilroy a map or plat of Tract No. 2336, Park Meadows
Unit No. Two, and the Common Council of the City of Gilroy has been
requested to approve and accept said map~ and
WHEREAS, the said Common Council of the City of Gilroy has
heretofore adopted a Resolution providing that, as a matter of
policy, the City of Gilroy shall not accept any map or plat of a
subdivision for filing until and unless sewer and water mains have
been laid and installed in the subdivision, and the streets and alleys
therein graded, gravelled, and oiled, or otherwise surfaced, and the
sidewalks, curbs and gutters, electroliers, fire alarm boxes, and
hydrants furnished and installed, all to the satisfaction of the said
Common Council of the City of Gilroy, and there has been deposited
with the City Clerk of the City of Gilroy the sum of One Hundred
Dollars ($100.00) per lot for each lot in the subdivision to be
applied upon the cost of providing general off tract drainage as
heretofore provided for by the Council, ,or the subdivider has enetered
into a written agreement with the City of Gilroy to furnish and
install all of the said improvements and facilities and the agree-
ment is accompanied by a good and sufficient surety bond oonditioned
upon the faithful performance of the provisions of the said agree-
ment, the said sum of One Hundred Dollars ($100.00) per lot for
said drainage purposes to be paid to the said City Clerk notwith-
standing the said agreement~ and
WHEREAS, there are fifty-six lots in the Subidivision and
the deposit to be made with the City Clerk of the City of Gilroy to
be applied upon the cost of said drainage facilities is the sum of
Five Thousand Six Hundred ($5iGOO.00) Dollars~ and
WHEREAS, the City Engineer of the City of Gilroy has estimated

the cost of all the other facilities and improvements hereinbefore
mentioned, excepting the said drainage facilities, to be the sum
of Fifty-Six Thousand ($56,000.00) Dollars, and that sum should
be the amount of the bond hereinbefore mentioned~ and
WHEREAS, the Common Council of the City of Gilroy believes
that each of the four most easterly lots of the said tract, desig-
nated as Lots 25, 52, 53 and 80, should be restricted by some
effective means to a single family dwelling, and that the approval
of said map of said tract should be conditioned upon each of the
said lots being used solely for single family dwellings~ and
WHEREAS, the owner and subdivider of said tract has requested
the Common Council of the City of Gilroy to approve said map and
order the same filed upon the execution of the aforementioned
agreement, the furnishing of the said bon in the sum of $56,000.00,
the payment of the said sum of $5,600 to the City Clerk for the
purpose aforesaid, and the execution of building restrictions
covering the said tract which will include provisions effectively
prohibiting the use of each of the aforementioned lots constituting
the most easterly lots of the subdivision for anything except single
family dwellings~
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the
City of Gilroy that the said map or plat hereinbefore described
is approved and accepted by thecity of Gilroy, such acceptance and
approval being conditioned, however, upon the execution of the
aforementioned agreement and the furnishing of a good and sufficient
bomin the sum of $56,000.00, which bond shall be conditioned upon
the faithful performance of the provisions of the said agreement,
and which agreement and bond shall be approved by the City Attorney
of the City of Gilroy, and upon the payment of the said sum of
$5,600.00 to the City Clerk, and the providing by building restric-
tions or some other effective means which shall be recorded in the

Office of the County Recorder of Santa Clara County that the said
four most easterly lots of the subdivision shall be used for single
family dwellings only~ and, upon the giving, execution and filing
of the said agreement and bond, the payment of the said sum of
$5,600.00, and the execution and recordation of building restric-
tions or other means of restricting the use of the four lots herein-
before mentioned to single family dwellings, the said plat or
map shall stand approved and accepted and the proper officials of the
City of Gilroy shall then, and not before, be authorized to
executed ,the necessary approval and acceptance.
ADOPTED AND PASSED this 2nd day of February, 1959, by the
following vote:
