RESOLUTION NO. 507
RESOLUTION OF THE C()}lHON COUNCIL OF THE CITY OF GILROY AUTHORIZING THE EXECUTION
OF A CONTRACT WITH HIRASAKI FARNS, INC.
WHEREAS, the City of Gilroy is arranging to construct, lay, and main-
tain a pipe line for transportation and removal of industrial waste from the City
of Gilroy to the premises belonging to the City, known as the City Sewer Farm
and Dumping Ground, located about 2 miles Southeast of the City of Gilroy, which
pipe line will extend through the following described premises belonging to
HIRASAKI FAffi.1S, INC., a corporation:
BEING A portion of the Rancho San Ysidro in Santa Clara County,
California, as patented, and being more particularly described,
as fo11m.Js:
"BEGINNING at a point in the southeasterly line of Lot 6 of
the "Elizabeth H. Hartin Tract" as shown on the map thereof
recorded in Book "F" of Maps at page 31, Records of Santa Clara
County; said point of beginning being the most southerly corner
of the 3.24 acre tract of land described in the deed from Michael
Mondelli, et ux, to Geo E. Clausen, et ux, dated February 26,
1941, and recorded February 27, 1941 in Book 1029 at page 41,
Official Records of Santa Clara County; said point of beginning
being also the most northwesterly corner of the certain tract of
land conveyed to Consolidated Foods Corporation, by Deed Record-
ed Narch 2, 1956 in Book 3428 at page 174, Official Records of
Santa Clara County, and running thence along the westerly line of
said land conveyed to the Consolidated Foods Corporation, S. 30
56' 50" E. 344.25 feet to the southwesterly corner thereof;
thence along the projection westerly of the southerly line thereof
N. 890 17' 50" W. 15.99 feet; thence southerly along a curve to
the left with a radius of 957.00 feet, from a tangent bearing of
S. 270 34' E. through a central angle of 60 05' 50" for a distance
of 101.84 feet; thence tangentially S. 330 39' 50" E. 957.37 feet;
thence N. 560 20' 10" E. 5.00 feet; thence S. 330 39' 50" E.
1454.65 feet; thence along a curve to the left tangent to the
last mentioned line with a radius of 952.00 feet, through a cen-
tral angle of 140 56' for a distance of 248.13 feet; thence tan-
gentially S. 480 35' 50" E. 343.17 feet to a point in the westerly
line of the 60 acre tract of land conveyed to James S. Byers, by
deed recorded August 2, 1938 in Book 890 of Official Records at
page 207; thence along said westerly line S. 19P 24' 50" E.
65.70 feet to the southwesterly corner of said 60 acre tract in
the center line of a drainage ditch; thence along the sotlthwester1y
line thereof and the centerline of said ditch S. 480 35' 50" E.
1843.78 feet to the most southerly corner of said 60 acre Tract
in the center of the Llagas Creek, being also in the westerly
line of the 48.91 acre tract conveyed by Fanny Louis Shepard, et
al, to Andrew Nartin, by deed dated September 1, 1916 and re-
corded in Book 41,8 of Deeds at page 349; thence along said wester-
ly line S. 120 40' 50" E. 109.02 feet to the southerly line of salid
lands of Hirasaki Farms; thence South 57 - 47 West along the
Southerly line of said land la distance of 7.30 feet; thence parallel
with the southwesterly line of said 60 acre Tract conveyed to
Byers N. 480 35' 50" W. 2330.52 feet; thence tangentially along a
curve to the right with a radius of 1055 feet, through a central
angle of 140 56' for a distance of 274097 feet; thence tangentially

feet; thence N. 330 39' 50" w. 957.37 feet; thence along a curve
to the right tangent to the last mentioned line with a radius of
1043 feet, through a central angle of 200 58' 10", for a distance
of 381.72 feet to a point in the southeasterly line of Lot 6 of
said "Elizabeth H. Martin Tract"; thence along said southeasterly
line N. 510 15' E. 206.97 feet to the point of beginning, and
CONTAINING THEREIN 11.176 acres of land, more or less;" and,
llHEREAS, it is necessary for the said City of Gilroy to acql1ire an
easement or right of way over, in and through the premises above described for
the purpose of laying, constructing, and maintaining said pipe line and the said
HlRASAKI FARES, INC., has a'?,I'eed to rent to the City of Gilroy, an easement or
right of way over, on, across and through the said premises for the sum of One
Hundred ($100.00) Dollars per acre per year, if the City will pay the sum of
Two Thousand Five IIundred (~2500.00) Dollars in cash as additional consideration
for the purchase price of said property by said District, which latter sum is to
be paid at the time of the termination of the lease, and said lease will terminate
when the SANTA CU,-RA COUNTY HATER CONSERVATICN AND FLOOD COnTROL DISTRICT ac-
quires title to the said property; and,
WHEREAS, an agreement has been prepared covering the aforesaid
arrangements between the said HIRASAKI FAill1S, INC., and the City of Gilroy, and
has now been presented to the Common Council of the City of Gilroy for considera-
tion and approval, and said Common Council having duly considered the same,
BE IT THEREFORE RESOLVED that the COI!L.TTlon Council 01 the City of Gilroy
does hereby approve the aforesaid agreement as prepared and does authorize the
Hayor of the City of Gilroy to execute the said agreement on behalf of the said
City.
