RESOLUTION NOo 512
RESOLUTION: ,DETERMINING THAT OWNER AND SUBDIVIDER OF ESCHENBURG
PARK UNIT NO. 1 HAVE FULLY COMPLIED WITH PROVISIONS OF THE AG~":,,.
MENT FOR FURNISHING IMPROVEMENTS AND RELEASING SURETY ON BOND.
WHEREAS, the Common Council of the City of Gilroy has
heretofore approved the plat and map of the subdivision of certain
property within the City of Gilroy owned by SIG SANCHEZ, known and
designated as "Eschenburg Park.!' Unit Noo l"~ upon the condition
that the owners of said tract shall furnish and install sewer and
water mains~ storm drainage facilities~ grade and pave streets, con-
struct sidewalks.r curbs and gutterst furnish and install fire hy-
drants and alram boxes.r and electrolierst all to the satisfaction
of the said Common Council of the City of GilroYt and furnish a
satisfactory bond conditioned upon the faithful performance of the
aforesaid conditions, and,
WHEREAS, the said SIG SANCHEZ has heretofore and prior to
the approval of the aforesaid map entered into an agreement with
the City of Gilroy requiring him to furnish and install all of
the aforesaid facilities and improvementst and in addition furnish
a bond to be executed by a responsible surety company in the sum of
Ten ($10,000000) ThQusand Dollarst to be conditioned upon the faith-
ful performance of said agreement and which bond was duly executed
by United Pacific Insurance Company as surety and is dated
, and has been delivered to the City of Gilroy, andq
WHEREAS, the said SIG SANCHEZ has fully performed all the
conditions and agreements set forth in the aforesaid agreement
made with the said City of Gilroy, and the conditions upon which
said bond was issued have been fulfilled .and the said SIG SANCHEZ
should be released from any obligations thereunder and the bond
declared terminated and no longer in effecto
NOW, THEREFORE t BE IT RESOLVED:
That the Common Council of the City of Gilroy does hereby
declare that all the conditions set forth in the said agreement

have been complied with by said SIG SANCHEZ~ and that the said
bond which has heretofore been furnished by BIG SANCHEZ in the
sum of Ten ($lOqOOOoOO) Thousand Dollars shall be terminated
and declared to be no longer in effect and the surety thereon
exonerated and released from all liabilityo
