RESOLUTION NO. 535
RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY AMENDING
RESOLUTION NOo 519 OF SAID COMMON COUNCILc BY INCLUDING THEREIN
ADDITIONAL PROPERTY TO BE CONVEYED BY THE CITY OF GILROY TO ALBERT
GURRIES IN EXCHANGE FOR CERTAIN PROPERTY TO BE CONVEYED TO THE SAID
CITY BY SAID ALBERT GURRIES.
WHEREAS, the Common Council of the City of Gilroy has hereto-
fore and on the 6th
day of July
, 1959c adopted Reso-
lution No. 519
providing for the conveyance to ALBERT GURRIESq
certain real property located adjacent to the proposed extension of
a branch of Welburn Avenue, and the performance of certain other
conditions set forth in s aid Resolution in exchange for the convey-
ance to th-:,: City of Gilroy of land belonging to the said ALBERT
GURRIES located in the area which will form a part of the said
Welburn Avenue branch; and,
WHEREAS, the said ALBERT GURRIES has indicated that he will
not make the exchange or carry out the exchange of property in
accordance with said Resolution: unless the following described
premises now belonging to the City of Gilroy and located in the
City of Gilroy, are also conveyed to the said ALBERT GURRIES as a
part of the exchange{ to wit:
That certain parcel of land located in the city of
Gilroy: County of Santa Claraq state of California,
and more particularly described as follows:
BEING a portion of Las Animas Rancho Sublot Noo 43 in
the City of Gilroy as shown on Map No. 8 accompanying the
Final Report of the Referees in the Las Animas Rancho
Partition Suit of Henry Miller, et all VB. Massey Thomas,
et all Action No. 5536 had in the Superior Court of the
State of Californiag in and for the County of Santa Clara
and being a portion of the Westerly part of that certain
tract of land conveyed by Ernest Barnes to Albert Gurries
by deed dated January 8q 1941 a:.ld recorded January 24, 1941"
in Book 1024 of Official Recor~6, page 9; Santa Clara County
Records, and is more particular..Ly described as follows:
"BEGINNING at an iron pipe at the most northerly corner of
that portion of land conveyed by Ernes Barnes to Albert
Gurries in said Deed in the southeasterly line of Welburn
Avenue, 30 feet wide as conveyed to the City of Gilroy for
public street by Deed dated May 23, 1908 and recorded in
Book 343 of Deeds, page 72; Santa Clara County Records; thence
along said southeasterly line of Welburn Avenue So 700 W.
38000 feet; thence S. 190 55! 30" E. 31. 74 feet; thence No
880 50' 30" Eo 40013 feet to a point in the Northeasterly
line of said parcel of land conveyed from Ernest Barnes to

Albert Gurriesi thence along said Northeasterly line
N. 190 55! 30" w. 44.70 feet to the point of beginning,
and
CONTAINING THERE:nN 00033 acres of land."

WHEREAS, the Common Council of the City of Gilroy is of
the opinion that the said described premises are of little value
to the City of Gilroy and that they adjoin the premises of the said
ALBERT GURRIES which he will retain upon the exchanger and form
a natural addition theretog and the said Common Council believes
that the said premises should be in cluded in the property to be
conveyed to the said ALBERT GURRIES by the City of Gilroy: in
exchange for the premises to be conveyed to the City of Gilroy by
said ALBERT GURRIES.
NOW; THEREFORE, BE IT RESOLVED, that the said Resolution Noo
519 i adopted by the Common Council of the City of Gilroy: on the
6th
day of
July
I 1959, be and the same is hereby
amended by including thereing the direction and authorization to
convey to said ALBERT GURRIES, the premises hereinbefore described,
as a part of the e::;:change and transaction set forth in said Resolution
No. 519
I and that said last designated resolution be modified
accordinglyo
BE IT FURTHER RESOLVED that in making the said exchange of
property, the Mayor of the City of Gilroy is directed to execute
a Deed of Conveyence which will include the premises hereinabove
describedo
