RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY AUTHORIZING
THE MAYOR OF THE CITY OF GILROY TO EXECUTE A NEW LEASE BETWEEN
THE CITY OF GILROY AND HENRY ALLEMANDo
BE IT RESOLVED that the lease heretofore entered into between
the CITY OF GILROY and HENRY ALLEMAND, on the 3rd day of January: 19551
wherein the said City of Gilroy leased to the said Henry Allemandl
certain portions of the Gilroy Sewer Farm property described as being
Lot 11 Lot 21 Lot 31 Lot 51 Lot 6, Lot 81 and all that part of Lot
4 not used for sewage disposal or other municipal purposesl as said
lots are numbered and designated upon that certain map dated JanuarYI
19301 of the Gilroy Sewer Farml made by Ro Wo Fisherl Civil Engineer,
beginning January 3, 19551 and ending October 311 1960, be terminated
and cancelled effective the 1st day of November 1959: and that a new
lease be entered into with said Henry Allemand for the term of Six (6)
years beginning November 11 1959.. upon the same terms and conditions
set forth in the aforementioned lease dated January 3, 19551 except
that said new lease shall contain provisions that in the event the
Lessee shall die or is incapacitated from farming or operating the
leased premises before the eA~iration of the term: the lease shall
terminate as soon as any crops then in the groundl growing, or in
the process of being harvestedt are harvestedo
BE IT FURTHER RESOLVED that the Mayor of the City of Gilroy
be and he is hereby authorized to execute on behalf of the City
of Gilroy: a lease which shall include the provisions hereinbefore
mentionedo
PASSED AND ADOPTED this 26th day of Octoberr 19591 by the
following vote:
