RESOLUTION NO. 77-1
RESOLUTION OF THE CITY OF GILROY APPROVING A PLANNED
UNIT DEVELOPMENT PERMIT, SUBJECT TO COMPLIANCE WITH
THE PLANS, SPECIFICATIONS AND DESIGNS FILED WITH THE
APPLICATION AND THE CONDITIONS IMPOSED HEREIN, FOR
DEVELOPMENT OF THAT 2.9 ACRE PARCEL LOCATED ON THE WEST
SIDE OF CHURCH STREET, SOUTH OF PIERCE STREET AND ADJACENT
TO LAS ANIMAS PARK.
WHEREAS, LARRY FRISONE has heretofore filed with the Planning
Commission of the City of Gilroy a petition in due form requesting
approval of a Planned Unit Development permit for development of 2.9
acres of property located on the west side of Church Street, south of
Pierce Street and adjacent to Las Animas Park, and
WHEREAS, the Planning Commission of the City of Gilroy has given
due notice of a public hearing upon the said application, in accordance
with the Zoning Ordinance of the City of Gilroy, has held the hearing,
has approved a Negative Declaration under the California Environmental
Quality Act, and has made its report to the Council of the City of
Gilroy, in which it recommends approval of a planned unit development
permit, subject to certain conditions, and
WHEREAS, the Council of the City of Gilroy has fixed the 3rd
day of January, 1977, at the hour of 8:00 o'clock p.m. in the Council
Chambers in the City Hall at 7390 Rosanna Street, Gilroy, California,
as the time and place for hearing the said report and recommendation
upon the said application, and notice of the said hearing has been
given in accordance with the said Zoning Ordinance, and a public hearing
has now been held upon the said application, at the time and place
fixed in the said notice, before the Council, and the Council having
duly considered the said application and the evidence presented, the
Council does hereby determine:
1. That the Council approves the Negative Declaration under the
California Environmental Quality Act.

2. That the Council approves and adopts the findings of the
Planning Commission set forth in its Resolution No. 76-41.
3. That a Planned Unit Development permit be granted subject
to the conditions set forth below.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY
that a Planned Unit Development permit be granted for the premises
described below, subject to the following conditions:
(1) That the Planned Unit Development permit be issued for
R3 development, subject to the condition that all im-
provements are to be constructed in accordance with
plans, specifications, designs, and landscaping filed
with and approved by the Planning Commission, or no
building permit be issued.
(2) That construction start within six (6) months of approval
of the project and that the entire project be completed
in one (1) stage of construction.
(3) A six (6) foot high chain link fence and screen planting
or decorative block wall shall be installed along the
entire perimeter of the project.
(4) Detailed landscaping plans showing type, size, quantity,
and location of plant materials to be used, and an
irrigation system plan shall be submitted to the Depart-
ment of Planning for review and approval. Landscaping and
permanent sprinkler systems shall be installed prior'to
issuance of an occupancy permit.
(5) Development of this project shall be in conformance with
Exhibits A & B, dated December 22, 1976, as approved by
the Planning Commission.
(6) The owner shall dedicate a 5 l/2 foot strip along his
Church Street frontage and improve said frontage to City
standards.
(7) Improvements to the property frontage shall include 5 foot
wide monolithic sidewalks and three electroliers.
(8) The residual land of the project site shall be dedicated
to the City of Gilroy for inclusion into Las Animas Park.
(9) All fill material within the building sites, parking lots,
and driveways shall be removed and compacted to 90% relative
density. Mounding and driveways shall be elevated to no
less than 204.00 feet.
(10) The developer shall provide a raised levy or masonary wall
along Miller Slough and along the westerly property line
to intersect with the existing mound. The masonary wall

shall be built at a minimum elevation of 204.00 feet.
(11) Entrance driveways shall continue to rise above the back
edge of the sidewalk to protect the property from potential
flooding from the street.
BE IT FURTHER RESOLVED that upon completion of all phases of con-
struction, the entire premises be rezoned R3 (Medium Density Residential)
as developed.
The said premises hereinbefore mentioned are described as follows:
Located in the City of Gilroy, County of Santa Clara,
State of California, to wit:
West side of Church Street, south of Pierce Street and
adjacent to Las Animas Park also shown as Parcels
790-26-l1, l2, l3 and 14 in the Santa Clara County Tax
Assessor's Map Book, containing 2.9 acres.
