RESOLUTION NO. 1843
RESOLUTION OF THE CITY OF GILROY MODIFYING RESOLUTION
NO. 1545 FOR A PLANNED UNIT DEVELOPMENT OF A 24.1 ACRE
PARCEL LOCATED ON THE WEST SIDE OF MESA ROAD NORTH OF
AND ADJACENT TO GAVILAN COLLEGE
Upon application of MADONNA DEVELOPMENT CO., as successor to
SAMUEL R. SPENCER, and good cause appearing therefore:
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY that the
Planned Unit Development Permit heretofore granted by Resolution
No. 1545 is modified as follows:
1. Permission to develop 0.8 acre as Cl (Neighborhood
Commercial) is revoked, with said 0.8 acre to be added to the 13.5
acres of R3 (Low Density Multiple Family Residence) development.
2. The tract map for the development shall be amended to
provide that the owners and residents of the apartment units on
lot 91 shall have access to and use of open space lot 90.
3. The amended plans and designs for 100 apartment units
containing a maximum of 214 bedrooms as filed by the applicant
are hereby approved, on the condition that building permits for
no more than the 100 apartment units and 20 single family residences
be issued prior to August 1, 1976.
4. The developer should submit plans and phasing for completion
of the Planned Unit Development for review and recommendation by
the Planning Commission prior to August 1, 1976.
5. Upon completion of the apartment units, the entire 24.1
acre parcel be rezoned.

approved.
