RESOLUTION NO. 1275
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
APPROVING AND ADOPTING THE RULES AND REGULATIONS
FOR THE GILROY FIRE DEPARTMENT AS OF SEPTEMBER, 1968
BE IT RESOLVED by the Council of the City of Gilroy
that the Rules and Regulations for the Gilroy Fire
Department of September, 1968, a true copy of which is
annexed hereto as Exhibit A, are hereby approved and
adopted for the operation of said department.

These Rules and R~gulations are prepared for the Fire
Department of the City of Gilroy for the general guidance of
all. They cannot cover every problem or question that may arise,
nor can they cover every specific act or duty. Much must be
left to the individual to perform his duties in a conscientious
manner, using his intelligence and discretion.
Loyalty and integrity are Important to good teamwork,
and these qualities are particularly stressed. Every man
owes these qualities to his Department, his fellow workers and
the community as a whole.
Since the strength of any organization is founded on the
quality of its individual members, we should each place before
ourselves the ideal of the best service possible to our fellow
citizens and strive always to serve that ideal.
The rew.ards will be many and one of the greatest will be
the satisfaction you will get from a Job well done.

GENERAL RULES
ARTICLE I
FIRE CHIEF
SECTION I The Fire Chief. under th0 direction of the City AdminIstrator. shall
be the chief administrative officer of the Fire Department. He
shall have control, management and supervision of all members of the
Department.
SECTION 2 He shall recommend to the City Administrator, from time to time, the
selection of new sites, changes in the location of stations and com-
panies, the building of new stations, the purchase of new apparatus,
hose, equipment, etc., and the sale of old hose, equipment, etc., not
necessary for continued use in the operations and maintenance of the
Department.
SECTION 3 He shall cause to be kept in proper form an accurate record of all
business transacted within the Department.
SECTION 4 He shall have power to assign all companies to fire or other duty
and shall make all assignments, transfers and details as he may
deem for the best interest of the service.
SECTION 5 He shall cause to be extinguished all fires with the least possible
danger to life and property and prevent unnecessary damage.
SECTION 6 He shall see that all premises on which fires occur are left in such
condition that they will not rekindle and cause further damage to
life and property and that all property Involved in fire is left in
an orderly condition.
SECTION 7 He shall have the power to demolish buildings and parts of buildings
which, in his judgment, might endanger life or property or which it
may be necessary to demolish to prevent the spread of fire as author-
ized by City Charter.
SECTION 8 He shall have the authority to dispatch apparatus and manpower to
calls for aid from other cities or fire departments when, in his
judgment, the call is necessary and the call is from a responsible
person and acting in accordance with City policy, when apparatus Is
sent out of the City on mutual aid, he shall notify the City Admini-
strator as soon as is reasonably practical.
~CTION 9 He shall report to the City Administrator any member who by reason
of age, disease, accident, or other incompetency does not or can-
not fully and promptly perform the <!utles required of him.
SECTI~ He may suspend or recommend dismissal from the service any member of
the Department for cause in such manner as provided by the ordinances
and Rules and Regulations adopted by the City Council.
SECTI ON II
He shall, at frequent intervals, consult with and issue orders or
instructions affecting the Department through the appropriate officer
He shall perform such other related duties as the City Administrator
may direct.
He shall periodically cause these Rules and Regulations, Policies and
Procedures and Department administrative forms to be reviewed to de-
termine current needs in administering the fire protection affairs of
the City.

ARTICLE II
ASSISTANT FIRE CHIEF

SECTION I The Assistant Chief shall rank next to the Chief in authority and
shall be delegated by the Chief to exercise the powers of the Chief
in his absence.
SECTION 2 He shall be just in his dealings with other officers and members of
the Department and see that order and proper discipline are main-.:
tained among members of the Department.
SECTION 3 He shall hold officers and company members under his direction re-
sponsible for promptness in discharge of their duties, the condition
of the companies in and out of quarters and for any neglect in car.
rying out and enforcing orders and rules governing the officers and
members of the Department. When he learns of any violation or dere-
liction he shall report the same to the Fire Chief with proper and
well-sustained charges.
SECTION 4 He may recommend suspension or dismissal of any member of the De-
partment under his command within standards of the service for cause,
supplementing his recommendation with charges in writing to the Fire
Chief.
SECTION 5 He shall see that the premises on which fires occur are left in such
condition that they will not rekindle and cause further dF~age to
life and property and that all property involved in a fire be left
in an orderly condition.
SECTION 6 He shall be respnsible for all Department property in his charge and
see that it is in proper condition for immediate use at all times.
SECTION 7 He shall perform such related duties as the Fire Chief may direct.
SECTION 8 He shall have power to assign all subordinates and companies under
his control to fire duty, effect transfers and details as may be
for the best interests of the service, subject, however, to the ap-
proval of the Fire Chief.
SECTION 9 He shall, after a fire is properly extinguished, see that all water
and debris are properly cleaned up and that required salvaging is
done. In cases of suspected incendiarism, all possible evidence
shall be properly processed.
SECTION 10 He shall, when in charge, cause all companies not needed at fires to
return promptly to service.
SECTION 11 During the absence of the Chief of the Fire Department, he shall have
authority to dispatch apparatus to fires outside the city limits,
providing such calls for aid are from persons in official capacity
or within City policy, he shall notify the City Administrator as
soon as is reasonably practical.

ARTICLE III
FIRE CAPTAIN
The Fire Captain shall, under the direction of the Chiefs, have
absolute command and control of the respective companies. In the
absence of a Chief Officer, the Senior Captain shall have the powers
and authof'ity of the Chief in times of emergency.
They shall ride on the seat of the apparatus going to and returning
from alarms of fire and shall see that all members of their company
ride in their proper positions on the apparatus responding to and
returning from emergency alarms, except such members as may be de-
tailed to other apparatus or special duty. They shall at all times
be concerned with the safety of their personnel.
They shall see that all apparatus sirens are continuously sounded
\"~hile responding to all emergency alarms and that red lights are on,

judgment, the siren is not needed.
The first in-district captain to arrive at a fire will be in charge
of such fire unless he is relieved by a senior officer. When an act-
ing captain is in charge of the first company to arrive at such fire~
he will turn over command to the first on-duty regular captain to
arrive at such fire, who will assume command unless relieved by a
senior captain, or a chief officer.
When not first to arrive, he shall promptly report his arrival to ~
the officer-in-charge and will be held responsible for proper loca-
tion of his company at a fire.
He shall, while working at fires, promptly report any dangerous
buildings, walls or floors to the officer-in-charge of such fire.
He shall see that the premises on which fires occur are left in such
condition that they will not rekindle and cause further dmger to
life and property.
He shall see, after a fire is properly extinguished, that all water
and debris arc properly cleaned IIp and that proper salvaging is
done. In cases of suspected incendiarism all possible evidence
shall be properly processed.
In case of responding to an alarm and upon arriving at the city li-
mits he finds that the fire is outside of the City, he shall immed-
iately notify the dispatcher by radio, proceed to fire, and exting-
uish fire or protect exposures until the arrival of an officer and
proper equipment of the other jurisdiction.
When a company is ordered back to quarters after an alarm, the com-
pany captain shall notify the dispatcher by radio that the company
is returning to quarters; he will net radio his unit out of service
unless he is unahle to respond to another emergency, but will note
if he is light water, hose, etc.
He shall, upon returning to quarters after an alarm, see that all
water tanks arc refilled, all wet and dirty hose is replaced and
that all apparatus and equipment are cleaned and made ready for

immediately if his company is not in 5~ch condrtion as to be placed
in service.
SECTION 13 lie shall require that all company fire fighters wear regulation fire
helmets and turnout coats from time of receipt of alarm ~ntil after
the Immediate emergency when, at his or the Chief's discretion, they
may dispense with the fire-fighting clothing~ Exceptions are the
rescue crew respond~ng In the rescue truck but they shall have their
fire turnouts and helmets with them at all times.
SECTION 14 He shall make a full report in writing of any courageous or meritor-
ious act performed by any member of the company and forward same to
the Chief of the Fire Department through the proper channels.
SECTION 15 He shall familiarize himself with all public buildings, manufactur-
ing plants. lumber yards, schools. theaters and other pertinent
buildings in his districto

its order and cleanliness and shall cause the front of buildings,
sidewalks, gutters and street to be kept clean und free from all en-
cumbrances.
SECTION 17 He shall preserve order and discipline in and about the company
quarters and at fires.
SECTION 18 He shall be Just, dignified and firm in his dealings with subordi-
nates, being careful to abstain from abusive and immoderate language
in giving orders. He shall see that all orders, rules and regula-
tions are strictly obeyed.

Members absent or late without proper notice will be reported late
after 8:00 ~.m. to the Chief, followed by a regular written report
if requested.
He shall equalize the work to be performed about quarters as nearly
as possible.
He may grant short leQves of absence to members of his company in
cases of emergency and then only when the strength of his company
will permit; such ~ime granted will be charged as per City Rules
and Regulations. The member shall notify his company officer or
dispatcher as soon as he Is eble to rletermine the time he will be
able to report back to duty. The Chief shall be notified, as soon
as is reasonable, of such action.
He shall see that all routine work is r.om~enced as soon after 8 A.M.
as possible and that members work steadily until the job is complete:

He shall report in writing to the Chief any member of their
company who does not keep himself and his unifo~m in a presentable
condition.
He shall promptly report any member who, because of sickness, fear,
age, or other reasons, cannot properly perform fire duty.
He may recommend suspension of any member of his company for cause
supplementing such recommendation with charges in writing to the
Chief.
He shall see that members remaining up after 10 p.m. conduct them-
selves in a quiet manner so as not to disturb those members who are
sleeping.
He shall cause fire alarm and/or other watch duty to be maintained
in the manner prescribed by the FIre Chief.
He shall carefully protect all public property from abuse and misuse
and shall particularly see that gas, water, electricity, fuel, gaso-
line, oil, and miscellaneous supplies are not wasted.
He shall not put apparatus out of service or leave quarters with
same for drilling or other purposes, except alarms, without first
notifying the dispatcher.
He shall inform the Chief whenever the apparatus or equipment in his
charge is in need of repairs.
He shall see that whatever work is done on the apparatus, other than
cleaning, is fully noted and recorded in the books kept for that
purpose.
He shall immediately inspect the entire apparatus when it is returned
from the shop to see that everything is ready for response to an
alarm.
He shall see that relief apparatus is returned in a clean condition
with all tools, implements, etc., belonging to such apparatus.
It is the respnsibility of the Captain to see that all apparatus
and equipment is properly cleaned each time it is returned to quart-
ers.
He shall train and instruct the members of his company and, by re-
gularly conducted drills, determine that the efficiency and coordi-
nation of his command, is maintained at a high standard.
He shall keep the daily journal in such a manner that it will be in
itself an accurate and complete history of the activities and oper~
tions of each company for each day. Everything pertaining to the
administration of the company or to the interest of the Department
shall be carefully noted as per Department policy. The log need not
reflect routine daily station maintenance.
He shall preserve, until their purposes have been served, all orders I
notices, communications and records pertaining to the operation of
his respective units.

He shall be responsible for the completeness, accuracy and dispatch
of all reports with which he is concerned. No reports or communi-
cations will be intercepted or unnecessarily delayed in transit.

partment through proper channels, in the case of accident or injury.
Captains at each station shall confer with each other in regard to
repairs, supplies and upkeep of quarters and shall work cooperatively
with each other.
When two or more Captains are located in the same quarters, they
shall confer with each other in regard to repairs, supplies and
upkeep of quarters and shall work harmoniously with each other.
The company Captain may be held jointly responsible with the company
Engineer for the safe arrival at the location of a call and the re-
turn to quarters and for any traffic accident or violation.
~Ie shall not permit his shift to go off duty until properly relieved.
If a member fails to report for duty on the on-coming shift, a mem-
ber from the off-going shift will be selected to remain on duty untij
such member reports for duty or other arrangements are made.
The Captain of a relieving shift in a case where the shift on duty
Is at a fire shall call roll and notify the dispatcher of his com-
pany.s readiness to relieve the on-duty shift. He shall then act
In accordance with the orders of the officer-in-cbarge of fire.
Under no circumstances shall any Captain of the Fire Department
make derogatory statements or adversely criticize Department policy
or the departmental activities of other officers, except in an
official written con~unicatlcn, through channels, addressed to the
personal attention of the Fire Chief, or personally, by oral report,
to the Fire Chief. If the problem cannot then be solved, It may be
taken to higher authorities in accordance with City Rules and Regu-
lations.
The doors to station and apparatus rooms will normally be kept
closed. Personnel must be aware that children and public may enter
the apparatus room unannounced.
He shall see that the members of his company become familiar with
all Rules and Regulations, Poltcies,and Procedures, And special
orders of the Fire Department.
It shall be the Captain's duty to perfonm fire prevention duties
when directed to do so by the Fire Chief. He shall familiarize him-
self with the construction, the type of business carried on, the
contents and whether combustible or non~eombustible, of all building:
within the City of Gilroy insofar as possible.

SECTION 50 He shall be able to ~ct as Engineer for his COffi?any whenever he is
detailed to such acting position by the officer-in-charge.
SECTION 51 ~o Fire Captain, either regular or acting, shall permit social,
fraternal, or political gatherings to assemble in the Department
quarters unless such p~rmission Is granted by the Chief of the FIre
Department.
SECTION 5~ He shall have the power to temporarily suspend from duty, as per
City Rules and Regulations, any member under his command, and shall
promptly report through channels, in writing with well-sustained
charges, any member for breach of same to the Chief of the Fire De-
partment.
SECTION 53 He shall perform such stand-by time as may be required by the Chief
of the Fire Department.

ARTICLE IV
TRAINING OFFICER
The Training Officer shall be under the immediate supervision and
direction of the Chief of the Department.
He shall be responsible for developing and administering a compre-
hensive program of In-service training for officers and men of the
Department. In all phases of the training program he shall include
Instruction in accident prevention, thus assisting all personnel in
their development in safety consciousness.
He shall formulate and instruct fiie brigades and emergency crews
of industry and hospitals In the City of Gilroy.
He shall plan, schedule &~d conduct regular training sessions and
drills for the members of the Department.
He shall respond to fires and other emergencies and assist suppres-
sion forces as necessary. He will observe and gather information
relative to fire fighting operations. Time and conditions permit-
ting, he will photograph fireground activities. He shall evaluate
the information obtained to be used for improvement of methods and
techniques.
At all times he shall seek and use the most modern and efficient
methods of training of all Fire Department personnel.
He shall supervIse the tr~Jning given by c~pcny captaIns end see

He shall keep traIning records of all companies and all members and
shall forward progress reports and monthly reports to the Chief.
He shall prepare and submit to the Chief an annual report of all
Training Division activities including statistical compilations of
manhours in training and such additional recommendations and conc-
lusions as may be necessary or required.
He shall maintain, keep current and update the Department Training
Manua 1 .
He shall be assigned to suppres5ion or other activities when requlrec
as deemed necessary by the Chief.
He shall be responsible for the facilities, equipment and apparatus
assigned to the Training Division and shall see that they are pro-
perly maintained.
He shall standardize methods of operations as directed by the Fire
Chief. Acting in this capacIty, whenever operational differences
arise, he shall determine which procedures are to be the standard
operations.
He shall coordinate the target inspection program.
In cooperation with the Fire Inspector, he shall conduct training
in fire prevention inspection methods for engine company personnel.

SECTION 16 He shall be responsible for conducting a physical fitness progr~m,
whether through regular training or special programs.

ARTICLE V
FIRE PREVENTION OFFICER
The Fire Prevention Officer shall be under the im~ediate supervision
of the Fire Chief and shall perform the function of his office as
generally hereinafter outlined. He shall be gcverned by the Rules
and Regulations of the Department and City as they may apply.
It shall be the duty of the Fire Prevention Officer to enforce the
provisions of the Fire Prevention Code and the laws and regulations
of the City of Gilroy and the State of California pertaining to fire
prevention and fire protection.
The Fire Prevention Officer shall inspect or cause to be inspected
all buildings and premises in the City of Gilroy in accordance:
with the provisions of the Fire Prevention Code.
He shall coordinate inspections to be made by the fire companies in
their districts.
He shall promptly investigate or cause to be investigated all com-
plaints received by the Bureau of Fire Prevention.
He shall investigate or cause to be investigated the cause, origin,
and circumstances of each and every fire occurring in the City of
Gilroy.
He shall establish and maintain comprehensive records of all busines~
transacted such as complaints, inspections, investigations, notices
served, and permits written.
He shall make such reports to the Fir~ Chief as he may require from
time to time.
He shall be just and dignified, firm in his dealings with his sub-
ordinates and just and dignified, impartial and courteous in his
dealings with the public.
He may, with the approval of the Fire Chief, give for publication
or for other purposes, any information regarding fires or other in-
formation which may be of value in preventing fires or for the pro-
tection of life and property'from fire.
He shall attend Planning Commission meetings, architectural meetings
and other meetings as required by the Fire Chief.
He shall perform such other related tasks as assigned.
He shall work with and assist the City Building, Planning, and other
City departments in matters pertafning to fire and life safety.
He shall plan and conduct such public educational programs on fire
prevention and life safety as he deems necessary or as directed by
the Fire Chief.

ARTICLE V - FIRE PREVENTION OFFICER
SECTION 14 He shall acquaint himself with n"tionally recognized standard
practices for the safeguarding to a reasonable degree life and
property from the hazards of fire and explosion arising from the
storage, handling of hazardous scbstances, m~ter!als and devices
and from conditons harzardous to life and prop~rty in the use or
occupancy of buildings or premises. He shall be thoroughly familiar
with the Fire Prevention Code and all other rUles, regulations,
codes, ordinances and laws pertinent to fire prevention and life
safety.
SECTION 15 He shall, when on duty, keep the Dispatcher informed of his where-
abouts at all times, maintaining contect by either radio or tele-
phone.
SECTION 16 Information received and business conducted by the Bureau of Fire
Prevention, which is of a confidential nature shall not be given
out to or discussed with any person or group of persons who are not
concerned therewith. This shall pertain to Fire Department members
as well as the public.

ARTICLE VI
FIRE ENGINEER
Engineers, under their company Captains, have the care and manage-
ment of the apparatus and shall be held responsible for the proper
condition of same. They shall see that it is clean, in good order
and ready for immediate service at all times.
He shall inform the company Captain vJhen apparatus requires main-
tenance or repairs.
He shall carefully instruct other members of the company who may be
placed in charge of the apparatus as to handling of same, and report
to the company Captain any neglect or violation of the rules in re-
gard to the care of apparatus which may have occurred during their
absence.
He shall have the motor and apparatus clean and ready for inspection
at all times, except in case of a previous working fire.
The off-going Engineers or drivers must deliver their apparatus to
the on-coming Engineers in good order and report to them everything
that has occurred during their shift which pertains to the operation
and care of the apparatus.
The Engineer shall be responsible for receiving the location of the
alarm from the company Captain, for getting his engine to the scene
of the fire, and for placing and connecting same for pumping.
Engineers shall, at all times, drive and operate apparatus in a
manner consistent with safety. Due regard for the welfare of the
public shall govern the operation of all apparatus.
Engineers shall familiarize thamselves with practices and procedures
relative to water supply, fire streams, pump capacities, motor. pump,
and other operations which will enable them to efficiently perform
their duties.
He shall remain with the engine at all emergencies unless it is
necessary for him to assist with lines, ladders, etc., and then only
under orders of superior officer.
He shall, at all times, when standing by or operating the pump,
watch for a signal from the fire location.
He shall not engage in any unnecessary conversation while operating
engine.
Engineers on their days off, responding to an alarm of fire, shall
act as Firemen, unless otherwise assigned.
An Engineer shall perform such other duties as are required by his
superior officers and the Rules and Regulations of the Department.

SECTION 14 When a Fire Captain is not on duty at a station, the senior Engineer
on duty will hold the position of Acting Captain unless otherwise
designated and shall be held responsible for enforcement of Rules
and Regulations, Department Polici~s and Procedures and the actions
of his company.
SECTION 15 He shall perform such other duties as may be required and shall
promptly and cheerfully obey all orders, Rules and Regulations of
the Department.
SECTION 16 Acting Captains shall have the authority and be required to enforce
the regulations and orders of the position and will be charged with
the knowledge of and be accountable for the proper execution of the
duties of such rank.
SECTION 17 Acting Captains shall be accorded all the privileges pertaining to
the office in which they are acting and shall be obeyed and respected
accordingly.
SECTION 18 No Acting Captain shall alter or annul the standing orders of the
regular officer without specific authority of the Chief.
S~CTION 19 Engineers shall familiarize themselves with the duties and responsi-
bilities of the Fire Captain under the direction of the Fire Captain.
SECTION 20 Engineers shall see that apparatus and equipment records on equip-
ment in their charge are kept in a proper manner.

ARTICLE VII
FIREMEN

Fir~nen shall be under the immediate superviston of their company
Captains.
Firemen shall respond to all alarms and/or emergency calls with
their respective companies while on duty or when so directed by
the Department and at all times conform to and obey promptly and
cheerfully the Rules and Regulations of the Fire Department.
They shall extingui sh fires and take proper preca'Jtions to prevent
rekindling thereof.
They shall acquire knowledge of the operation of all various types
of apparatus, tools, and equipment in llse in the Department. They
shall, under the direction of their superior officers, maintain such
apparatus, tools, and equipment as are in their care or possession
in a clean condition and in readiness for operation at all times.
Firemen shall assist the Engineers in keeping the apparatus clean,
neat and in good order; they shall keep the quarters, hose, ladders,
tools and implements of the Department in good order and ready for
immediate use in case of fire.
Firemen shall familiarize themselves with the Rules and Regulations
of the Department and perform such other duties as the Fire Depart-
ment officers may direct.
In the absence of a Captain and Engineer, the senior Fireman will be
In charge and make such immediate decisions as are necessary for the
situation.
ARTICLE VIII
DISPATCHERS
SECTION 1 The fire alarm operators, under the direction of the Headquarters
officar, shall interpret and transmit messages and fire alarm sig-
nals and shall dispatch companies to all alarms. They shall be
courteous in their contacts with the public and make every effort
to give satisfaction.
SECTION 2 They shall familiarize themselves with the streets, street numbers,
running cards, alarm codes and alarm system equipment. They shall
be able to receive and transmit alarms or codes quickly and accur-
ately.
SECTION 3 They shall immediately advise the Headquarters officer of conditions
equipment or personnel which interfere with the efficient operation
of the dispatch center.
SECTION 4 They shall maintain a dispatcher's manual, running cards and other
records as directed by the Headquarters officer.
SECTION 5 They shall familiarize themselves with all department rules and
regulations and policies and procedures, especially those applying
to dispatching and response to alarms.
SECTION 6 They shall remain at all times at their post of duty unless relieved
by a fully-qualified operator.
SECTION 7 They shall keep an accurate record of the status of all companies.
SECTION 8 They shall make communications tests and record same in accordance
with department procedures.
SECTION 9 They shall receive and transmit to all companies and appropriate
authorities all hydrant information, street information, fumigations:
house moving and other information as directed by the chief officers
or the Headquarters officers.
SECTION 10 They shall keep equipment, appliances and dispatching office in pre-
sentable and serviceable condition. They shall immediately notify
the Headquarters officer of repairs needed for equipment under their
control.
SECTION 11 They shall assist the company officer in the training of firemen as
relief dispatchers nnd perform such related work as may be required.

ARTICLE IX
GENERAL RULES
SECTION I Members of the Department shall devote their entire time and atten-
tion to the service, attending fires and alarms of fire to which
they are assigned, detailed or called; riding on the apparatus
going to and returning from ala~ms of fire, unless otherwise direc-
ted. They shall perform full duty under any and all circumstances.
Fatigue from duty at a previous fire will not be accepted as an
excuse for failure to respond to an alarm. All off-duty members in
the station shall re~pond to alarms of fire unless excused by com-
pany officer or the officer-in-charge. All off-duty members are
subject to call on order of the officer-in-charge of emergency.
SECTION 2 They will conform to and promptly and cheerfully obey all Rules,
Regulations and orders for the government of the Department.
SECTION 3 They will not give away, sell or in any way dispose of any property
belonging to the Department. Loaning of any property belonging to
the Department shall conform to the written policies of the Chief
of the Department.
SECTION 4 On-duty members shall not enter any place in uniform where intoxi-
cating liquors are sold except in the strict discharge of duty. No
member in uniform shall drink any alcoholic beverage. No member,
while on duty, shall be under the influence of intoxicating liquor,
beverages, drugs, or compounds.
SECTION 5 Any member absenting himself from duty because of drink or reporting
for duty under its influence will be subject to disciplinary action
from the Department.
SECTION 6 They shall not be guilty of conduct in any way unbecoming a gentle-
man nor conduct thems~lves in any manner prejudicial to the good
reputation, order or discipline of the Department.
SECTION Z All members will be encouraged to pay their just debts when due.
Repeated complaints or failure or refusal to do so will be consi-
dered not in the best interests of the service.
SECTION 8 Members, when speaking to an officer, shall address him by title,
such as "Chief," "Captain," etc., wlli Ie on duty.
SECTION 9 No information relative to the business of the Department shall be
furnished persons not connected therewith except as ~uthorized by
the Chief of the Department.
SECTION 10 Members are strictly prohibited from engaging in altercations while
on duty under any circumstances.
SECTION II Members shall maintain lockers in a neat and clean condition at all
times.

ARTICLE IX - GENERAL RULES
SECTION 12 Each member is required to have a single party line telephone to
his residence. Any change in telephone number must be reported to
the Chief, or the Dispatcher as soon as possible and he will for-
ward the information to the Chief.
SECTION 13 Members shall report to the Chief as soon as possible any change
of residence. Failure to do so shall be deemed sufficient cause
for suspension.
SECTION 14 No member, while on duty, shall leave the station premises on pri-
vate or semi-private business without first receiving permission
from his superior officer.
SECTION 15 Beds may be occupied by members from 8 P.M. to not later than 7 A.M.
only and no lounging or reclining in a position to indicate sleep
will be permitted at any other time, except in case of sickness or
fatigue resulting from exertion through actual duty immediately
preceding. This exception may be authorized by the company Captain.
SECTION 16 All members shall report for duty sufficiently early (at. least by
7:50 A.M.) to enable themselves time to be ready for response at
shift change time (8.A.M.)
SECTION 17 In case a member is prevented from reaching his company in time to
report for duty because of sicknc~s or other unavoidable occurrence
he will, at the earliest time possible, inform Headquarters Officer
who will so advise the affected station and, if necessary, arrange
through the Chief for sufficient manpower to cover the shift.
SECTION 18 Should any member on leave fai 1 to report for duty at the expira-
tion of said leave, it shall be the duty of the company Captain
of the company to which the member is assigned to report such fact,
through channels, to the Chief, who will make an investigation and
take such action as he feels the circumstances warrant.
SECTION 19 Members of the Department refusing to obey the orders of an Officer
shall be reported immediately, as per Department Policy, to the
Chief, through proper channels. Failure on the part of any officer
to so report will constitute a violation of this rule.
SECTION 20 Applications for transfer shall be made in writing over the signa-
ture of the applicant, stating fully and truthfully the necessity
therefore, with the approval or disapproval of the company officer
~~d reascntherefore, and forward through regular channels to the
Chief.
SECTION 21 Any member leaving the Department for any cause must return through
the company Captain all Department property that has been assigned
to him. Otherwise, the cost of the articles not so returned will be
deducted from his final paycheck.

Employees shall not place long distance telephone calls through
Department telephones except on City business. Captains will be
held strictly responsible for the enfore~ent of this rule. Placing
and receiving parsonal local calls shall be held to the minimum.
All members of the Department shall provide themselves with a
regulation uniform on the date of such employme.nt. Members promoted
shall do likewise by the effective date of promotion.
Members must keep uniforms and turnout clothing clean and well re-
paired.
Members, while taking part in Department-approved athletics and/or
exercises, may wear athletic shirts and tennis shoes other than that
of regulation uniform. Such clothing worn shall be clean, free from
tears, and shall be removed immediately following the finish of games
and exercises.
All uniformed members of the Department will provide themselves with
a standard uniform, fitted with proper buttons, braid and insignia,
according to uniform specifications and amendments. All uniformed
members shall provide themselves with regulation black ties and sock~
of black or dark blue color. Dark socks with lower portion white
will be permitted.
No members of this Departmant shall use their badge or any part of
the Department uniform, or associate their relationship with the
Gilroy Fire Dapartment in an effort to seek any reward or personal
concessions on their behalf, nor will they accept any reward for
doing their departmental duty.
No member of the Gilroy Fire Department snaIl wear on his uniform
any emblem, insignia, or other device emblematic of any secret,
social or beneficial ordar, other than that connected with the De-
partment. Any member holding an honorable discharge from the Armed
Forces of the United States may wear, while in dress uniform and
taking part in patriotic demonstrations or parade, a war service
ribbon or medal as may have been authorized by the Government, on
the left breast.
All officers and members of the Department shall wear the Department
badge on the left breast while in uniform. He shall not, under any
consideration, loan his badge to any other person.
The loss of a badge shall be reported immediately to the company
Captain who shall in turn notify the Chief through proper channels.
The Fire Chief may, at his discretion, change the uniform regula-
tions of the Department consistent with changing times and condition~
Uniform specifications will be on file in the Fire Department office.

to engage in conversation with spectators or among themselves~ but

When a company at the scena of a fire is not called into action, its
members shall remain on ths apparatus unless otherwise ordered.
All members on duty except Chief Officers shall wear fire helmets
and turnout coats while responding to an alarm on the apparatus
(excluding the rescue unit). Permission to remove coats may be
granted by compnny Captain if conditions so warrant.
At suspicious fires or when strong odors of flammable liquids or
obnox i ous odors are ev i dent, or where there is phys i ca I ev i dence 0';:
arson, extreme care should be used not to destroy or move possiblr!
evidence. Members will take due notice of all circumstances per-
taining to such fires for future action or for presenting eviden=e
in court.
Members shall promptly cause all persons in danger from burning
buildings and adjoining premises to be removed therefrom with the
least possible danger to life and limb.
Members on "off-shift," when responding to an alarm of fire, shall
abide by all existing traffic laws.
Members occupying beds in quarters when off-duty will be required
to respond to all alarms to ~hich the co~pany responds and shall be
governed by all Rules and Regulations of the Department. Permission
to occupy beds when off-duty shall be secured from the company Cap-
tain. Permission to live at stations for an extended period of
time shall be secured through the Chief.
Any member while off-duty, responding to an alarm of fire, shall
report to the officer-in-charge of such fire, who will assign hi"
to duty as he may determine. He shall not leave until dismissed by
the officer-in-charge of the fire.
He shall not permit persons not connected with the Department to
ride on the apparatus unless otherwise authorized by the Chief.
Members are prohibited from smoking on apparatus and shall not
smoke at fires and calls except when permission to do so is granted
by the officer-In-charge of such fire or call.
The loss of spanners, hose straps or other tools or equipment must
be reported in writing to the Chief, stating by whom lost and lo-
cation. If, after investigation, it is shown that such loss was
due to carelessness, the person responsible may be charged the
purchase price.
It shall be the duty of members on apparatus floor, when strangers
enter quarters, to approach them and courteously inquire their
business. In case information is desired concerning Department
policy or personnel information, they shall refer such calls to the
company Captain.
ARTICLE IX - GENERAL RULES (cont1d)
SECTION 44 All members shall read and become familiar with City Ordinances,
Rules and Regulations and Orders relating to the Department.
SECTION 45 Any member of the Department violating any of the Rules and Regula-
tions, general or special orders of the Department or having know-
ledge of such violation and not reporting same, shall be subject to
disciplinary action.
SECTION 46 Nothing included in these Rules is intended to indicate elimination
of proper channels. In some instances intermediate ranks have not
been mentioned. The intent, however~ is that all matters will be
processed through the chain of command.
SECTION l~7 Employees of the Fire Department shall not belong to any organiza-
tion, association or society which will in any manner divide their
loyalty to the City of Gilroy, State of California, or the United
States of America, the purpose of this Rule being to retain only
those men who will serve the City, State and National Governments
faithfully and without allowing themselves to be influenced by any
organization, association or society to the detriment of their
obligations as City employees. Violation of this Rule will consti-
tute cause for suspension fr~~ the Department.
