RESOLUTION NO. 99-25
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING TM 98-11, A TENTATIVE MAP WITH
FOUR DUPLEX LOTS ON APPROXIMATELY 1.11 ACRES
LOCATED EAST OF EIGHTH STREET AND EAST OF
CHESTNUT STREET, APN 841-12-053
WHEREAS, Robert Martinez ("Applicant") submitted TM 98-11, requesting a Tentative
Map to subdivide an 1.11 acre parcel into four duplex lots; and
WHEREAS, the property affected by TM 98-11 is located east of Eighth Street and east
of Chestnut Street, as described in Exhibit A attached hereto; and
WHEREAS, pursuant to the California Environmental Quality Act ("CEQA"), a
Negative Declaration, along with a mitigation/monitoring program, was adopted for this project
by the City Council on February 16, 1999; and
WHEREAS, the Planning Commission reviewed application TM 98-11 at a duly noticed
public hearing on February 4, 1999, and recommended that the City Council approve
TM 98-11; and
WHEREAS, the City Council held a duly noticed public hearing on February 16, 1999, at
which time the City Council considered the public testimony, the Staff Report dated February 10
and February 9, 1999, and all other documentation related to application TM 98-11; and
WHEREAS, the location and custodian of the documents or other materials which
constitute the record of proceedings upon which this project approval is based is the office of the
City Clerk.
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The City Council finds as follows:

This Tentative Map is approved when, and only if,
full force and effect.

L The project is consistent with the site's land use designation on the General
Plan map, and with the intent of the General Plan text.
2. The project is consistent with the City's Subdivision and Land Development
Code, and the State Subdivision Map Act.
3. There are no facts to support findings requiring denial of the proposed
tentative map pursuant to Califomia Government Code section 66474.
B. Tentative Map TM 98-11 should be and hereby is approved subject to:
L The fifteen (15) conditions identified in the Staff Report dated February 10
and February 9, 1999, attached hereto as Exhibit B, and incorporated herein by this
reference.
2. The mitigation measures set forth in the Negative Declaration and the
mitigation/monitoring program, attached hereto as Exhibit C and incorporated
herein by this reference,

. An Initial Study of this project was undertaken and prepared for the purpose of ascertaining whether this project
might have a significant effect on the environment A copy of this study is on file at the City of Gilroy Planning
Division, 7351 Rosanna Street, Gilroy, CA 95020.
Findinv. & Re3.!lons
The Initial Study identified potentially significant effects on the environment However, this project has been
mitigated (see Mitigation Measures below which avoid or mitigate the effects) to a point where no significant
effects will occur. There is no substantial evidence the project may have a significant effect on the environ11ient
The following reasons will support these findings:
I. The proposal is a logical component of the existing land use of this area
2. Identified adverse impacts are proposed to be mitigated through preparation of special studies, and
construction of off-site improvements.
3.,.. The proposed project is consistent with the adopted goals and policies of the Gilroy General Plan.

4. The Initial Study was independently reviewed by 9ty staff; and this Negative Declaration reflects the
independent judgement of the City of Gilroy.

1 A qualified soils engineer shall prepare a soils investigation for the project The recommendations of
the soils investigation shall be incorporated into the final building plans and shall be reviewed and
approved by the Gilroy Engineering Division prior to approval of the building permit
2 The following control measures shall be incorporated into any permits issued for the proposed project
A Water all active construction areas at least twice daily.
B. Cover all trucks hauling soil. sand, and other loose mat.erials or require all trucks to maintain at
least two feet of freeboard. .'.
C. Pave, apply water three times daily, or apply (non-toxic) soil stabilizers,on,all unpaved acc~s
roads, p3rking areas and staging areas at construction sites. .
D. Sweep daily (with water sweepers) all paved access roads, parking areas and staging areas at
construction sites. .
E. S weep streets daily (with water sweepers) if visible soil material is carried onto adjacent public
streets.
F. Hydroseed or apply (non-toxic) soil stabilizers to inactive-con,struction areas (previously graded
areas inactive for ten days or more).
G Enclose, cover, water twice daily or apply (non-toxic) soil binders to exposed stockpiles (dirt, sand,
etc.)
H Limit traffic speeds on unpaved roads to 15 mplL
I. Install sandbags or other erosion control measures to prevent silt runoff to public roadways.
J. Replant vegetation in disturbed areas as quickly as possible.
.3 The applicant shall modifY the proposed cul-de-sac to enable the provision of four required guest parking
spaces, subject to review and approval by the Gilroy Planning Division prior to tentative map approval.
4 The following language shall be included on any permits issued for the project site, including, but not
limited to, building permits for the future development "All noise generating construction activities shall
be limited to weekdays between 7 AM and 6 PM, and to weekends between 8 AM and 6 PM. No
construction is allowed on Sundays. In addition, the developer will be required to use temporary berms
or noise attenuation barriers will be used where feasible."
5 The developer shall have a city approved noise analysis conducted by a qualified noise engineer. The noise
analysis shaI1 be used to determine the need for any noise attenuation structures or special building design
considerations. These design considerations shall be incorporated into the overall design of the project,
and shall be submitted for review and approval by the City Planning and Building Divisions prior to the
issuance of a building permit
6 Due to the possibility that significant buried cultural resOurcllS might be found during construction, the
following language shall be included in any permits issued fo.r the project site, including, but not limited
to building permits for the futme development, pursuant to the review and approval of the Gilroy Planning
Division:
"If archaeological resources or human remains are discovc:n:d during construction, work shall be halted at .
minimum of200 feet from the find until it can bC evaluated by. qualified professional archaeologist. If the find
is determined to be significant, appropriate mitigation measures shall be fonnulated and implemented "
