RESOLUTION NO. 2007-62
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
AUTHORIZING THE FILING OF APPLICATION DOCUMENTS FOR JOINT USE
FUNDING AND SITE ACQUISITION FUNDING FOR THE CHRISTOPHER HIGH SHOOL
GYMNASIUM FACILITY AND APPROVAL OF THE JOINT USE AGREEMENT
WHEREAS, the City of Gilroy established a partnership with the Gilroy Unified School
District with the acceptance of the Gymnasium at Ascencion Solorsano Middle School in 2003;
and,
WHEREAS, the City of Gilroy desires to partner with the District again, for another
gymnasium at the new Christopher High School, scheduled to open August of 2009; and
WHEREAS, there is an identified need for aN additional gymnasium for the community;
and,
WHEREAS, design development was completed leading to a detail design and plans for a
comprehensive high school including a second gymnasium multi-purpose building with an
estimated expenditure of $6,600,000, which has received support from the Gilroy Unified School
District (the "District") and the City Council of the City of Gilroy ("City"); and,
WHEREAS, the California Education Code provides for Type I Joint Use Funding for up
to 50% of New Construction cost under California Education Code 17077.42, Section
1859.122.21; and,
WHEREAS, the District has a need for such funding and there is a pronounced shortage
of funds remaining making the funding timeline for the 2007-08 funding year critical, creating
the need for the earliest possible submission; and,
WHEREAS, there is no assurance funds will be available in the new funding year; and,
WHEREAS, the District is electing to participate in Type II Joint Use funding for New
Construction; and,
WHEREAS, the District can pledge at least 25% of the cost of construction as its
matching share of the cost to qualify for Type I Joint Use funding from its Facilities Master Plan
commitment; and
WHEREAS, the City can pledge at least 25% of the cost of construction, not to exceed a
total contribution of $2.2 million, as its matching share of the cost to qualify for Type 1 funding
from its fiscal year 2010-11 capital improvement budget; and,

WHEREAS, a Joint Use funding application requires a Joint Use Agreement; and,
WHEREAS, a Joint Use Agreement (the "Agreement") has been drafted and reviewed by
District Counsel and the State of California Office of Public School Construction and the City
Attorney and the Agreement is incorporated by reference and is attached hereto;
NOW, THEREFORE, BE IT RESOLVED that the City Council ofthe City of Gilroy
does hereby authorize and direct the Mayor to execute the agreement with the Gilroy Unified
School District for the joint use of the gymnasium at the Christopher High School;
FURTHER, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Gilroy approves the submittal of the application documents for funding to the state of California
for Type I Joint Use funding.

resolution, duly adopted by the Council of the City of Gilroy at a regular meeting of said Council
