Present:Councilmen George M.Ilason,J.H.Wentworth,David V.Stout, Carl W.Pate. Absent:Councilmen James B.Thomas,Dale D.Daniels. :inutes of the regular monthly meeting of December 4th and the regular adjourned meetings of December 13th and December 18,1950 are stead and approved. A communication is read from the Gilroy Parent- Teachers Association invittng members of the Council to attend to a conference relative to schools, and ordered placed on file. A communication is read from Logan and Frazer,city auditors,with reference to a request from the Council to advise the Council in regard to their opinion as to whether or not the Gilroy Telephone Companyliv.request_to the Public Utilities Commission for an in- crease in rates is jutfified. The auditors suggest that the City Attorney be instructed to appear before the Commission and request s them to grant only a rate increase that if fully justifiable by their investigations. Motion by Councilman Pate,seconded by Councilman Stout and carried that City Attorney Sydney Johnson represent the City of Gilroy at the hearing before the Public Utilities Commission for the Gilroy Te$ephone Company's request for an increase in rates. A communication is read from the Division of Highways relative$ 1221. to franchises for public utilities and the relocating their facilities t o accomodate construction of a state highway as a freeway. The Clerk is instructed to advise the receipt of this communication as requested in the letter. A communication is read from the League of California Cities answering a request made for information with reference to height of fences. They advise that in the Bay Area Cities a six foot limitation is the most common practice;some cities have a four foot limitation on front yard fences and six foot limitation on side and back yard fences. This communication is ordered filed. A communication is read from the local National Guard Company offering to lease 4500 square feet of ground in the rear of Viheeler Aiditorium and fence the same. This matter is feferred to the Buildings and Grounds Committee for action. A communication is read from the Gilroy City Planning Commission re- affirming their original recommendation on the application of Vi.J.Hanna for rezoning a portion of his property and (2) recommending that R.C. Soward be granted a Use Permit to conduct a one -chair barber shop in in home at 304 N.Church Street,providing, no advertising signs are placed on the premises and that the business is conducted coley by R.C. Soward, the applicant. 1-lotion by Councilman Iiason,seconded by ; ouncilman Pate and carried that R.C.Soward be granted a Use Permit to conduct a one -chair barber shop in his home at 304 N.Church Street providing no advertising signs are placed on the premises and that Mr.R.C.Soward conducts the business himself. Notices of Application to Appropriate Water are now presented -one YVr Mrs.Ruth Veston to appropriate 0.250 aubi.m.'.feet of water from March 1 to November 30 from the Uvas Creek and one fav Fred O.Scheidegger to approripate 0.25 cubic feet per second from April 15 to July 15, from the Little Uvas Creek. The City Attorney is instructed to file a ,protebt,dgainst the application of Fred O.Scheidegger to appropriate water from the Little Uvas Creek. The Building Inspector's report for the month of December is presented and read and orderdd placed on file. This being the time specified in a legal advertisdment calling for bids for automobile and comprehensive liability insurance three bids are presented and read- United Pacific Insurance Company represented by Brown & Voorhies; Pacific Indemnity Company represented by E.E.Eustide 1222 and Travellers Insurance Company represented by August Piedmnt. mlbtion -.by: Counci. rmn St©utW6conded by Councilman Mason and carried that consideration of bids for Automobile and Comprehensive Liability Insurance be held over until Thursday,January 4th at 1 o'clock P.M. Councilman . <,.ason discusses the proposed increase in acreage of the South Santa Clara Valley 'slater Conservation District stating that the city's reservoir property and Sewer Farm property are included in the proposed annexation. .;lotion by Councilman Stout,seconded by Councilman Pate and carried that Councilman George M.Mason be authorized to sign the petition on behalf of the city for proposed annexation of additional acreage to to the South Santa Clara Valley 1,7ater Conservation District. Councilman Pate discusses loose cansat the garbage dump.°It is agreed that the franchise holders should remove these cans at once. Reports of the city officers are presented and read. Motion by Councilman Stout,seconded by Councilman Mason and carried that the reports of city officers be accepted as read and placed on file. .Notion by Councilman Stout,seconded by Councilman Mason and carried that bills as presented be allowed and tivarrants ordered drawn on the Treasurer.
