Present:- Counoilman, J.,H. Wentworth, Carl W. Pate, J.B. Thomas, Goo. M. Mason & David V. Stout. Absent: Councilman, Dale D. Daniels. Resolution No. 253 was presented and read. Motion by Councilman Stout, Seconded by Councilman Mason that Resolution No. 253 be adopted as read. RESOLUTION NO 21_ RESOLUTION MAKING THE CITY OF GILROY A MEMBER OF THE JOINT CITIES AND COUNTY CIVIL DEFENSE AND DISASTER PLANNING BOARD OF SANTA CLARA COUNTY AND DESIGNATING SAID BOARD AS THE DULY EMPOWERED AND AUTHORIZED AGENCY OF SAID CITY IN THE PLANNING OF CERTAIN FIELDS AND PHASES OF DISASTER PREPAREDNESS AND CIVIL DEFENSE. WHEREAS, experience has proved that in the event of a major natural disaster in any metropolitan region it is necessary that all units and agencies of government assist and cooperate with each other In dealing with the problems that maxi arise; and under the conditions of modern war, in the event of an attack by an enemy, the magnitude of the disaster would be increased to the point where such assistance and cooperation would be absolutely necessary for survival; and WHEREAS, together with the County of Santa Clara and the other municipalities therein, the City of Gilroy recognizes the need for joint planning and action, as well as for all -out city planning and action, in order to be-fully prepared for any eventuality that may occur; and WHEREAS, in order to achieve such joint planning and action, a JOINT CITIES AND COUNTY CIVIL DEFENSE AND DISASTER PLANNING BOARD OF SANTA CLARA COUNTY 1s hereby organized and shall consist of a body of one representative from each County Supervisorial District and each municipality with the exception of the City of Alviso, which for purposes of mutual aid and this resolution shall be considered an 122E unincorporated area, empowered by their City Council or County Board of Supervisors to represent them in joint planning for civil defense and disaster; and WHEREAS, it is desirable and necessary, in order that said Board may discharge its duties, that each of said municipalities and said County become a member of said Board by formal action of the legislative body of said municipality and said County, NOW, THEREFORE, BE IT RESOLVED THAT the City of Gilroy hereby becomes a member of said Board and designates said Board as the duly empowered and authorized agency within Santa Clara County charged with the following duties and responsibilities: 1. Define the Board's geographical area.of responsibility. 2. Formulate County -wide civil defense and disaster policies to guideplanning and operation for civil defense and disaster, con- tinuously emphasizing that said municipalities and County have individual local responsibility for full and continuous activities in preparing their own disaster and civil defense plans. 3. Develop a County -wide operating plan, embodying and coordinat- ing the service plans of the varous political subdivisions, acceptable �A to the State in accordance. with the Master Mutual Aid Agreement, and insuring that the following services are available and properly coordinated on a County -wide basis: (a) Air Raid warning service; ('b) Shelter protection; (c) Evacuation; (d) Warden service, or organized self- protection; (e) Mutual aid and mobile support; (f) Fire Service; (g) Law enforcement services; (h) Health services; (i) Emergency welfare services; (j) Engineering service; (k) Rescue service; (1) Communications; (m) Transportation; (n) Plant protection; (o) Supply service; (p) Civilian auxiliaries to.military activities; (q) Personnel service; (r) Public information and education; (s) Other services shall be added as are determined by the Board to be necessary. 4. Prepare an operating agreement acceptable to the majority of the political subdivisions within the County. 5. (a) Determine the need for a County -wide coordinator for the joint Cities and County Civil Defense and Disaster activities; 5. (b) If it is determined that a Coordinator is necessary, the dkties and authority of the position should be outlined and the method of appointment and removal established; 1229 (e) Consideration should be given to compensation, housing, transportation, communication, personnel and other details incident to the office of said Coordinator. 6. Consider recommendations for the appointment of County -wide Coordinators of each of the varous civil defense services and estab- lish a method of appointment and removal therefor. 7. Consider the State and Federal Plans for local disaster organization in the light of local conditions and follow the general pattern of those plans, modifying or expanding them as appropriate. 8. Consider need for budget and determine ways and means for the provision for finance and control of expenditures. 9 Consider the selection, financing, equipping, and staffing of one or more control eenters within the County. 10. Receive and consider reports pertaining to civil defense and make whatever recommendations might be deemed advisable. 11. Consider and take steps to secure maximum financial support from State and Federal governments. 12. Assist and make recommendations on decisions on any controv- ersy between any of the representatives of the parties hereto engaged in aiding the Board in developing County -wide operating plans. AND BE IT FURTHER RESOLVED that Byron Brown is hereby designated to represent and act for the City of Gilroy, as a member of said Board, and G.B. Carr is designated as alternate to act for him in his absence or inability to attend meetings of said Board. ADOPTED AND PASSED this 12th day of February, 1951, by the following vote: AYES: Councilmen, J.H. Wentworth, Carl W. Pate,J.B. Thomas, Geo. M. Mason and David V. Stout. NOES: Councilmen, None Absent: Councilman, Dale D. Daniels, ATTEST: Mayor Dep.City ler The Deputy City Clerk was instructed to inform Walter S. Gaspar, acting chairman of the Joint City County Civil Defense Planning Board that the Common Council had adopted the resolution making the City of Gilroy a member of the Joint Cities and County Civil Defense and Disaster planning Board of Santa Clara County. The matter of making necessary repairs to the house at the Golf Course was placed in the hands of the Buildings & Grounds Committee 1230 with power to act. Resolution No. 254 was presented and read. Motion by Councilman Stout, seconded by Councilman Thomas that Resolution No 254 be adopted as read. RESOLUTION NO. 254. WHEREAS, a majority of the eligible employees for whom coverage is requested by the City of Gilroy , hereinafter designated.as "Public Agency ", at an election, voted in favor of the Public Agency making a formal application to the State Director of Finance, hereinafter designated at the State, for inclusion of the said eligible employees of said Public Agency in an agreement between the State and the Federal Security Administrator for the coverage of such eligible employees under the insurance system established by Title II of the Federal Social Security Act, as amended and implemented by Chapter 46, Statutes of 1950, 3rd Extra Session; and WHEREAS, the Public Agency desires to file such an application with the State and to enter into an agreement with the State contain- ing terms and conditions whereby the State will take the necessary steps to extend to such eligible employees coverage under the said insurance system on behalf of the Public Agency; and WHEREAS, a form of application and agreement between the State and the Public Agency containing the terms and conditions for the inclusion by the State of the said eligible-employees-under the coverage of said insurance system on behalf of the Public Agency has been submitted to this body for consideration and action; NOW, THEREFORE, BE IT RESOLVED that the Public Agency execute the aforesaid applioation and agreement and submit the same to the State for acceptance and that the State be, and it is hereby, re- quested to include all said eligible employees of the Public Agency in an agreement between the State and the Federal Security Adminis- trator for the coverage of said employees under the insurance system established by Title II of the Federal Social Security Act, as amended or as may hereafter be amended; and BE IT FURTHER RESOLVED, that for the purpose of said application and agreement, P.A. Cox, City Clerk, 3 East 6th Street, Gilroy, California, be, and he hereby is, designated at the Authorized Agent of the Public Agency and is hereby authorized and directed to execute said application and agreement, as submitted, on behalf of Public Agency and to forward the same to the State for acceptance and 1231 further action; and BE IT FURTHER RESOLVED, that said Authorized Agent is further authorized and directed as the representative of the Public Agency to conduct all negotations, conclude all arrangements and sign all agreements and instruments which may be necessary to carry out the letter in intent of the aforesaid application and agreement and in conformity with all applicable Federal and State Laws, rules and regulations. ADOPTED AND PASSED this 12th day of February, 1951, by the following vote: AYES: Councilmen, J.H. Wentworth, Carl W. Pate, J.B. Thomas, Geo. M. Mason & David V. Stout. Gity Glerk The City Attorney was instructed to investigate the legality of the Use Tax to be used in connection with the Sales Tax in the City of Gilroy and to report to the Common Council at a later date.
