This regular monthly meeting of the Common Council is dulled to
order by His Honor Mayor George C.Milias.
Present:, George M.Mason,J.H.Wentworth,James B.Thomas,David V.
Stout,Carl +.Pate. Absent.: Councilman Dale D.Daniels.
Iinutes of the regular monthly meeting of February 5th and
regular adjourned meetings of February 12th,21st and 26th are read
arh approved.
The report of the Building Inspector for the month cf February,
1951 is presented and read and ordered placed on file.
The report of the Fire Department for the year 1950 is presented
and read along with reports for the years 1946 to 1949 inclmsive. -
These reports are ordered filed.
A communication is read from the Gilroy City Planning Commission
recommending the acceptance of the map of Tract No.725,Rea Subdivison
No.3,providing an easement for public utilities was provided along
the north line of Lots 1,2 and 3 as shown on the map and that a bond
in sufficient amount to cover the cost of curbs,gutters and sidewalks

as recomrlended at a joint meeting of the Ordinance C,'oEmittee and the
Planning Commission, be filed with the City Clerk. The City Attorney
is instructed to draw up the necessary resolution for acceptance of this
subdivision.
The franchise tax-return for the-Gilroy-Telephone Company for the year
1950 showing a tax of .; 1,199.38, is presented and read and ordered placed
on file.
The franchise tax return of the Coast Counties Gas and electric Company

" for the year 1950 showing a tax of 4,5,037.45, is presented and read and
ordered placed on file.
A report of water samples taken by the Santa Clara County Health
Department during the month of February,1951 , is presented and read.
Reports showed samples satisfactory and reports are ordered filed.
An Application for an On Sale Beer License by Louis hainero,d.b.a.
Lucky Club,27 S.Ivlonterey Street and an application for an On Sale Beer
and Viine license by Andrew Ochoa , d. b. a. El Charo Cafe , 77 S.hionterey
Street,transfer.from Daniel and Frances Ferrel, are presented. No
objection is made.
A commmunication is read from the Tax Colloctor of Santa Clara
County of:--ering to sell to the city of Gilroy three pieces of property
used by the city for easements or alley purposes the Tax Collector
stating that it was his desire to celar these properties from the county
de linquent roll.
11otion by Councilman Stout,seconded by Councilman Pate and carried
that the city purchase the property as outlined in the communication
from the County Tax Collector and that the City Attouney be designated
as the official to carry out the negotiations with the Santa Clara County
Tax Collector.
A communication is read iron the League of California Cities requesting
a 15% assessment on the city's annual service: chargeto defray expense
of extra personnel "to stay on top of the civil defense job and to get
on top of the controls as they come along ".

that 15% of the cities annual service charge of the League of California
Cities in the amount of �28.50 be be:. °foi-warded to the League to-,-be-used
for for the purposes outlined in their bulletin.

CIVIL DEFENSE AND DISASTER RESOLUTION.
7 ''REAS, ORDINANCE NO.493 of the City of Gilroy relating to civil
defense and disaster provides that the civil defense and disaster
organization,tiie distribution of civil defense powers and duties,
the assignment of functions and services and the recruitment,direction
and traning of personnel shall be prescribed by resolution adopted
concurrently with the adoption of said ordinance,now therefore,be it
RESOLVED, By the Cormion council of the City of Gilroy as follows:
Section 1. The civil defense and disaster organization of this
city shall be as hereinafter more particularly described and as
shown on the attached chart marked Eishibit A and entitled,"Suggested
Model Local Organization of Civil Defense." Said Exhibit A, including
all information shown thereon,is as much a part of this resolution
as 6f the materials and information set forth by said exhibit were
fully described herein.
Section 2. Division of Operating Services. There is hereby created
a division of operating services, For the purposes of civil defense
planning and organization, the chief of each operating service within
this division shall be responsible to the director through the assist-
ant director.
Within this division, there shall be the following civil defense
and disaster services:
(1) Fire service;
(2) Law enforecment service, which shall include the plant pro -
pection service;
(3) Engineering service,which shall include untility service,
shelter protection and rescue service;
(4) Health and medical services,which shall include special weapons
defe -.se; and,
(5) Emergency welfare service,which shall include mass feeding and
shelter.
The director shall appoint a chief of each service,except as here-
inafter provided. The chief of the fire department of the Lity of
Gilroy shall be chief of the Fire Service, The chief of police(City
11arshal) of the City of Gilroy shall be the chief of the law enforce-
ment service. The city engineer of the City of Gilroy shall be the
chief of the engineering service.
Section 3. Division of S -oecial Services. There is hereby created
a division of special civil defense and disaster services. This
division shall be under the direction of a deuuty director of civil
defer se.who shall be appointed by the director. For the purpose of
civil defense and disaster planning and organization,the deputy dir-
ector is respobsible to the director through the assistant director
of civil defense and disaster.

(1) mutual adi plans;
(2) evacuation service;
(3) transport &tion service;
(4) warden service;
(5) corimunication service,which shall include civil air raid -iarn-
ing;

(6) Supply service;
(7) public affairs and information service;
(8) training service;
(9) personnel service ,which shall include the recruitment of civil-
ian auxiliaries to military activities;and,
(10)general adainistration service.
The director shall appoint a chief of each such service who shall be
responsible to the deputy director of the division of special services.
the director may appoint the same person as chief of two or more services.
Section 4. Legal. The city attoenry shall serve as legal advisojt to the
director of civil defense and the civil defense organization.
Section 5. American _ed Cross. The American ed Cross in the City of
Gilroy will, in the natural disaster, furnish food,clothing,shelter,
registration and information service,su>plementary medical service when
requested, and rehabilitation to individuals and families affected by
the disaster.
In war - caused disaster, t'_,e American Red Cross will furnish only
food,clothing and shelter to affected individuals and families.
The American pied Cross will provide funds with which to finance all
its relief operations during natural disaster. Civil defense financing
will be provided by public or private agencies other then the Iced Cross
for Red Cross functions in war- caused disasters.
The director shall be responsible for arranging,through the chairman
of the local Red Cross Chapter, for the participation of the Iced Cross
in civil defense as a ?cart of the mass care service in case of war -
caused disaster, and for the relationship between the I,ed Cross and the
civil defense organization in case of natural disaster.
Sec.6. Duties. The civil defense and disaster duties of the deputy
director and the chiefs of operating services and special services shall
be as described in "United States Civil Defense," National Security
Resources .Board Document 128,dated September 8,1950, copies of which
shall be filed in the office of the city clerk for use and examination
by the public. Such duties as described on "United States Civil Defense"
may be changed from timle to time by the director by written administra-
tive orders,particularly for the ourpose of conforming to recozr�iendations
of the State director of Civil Defense or subsequent modifications
recommended by the Federal Civil Defense Administrator. Upon recommend-
ation of the civil defense and disaster council of the City of Gilroy,
such duties shall be changed in accordance with such recommendations.

the Sales and Use `i"'ax Ordinance over the Sales Tax Ordinance.
hr.Robert Byers,president of the Chamber of Co,-,ulerce, now presents
Allan G.Anderson,field representative of the Tiunicipal Tax Association
who discusses the ordinance. A representative of the Gilroy Farm Bureau
is called upon by the hayor for comment. I,1r.George Kane,past president
of the Gilroy Chamber of Commerce, now appears before the Council to
discuss the ordinance.

Chapter 104,Statutes 1946,1st Extraordinary Session,provides:
"The California State Disaster Council shall establish by rule
and regulations various classes of disaster service workers
and the scope of the duties of each class. The California State
Disaster Council sjall also adopt rules and regulations prescrib-
ing the manner in which disaster service workers of each-class
are to be registered. All such rules and regulations shall be
designed to facilitate the paying of vior1ments cor_pensat ion" ,and
, ".11EREAS, the California State Disaster Council on April 4,1946,
adopted rules and regulations establishing classes of disaster

service workers, the scope of duties of each class and the manner of
registration of 'such volunteer iiorkers: and

certified by the California State Disaster Council. Upon making
such certification, and not before, the disaster council becomes
