This regular monthly meeting of the Common Council is called to
order by His Hone Mayor George C.Milias.
Present: Councilmen J.H. Wentworth, James B.Thomas,David V.Stout,
Carl W.Pate. Absent:Councilmen George M.Mason,Dale D.Daniels.
IAinutes of the regular monthly meeting of May 7th and regular
adjourned meetings of May Plst,25th ,1951 are read and approved.
The Poundmasters report for May,1951 is presented and read and
ordered filed.
An application for an On Sale Beer License from John A.Bautista,
d.b.a.Johnnie's Pool Hall,149 S.Monterey Street, is presented. No
objection is made.
An application to appropriate water from the Uvas Creek is
presented and read.
Motion by Councilman Stout,seconded by Councilman Pate and
carried that the application to appropriate water from the Uvas
Creek be protested and the City Attorney instructed to file the
necessary protest with the Division of eater Resources.
The report of arrests and citations issued by the Police Depart-
ment for the month of May,1951 is presented and read and ordered
placed on file.
The report of the Building Inspector for the month of May,1951
is presented and read and ordered placed on file.
The report of water samples taken by the Santa Clara County
Health Department is presented and read and ordered placed on
file.
A communication is read from the State Defense Council stating

presented and read and ordered filed.
A communication is read from Senator John F.Thompson acknowledging
the city's request that he oppose Assembly Bill No.1981 dealing
with the allocation of costs for grade separations.This communication
is ordered filed.
A communication is read from the Public Utilities Commission
stating that their records indicate that this city has completed
100 per cent the recoa=endations made by the Commission for improve-
ment and reduction ct[ potential grade crossing hazards. The communic-
ation is o rdred filed.
A communication is read from the Gilroy Gilders thanking the Council

for free use of Wheeler Auditorium for their annual Spring Time
Folk and Square Dance Festival. This comiunication is ordred filed.
The Mayor now discusses the condition of the grandstand and bleackers
at the Gymkhana grounds and states that they are in need of repairs
and that the Gilroy Gymkhana Association will give the sum of $3000.
towards the cost of making the repairs.
The Mayor now calls for bids submitted by local contractors for
necessary repairs at the Gymkhana grounds.
The following bids are presented: George C.Renz Construction
Company - $8,446.00; Gordon Farotte - $7878.00; Horace Willard-$7,760.00;
William Radtke & Son - $9,750.00.
Motion by Councilman Stout,seconded by Councilman Thomas that the
bid of Horace WillArd of $7,760.00 for repairs to the grandstand at
the Gymkhana grounds be accepted as the lowest and best bid;that all
bids be given to the City Attorney and held by him in the event that
the low bidder defaults; that the necessary contract be drawn with
provision for bonds for material,labor and completion.
A communication is read from the Santa Clara County Defense Council

The Mayor now reads the mutual aid fire agreement.
Lotion by Councilman Stout,seconded by Councilman Thomas and carried
that the mutual aid fire agreement with the Santa Clara County Defense
Council be accepted and e1quuted.
A communication is read from the Santa Clara County Defense Council
requesting adoption of an attached resolution dealing with a request
to the State Legislature for an appropora$ion to establish a communica-
tions net -work of civil d6fense in the nine Bay counties.
RESOLUTION NO.262 is presented and read.
Motion by Councilman Thomas,seconded by Councilman Pate that RESOLUTION
NO.262 be adopted.
RESOLUTION NO.262
WHEREAS, the operational area coordinators meeting in joint session
have adopted a program of communications within the mutual aid Region
3, and have adopted the following resolution,
RESOLVED, by the operational coordinators that the necessary commun-
ications network will be from Region 3 control center to the operational
are control eenters,and from the operational area control centers to the
local city and county control centers. The network approved and ree mend
ad including radiotelephone, and the like, would require the expenditure
of all or a part of $200,000. This system would be used exclusively for
the dissemination of attack warning information and for the transmitting
and receiving of necessary communications to make the region and its
operational areas effective.
It is the unanimous concurrence of the operational area coordinators
that the provision of this communication network is a State responsibil-
ity and that it is of immediate necessity that action be talon mow to

protect the life and property within this critical target area.
The effectiveness of the entire civil defense program within this
critical target area is dependent upon such an essential communications
network.
THEREFORE, be its resolved, that this body consider that this matter
is of such grave importance that State funds should be made available
immediately.
AND BE IT FURTHER RESOLVED that this resolution shall be forwarded
to the Governor,Major General W.M.Robertson,USA,(Retired), and the
representatives of the Cities and Counties in session at Sacramento.

A resolution requesting that the County Planning Commission plan
fear adequate play ground and recreation facilities in territory
bordering cities in the county, from the City Council of Lo# Gatos
is presented and read.
It is unanimously agreed to defer action on this resolution until
Jule 2nd.
The Mayor now states that this is the time specified after the
formal hearing on rent decontrol that the Council would consider
this matter furtheripEis Honor now asks if there is any person present
who desires to protest and /or object to to rent decontrol for the
City of Gilroy. No person appears to protest and /or object to rent
decontrol in the City of Gilroy.
RESOLUTION NO.263 is presented and read,and amendments are made.
Motion by Councilman Thomas Seconded by Councilman Stout that
RESOLUTION NO.263 be adopted,with amendments.
Attorney Robert K.Byers now appears before the Council after dis-
cussion by Councilman of the transcript of the testimony and states
that the case for rent decontrol as presented at the formal ,hearing
was not very strong.
RESOLUTION NO.263
WHEREAS,a petition to decontrol rents in the City of Gilro y,County
of Santa Clara, State of California,a copy of which is attached hereto,
was filed with the Common Council of the City of Gilroy one the 7th
day of May,1951; and,
'WHEREAS, such petition, on its face, recited facts sufficient to
require the Common Council of the City of Gilroy to call a public
hearing to consider decontrolling rents; and,
WREREAS, the attached notice of the date,time,plaee and purpose
of such public hearing was published twice in the Gilroy Evening
Dispatch, a newspaper of general circulation published and circulated
in the said City of Gilroy, on the 9th and 16th day of May,1951;and,
M1EREAS, the Common Council of the City of Gilroy held a public
hearing at the time,date and place for the purpose set forth in such
published notice; and,

IHEREAS, at such public= hearing all interested persons were given a
reasonable opportunity to be heard, with the right to be represented by
Counsel ; and the said hearing was regularly continued to May 22,1951,
at the hour of 1:00 o'clock P.M., at which time all interested persons
present were given a reasonable opportunity to be heard and a portion
of said interested persons were resprsented by Attorney Robert K.Byers,
and evidence in support of said petition was duly given and no one
appeared at either of said hearings in opposition to the said petition;
and,
IBEREAS, a transcript of the record of such public hearings comprise
the entire record upon which this finding and resolution are based and
a certified copy of such record is attached hereto; and,
WHEREAS, the Common Council of the said City of Gilroy, did at the
conclusion of the said hearing held on the said 22nd day of May,1951,
regularly continue the hearing until the 29th day of May,1951,at the
hour of 8:00 P.M. at the same place fixed in the original notice and no
one appearing at the said hearing on the 29th day of May*1951, to
contest the said pet it ion and the said Common Council having duly
considered all of the evidence presented at such hearings and taken the
same under advisement; and
10EREAS, rents have been decontrolled in all of the incorporated
areas of Santa Clara County as well as all of the incorporated cities
and towns in the said county with the exception of Alviso and the City
of Gilroy, and it is common knowledge that there is less need for rent
control in the City of Gilroy than in any other portion of the County
except possibly the Town of AlvisO; now,therefore,
THE COivr. "ON COUNCIL OF THE CITY OF GILROY does hereby find and
resolve as follows: That there no.longer exists in the said City of
Gilroy such a shortage of rental housing accomodations as to require
rent control in such City.
Adopted,signed and approved this 4th day of June,1951m by the
following vote:

Mr.Chas.Acker of Acker & Sims,garbage franchise holders, now appears
before the Council to request that the ordinance setting garbage collection
rates be amended.
It is unanimously agreed to refer this matter to the Ordinance Committee
for investigation and to make the necessary amendments to the ordinance.
Mrs.Lee Berta representing the Veterans of Foreign Wars now appears
before the Council to request permission to hold a street dance on the
evening of July 13th. After considerable discussion it is agreed that
the City Clerk contact the Armory Board chairman,Lt.Col.Robert Greig,
to ascertain if it would be possible for the V.F.W. to hold their
proposed dance on July 13th in the Auditorium instead of the street.
Mr.George C.Renz,owners of subdivision in the northwest section of
the city now appears before the Council to discuss the paving of a
portion of Hanna Street , north of Broadway; Carmel Street north of Broad -
weV and all of La.Sierra Way. `Pais matter is feferred to the Street
Committee to,meet with Mr.Renz to discuss this matter.
This being the time specified in a legal notice calling a hearing

on the proposed annexation of the Renz - Wayland Lane tract the Mayor now
asks if there is any person present who desires to speak against the
proposed annexation of this tract. No person appears to protest and /or
object.
Motion by Councilman Stout,seconded by Councilman Thomas and carried
that the hearing on the proposed annexation of the Renz Wayland Lane
tract be postponed until Monday,July 2nd,1951, at the hour of 8 o *clock
P.M. in the Common Councilroom,City Hall,Gilroy.Califormia.
Building Inspector Byron Brown now appears before the Council to
discuss a request made by Mr.John Ciabattari to mare a sewer connect.-
ion to his property lying two feet outside the aWth'..Qity.'limits.

as may be required by the city. It is agreed that the Building
Inspector discuss the matter of annexation with Mr.Ciabattari.
Councilman Wentworth discusses the matter of the parking lot on
the Stuart property on Martin Street. It is unanimously agreed that
Councilman Wentworth discuss the plan drawn up by the City Engineer
with Mr.Stuart.
Motion by Councilman St out,seconded by Councilman Pate and carried
that the suma of $10,000.00 be transferred from the Water Fund to
the General Fund.
Reports of city officers are presented and read.
Motion by Councilman St out,seconded by Councilman Thomas and carried
that the reports of city officers be accepted as read and placed on
file.
Motion by Councilman Stout,seconded by Councilman Thomas and carried
that bills as presented be allo and and warrants ordered drawn on the
Treasurer.
