In the absence of His Honor the Mayor this regular monthly meeting
of the Common Council is called to order by the City Clerk.
Present:Councilmen George M.Mason,J.H.Wentworth,James B.Thomas,
David V.Stout,Carl W.Pate. Absent:Councilman Dale D.Daniels.
Motion by Councilman Stout,seconded by Councilman Pate and carried
that Councilman George M.Mason be Mayor pro -tem.
Minutes of the regular monthly meeting of August 6th and regular
adjourned meetings of August 22nd,23rd and 27th are read and approved.
A report of water samples tested by the Santa Clara County Health
Department is presented and read. All samples showed satisfactory and
are ordered filed.
The report of the Poundmaster for the month of August,1951 is presented
and read and ordered placed on file.
The report of arrests and citations issued by the Gilroy Police Dep-
artment for the month of August,1951 is presented and read and ordered
placed on file.

The report of the Building Inspector for the month of August,1951
is presented and read and ordered placed on file.
Resolution No.43 of the Gilroy City Planning Commission recamending
certain changes in zoning on Old Gilroy Street between Alexander
Street and Chestnut Street, is presented and read.
RESOLUTION NO.266 is presented and read.
Motion by Councilman Thomas,seconded by Councilman Pate that
RESOLUTION NO.266 be adopted.

RESOLUTION NO.266 OF TIY� CITY OF GILROY FIXING THE TIME AND PLACE
FOR HEARING THE REPORT AND RECOIZIIENDATIONS OF THE CITY PLANNING
COT&IISSION OF THE CITY OF GILROY THAT THE ZONING ORDINANCE OF THE
CITY OF GILROY BE AMENDED BY EXTEND ING THE BOUNDARY LIIMS OF ZONE
"Cl" DISTRICT TO INCLUDE ADDITION OF TERRITORY NOW IN ZONE "B ".
�'PfiEREAS the City Manning Commission of the City of Gilroy has
regularly adopted a Resolution reporting and recommending to the
Common Council of the City of Gilroy that Ordinance No.422,known
as the "Zoning Ordinance ", of the City of Gilroy, be amended by
reclassifying and placing in Zone "Cl" District the following
described premises located in the City of Gilroy now in Zone "B"
District,to -wit:
Lots 1,2,3 and 4 in Block 2 South of Range
4 Last of the City of Gilroy,as shown on
Map No.6 and its amendments accompanying the
report of the referees in the Las Animas Rancho
partition suit Action No.5536 had in and for
the County of Santa Clara,
All of Block 2 Range 4 East of the City of
Gilroy as shown on Td=ap No.6 and its amendments
above referred to. Also Lots 1,7,8,9 and 10 in
Block 2 :youth Range 3 East,and Lots 4 and 5
in Block 1 South Range 3 East,as shown on the
said map above referred to.
Also the following described portion of Lot 6
in Laid Block 1 South Range 3 East:
Commencing at the point of intersection of the
easterly line of Alexander St. with the northerly
line of Old Gilroy Street -and running thence in
a northerly direction along the easterly line of
Alexander Street 126.06 feet; thence at right
angles in an easterly direction to the westerly
line of an alley;thence in a southerly direction
along the said line of said alley to the northerly
line of Old Gilroy Street and thence in a westerly
direction along the northerly line of Old Gilroy
Street to the point of beginning.
Also the following described portion of Block 2
South Range 4 East as shown on the Map above
referred to:
Commencing at the point of intersection of the
70esterly line of Chestnut Street with the south
line of Old Gilroy Steeet,running thence Southerly
along the west line of Chestnut Street 132.64 feet;
thence at right angles in a westerly direction 150
feet;thence at right angles in a northerly direction
45 feet;thence at right angles in a westerly direction
150 feet to the east line of Forest Street;thence
along the easterly line of Forrest Street in a north-
erly direction to the South line of Old Gilroy
Street;thence along the South line of Old Gilroy
Street in an easterly direction to the point of
beginning.

Reference is hereby had to the maps and general zoning ordinance of the
City of Gilroy now on file in the office of the City Clerk of the City
of Gilroy.
And, 7EEREAS the ordinances of the City of Gilroy and the laes of
the State of California require that a hearing be had before the Common
Council of the City of Gilroy mpon the said report and recommendation,
and that a time and place be fixed for said hearing, and that due and
legal notice thereof be given,
NOW,THEREFORE,BE IT RESOLVED that a public hearing be had before
the Common Council of the City of Gilroy upon the said report and
recommendation, and that Monday, the 24th day of September,1951, at
the hour of 8:00 o'clock P.M. of said day at the Common Councilroom
in the City Hall in the City of Gilroy,County of Santa C1ara,State
of California, be and the same is hereby fixed as the time and place of
hearing said report and recommendation and to act thereupon.
AND, BE IF FURTHER RESOLVED that the City Clerk give notice of the
said hearing in accordance with law.

A report ,findings and recommendations/oft the matter of Mary C.
Hudson,J.W.Dugan and B.C.Aufdengarten and Jehovah's Witnesses
application for a Use Permit to construct a church building at the
northwest corner of Seventh and Chestnut streets,is presented and read.
It is unanimously agreed to hold the matter of granting the Use Permit
to Jehovah's Witnesses until September 24,1951.
A communication is read from the Division of Highways relative to
parking on state highways. This communication is ordered filed.
A c cmmunieat ion is read from the Gilroy (Fliders requesting free use
of Wheeler Auditorium for a dance festival October 20th,1951.
Motion by Councilman Pate,seconded by Councilman h1ason and carried
that the Gilroy Gliders be granted permission to use Wheeler Auditorium
free of charge for their dance festival,October 20,1951.
A communication from Fredrickson & Watson Construction Company to
the Chamber of Commerce is presented and read. and ordered filed.
A communication is read from the Division of Highways granting
permission to instal twin -stall parking on Monterey Street between
Fourth Street and Seventh Street is read with suggestions that
certain requirements of the Division of Highways be incorporated in
a new Resolution. This matter is referred to the City Sttorney with
instruction to draw the necessary resolution.
2 7/4 A communication is read from the Public Utilities Commission of
the State of California advising that a hearing for increase in rates
by the Pacific Telephone and Telepgraph Company will be held i4L
San Francisco, September 6,1951. This communication is ordered filed.
A communication is read from Russell R.Crane,ll Monte Vista ;say,
calling to the attention of the Council the drainage problem in the
area in which he resides. This communication is ordered placed with
information,ete. connected with the P«iller Avenue drainage plan.
A communication is read from the San Martin Sales Company stat-
ing that the company will assume the pro -rata cost the sewerage
in Chstlewood Park but will not pay any amount charged against
them for water. It is unanimously agreed to invite Mr.M.J.Filice
to attend the Council meeting September24,1951, to discuss: this
matter further with him.
A communication is read from the commanding officer of the local
National Guard Reserve Companjr requesting the Council's permission
to use feeler Auditorium a a po#t of mobilization and quarters
in the event of an emergency. The Clerk is instructed to advise
the commanding officer that the Council will cooperate in every
way with the National Guard Reserve in the event of an emergency.
Application for transfer of An Off Sale General Liquor license
from J.C. & Mabll Bray to Eva & Roger Stapleton,ge neral partners
and J.C.&Mable Bray limited partners,40 Old Gilroy Street;transfer
of an On Sale Beer and `,'ine License from Albino Berri and C.DeCarli
to Mrs.C.DeCarli,d.b.a.Swiss Hotel,85 S.Montere y St.;and an On Sale
Beer license to J.F.Baker and C.H.Morgan,d.b.a.Pacheco Gafe,30 Old
Gilroy Street, are presented. No objection is made.

A map /showing several methods of handling the proposed 11iller
Avenue drainage problem is presented. This map is ordered filed
fcrr future reference.
Mr.John Bozzo a resident of the Second ';Iestern Addition, now
appears before the Council to discuss the progress being made in
placing the utilities in the Second Ilestern Addition. Several other
Persons residing in the area are also present. The Mayor suggests
that those present residing in the area form a committee to call
upon those who have not paid their costs of installation of utilities
and urge them to do so at once. The Mayor states that he will call
a special meeting for Mlonday,September 10,1951 at 8 o'clock P.M.
in the Councilroom, for the purpose of hearing a report from the
canvassers and to determine at that time whether or not all-money

paid in will be returned and steps taken to form an improvement
district out of the area or whether the city will proceed with the
work as planned under the agreement that all honey for the utilities
must be paid before any work in the area ins started. The group of
property owners in the area that are present ask if thy can have a
list of those property owners Who have not paid their pro-rata cost.
This request is unanimously granted.
The Mayor now calls to the attention of the Council the manner in
which television aerials are being erected throughout the city and
states that there is great danger from these aerials in the event
of a high wind storm. A sample ordinance is presented and the
Ordinance Committee is instructed to have the City Attorney draw up
an ordinance covering the erection of television aerials and present
it at the next regular monthly meeting.
Councilman Pate discusses the matter of Purchasing Agent G.B.Carr
attending Purchasing Agents meetings and paying his own expenses.
Motion by Councilman Vdentworth,seconded by Councilman Stout and
carried that Purchasing Agent G.B.Carr be allowed the sum of $1540
for expenses when attending Purchasing Agenys meetings.
Councilman Stout discusses the matter of alley approaches.Discussion
on this matter as to whether the city should pay for the approcahes
of the property owners be required to pay their pro -rata share of
the cost,follows. This matter is referred to the Street Committee
for investigation and report.
Reports of city officers are presented and read.
T;otion by Councilman Stout,seconded by Councilman Pate ind carried
that the reports of City officer be accepted and placed on file.
Motion by Councilman Stout , seconded by Councilman Mhomas and carried
the. t bill as presented be allowed and warrants ordered drawn on the
Treasurer.
