Present:Councilmen George M.Mason,J.H.Wentworth,James B.Thomas,David V.Stout,Carl W.Pate. Absent:Councilman Dale D.Daniels, The City Attorney presents a pvnposed contract between Dr.Leon and Mrs.Beatrice Melkonian and the City of Gilroycwith reference to an their easement through Yis property for sanitary sewer and Storm sewer and providing that for this easement Dr.& Mrs.Melkonian would not be charg- ed dnp of the cost of installation of sanitary sewer and storm sewer and water mains in the Second Western Addition. Motion by Councilman Thomas,seeonded by Councilman Pate and carried that the contract between Leon and Beatrice Melkonian and the City of of Gilroy,as read by the City Attorney, be accepted. Daniel s APPROVED: Mayor Attest: City Clerk Mr.John Stelling,owrB r of property on Miller Avenue, is present. The Mayor now reads a letter dated September 12,1951,signed by Mr-Howard Campen,County Counsel for the County of Santa Clara,which letter sets forth the proposition being offered to the City of Gilroy by the County of Santa Clara with reference to the matter of drainage on Miller Avenue. The Mayor now discusses the contents of the letter and states that the Division of Highways is definetly not interested in the project - this information coming from Mr.Fred Montell of the Division of High- ways with whom members of the Council had met during the noon hour. The I4iayor now addressefnimself to Mr.John Stelling - reviewing the proposed project for drainage on Iailler Avenue by the installation on a pump and 4500 g.p.m.pump on the west side of Liller Avenue near its intersection with Sixth Street and piping to run from the pump to the top -of the levee on Carnadero Creek and the Mayor asks' Xr. Stelling that if this work is done and the pump is maintained by the City would he consent to sign a waiver relieving the City of Gilroy from..:§;ny damages to his property in the future. Mr.Stelling answered that he would not sign anything waiving the city's liability even with the installation of a 4500 gallon per minute pump.It is then suggested that as an alternate plan that the pump and sump be erected at the intersection of Fifth Street and Biller Avenue. Iiotion by Councilman Stout,seconded by Councilman Mason and carried that the entire project on Iviiller Avenue be returned to the County of Santa Clara as the proposition is not acceptable to the City. Adjourned subject to the call of the chair. City Clerk
